An ordinance creating the office of Attorney for Land and
Water Rights.
Be it ordained by the Board of Commissioners of Salt Lake
City, Utah:
' SECTION 1. There is hereby created the office of Attorney
for Land and Water Rights, which office shall be filled by appoint
meat of the Board of Commissioners, and the appointee to said
office shall be an assistant City Attorney.
SECTION 2. It shall be the duty of the Attorney for Land and
Water Rights to have particular charge, under the direction of the
head of the Legal Department, and in conjunction and co-operation
with the other officers of said Department, of litigation involvin
the titles and rights of Salt Lake City to land and water; and to
prosecute and defend all suits wherein such rights are asserted or
called in question. He shall also conduct such other litigation
and attend to such other legal matters on behalf of the city and
its officers as the head of the Legal Department or the Board of
Commissioners may require. He shall compile a complete and aeon-
ate record of the titles to all real estate of every description
owned by Salt Lake City, or in which said city may be interested.

eoessary steps to perfect the titles to all real estate and water
lights owned or claimed to be,owned by the said city. He shall
locate and familiarize himself with all the lands owned or contmoll:d.

hall ascertain whether or not each particular parcel is occupied,
nd if occupied, by whom and under what authority. He shall
rromptly report to the Commissioner of Parks and Public property
.henever the city's title to or right in any of said property is
eopardized in any way. He shall locate and familiarize himself;';

with all water rights owned or controlled by Salt Lake City, or in
which said pity is interested, whether within or without the city
limits, and shall compile complete records of all such rights,
with a description as accurate as possible of each of said water
rights, of the use to which the oity's testa interest:: therein is
applied, and of the general condition, nature and title of all sai.'

and Waterworks whenever the city's title to, or rights to any of
said water are jeopardized in any way. He shall report generally
or specially when called upon to do so By the Board of Commissione s.
SECTION 3. It shall be the duty of the Attorney for Land and
Water Rightd to keep a complete and accurate record, properly in-
dexed, of all transfers of real estate to and from Salt Lake City,
and also to keep a complete and accurate record of all other in-
struments and transactions which affect the title to real estate or
water rights belonging to the city or in which Salt Lake City is
interested. It shall further be his duty to make or cause to be
made a map showing in colors each particular tract of parcel of
land owned by Salt Lake City, or in which Salt Lake City has any
interest. He shall deliver to the City Auditor during the month
of December of each year, a revised list of all real estate belong-
ing to the city, together with an estimate of the value of the
several parcels thereof, at the time said list is made.
He shall keep advised -of any and all filings in the office of
the State Engineer, which in any way may affect Salt Lake City or
its right or title to the use of any waters, or water rights owned
or claimed by it, or in which it is interested, and shall take all
4eoessary steps to protect the interests of the city therein.
He shall prepare and submit in detail a report to the Board
of Commissioners, not later than December 31st of each year, of all
ransactions affecting the sale, purchase, transfer or lease of

any real estate or water rights belonging to the city, or in which
the city is or may be interested, together with a detailed report
of all actions brought for or against Salt Lake City, relating in
any way to real estate or water rights belonging to the city.
SECTION 4. Whenever the Board of Commissioners contemplates
purchasing any real estate or any interest therein., or whenever
any real estate or any interest therein is about to be conveyed or
transferred to Salt Lake City, the grantee of said real estate or
interests shall furnish to the city a complete and accurate abstrall
of title to the property, which abstract shall be examined and
passed upon by the Attorney for Land and Water Rights, end a repor
of the condition of title made to the Board of Commissioners. If
the purchase is made, the deed of conveyance or other instrument o
transfer stall, without delay, be delivered to the City Auditor,
who shall immediately cause suoh deed or other instrument to be
recorded in the office of the Recorder of the county in which such
real estate is situated, and after such deed or other instrument
has been so recorded, it shall be delivered to the Attorney for
Land. and Water Rights for record. The purchase price or other
consideration for conveyance or transfer of any real estate or any
interest therein to Salt Lake City, shall net be delivered to the
grantor until he shall have complied with the requirements of this
Section.
Whenever any real estate or any interest therein is conveyed,
transferred or granted by Salt Lake City, the deed, lease, contract
or other instrument shall be recorded in the legal department,
before being delivered to the grantee. If in any case it shall be
impracticable to record said deed or other instrument before de-
livery, then a true copy thereof shall be immediately furnished to
the legal department.
SECTION S. The compensation of the Attorney for Land and
