003 of 2021 - West End Alley Vacation (Adjacent to Properties Located at 740 West and 746 West 900 South)No. PLNPCM2020-00268, and which is more particularly described on Exhibit “A” attached
hereto, hereby is, vacated and declared not presently necessary or available for public use.
SECTION 2. Reservations and Disclaimers. The above vacation is expressly made
subject to all existing rights-of-way and easements of all public utilities of any and every
description now located on and under or over the confines of this property, and also subject to
the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or
rerouting said utilities, including the city’s water and sewer facilities. Said vacation is also
subject to any existing rights-of-way or easements of private third parties.
SECTION 3. Conditions. This proposed street vacation is conditioned upon the
following:
1) The proposed method of disposition of the alley property shall be consistent with the
method of disposition set forth in Section 14.52.040 (“Method of Disposition”) and
Chapter 2.58 (“City Owned Real Property”) of the Salt Lake City Code; and
2) The vacated alley be consolidated into the parcel located at approximately 740 West
900 South Street.
SECTION 4. Effective Date. This Ordinance shall become effective on the date of its
first publication. The city recorder is instructed not to publish or record this ordinance until the
conditions identified above have been met as certified by the director of the Salt Lake City
Planning Division or his designee.
SECTION 5. Time. If the conditions identified above have not been met within one year
after adoption, this ordinance shall become null and void. The city council may, for good cause
shown, by resolution, extend the time period for satisfying the conditions identified above.

Condition 2 of this ordinance is considered satisfied because the condition cannot be completed until the ordinance is
published.The vacated portion of the ally cannot be consolidated until it is considered real property and owned by the
adjacent property.The condition is in the ordinance is not enforceable until after the ordinance is published.My
certification is contingent on the applicant consolidating the vacant portion of the alley with the adjacent property prior
to issuing any building permits.Which likely would have to occur for the future development to comply with
development regulations.The Planning Division will flag this condition in Accela so it will be identified by any city staff
who may perform a required review of any future building permit and no further action is required by the City
Recorder’s Office to address the consolidation.
