An ordinance providing for the issuance of Two Hundred Thousand Dollars (000,000.00) Refunding Bonds of Salt Lake City, Utah, Series of January 15, 1954, introduced by Commissioner, Marcus , was taken up and read and on motion of Mr. Marcus passed, all members present voting aye. AN ORDINANCE AN ORDINANCE PROVIDING for the issuance and sale of Two Hundred Thousand Dollars ($200,000.00) Refunding Bonds of Salt Lake City, Utah, Series of January 15, 1934. WHEREAS, at a regular meeting of the Board of Commissioners of Salt Lake City, Utah, held on the 20th day of January, 1933, said Board of Commissioners provided for the issuance of One Million Two Hundred Thousand Dollars ($1,200,000.00) Salt Lake City Tax Anticipation Bonds, Series of January 16, 1933, bearing interest at the rate of three and 20/100 (3.20%) per cent per annum, payable semi-annually on the 15th day of July, 1933, and the 16th day of January, 1934, numbered and in denominations as follows: Bonds numbers one (1) to fifteen (15), both inclusive, being in the denomination of Fifty Thousand Dollars ($50,00).00) each; bonds numbers sixteen (16) to thirty-three (33), both inclusive, being in the denomination of Twenty-five Thousand Dollars (025,000.00) each, said bonds bearing date of January 16, 1933, and being due and payable January 16, 1934, and designated as "Salt Lake City Tax Anticipation Bonds, Series of January 16, 1933," said bonds being issued for the purpose of meeting current expenses of said City for the year 1933, and WHEREAS, said resolution passed by the Board of Commissioners on the 20th day of January, 1933, provided also for the sale of One Million Dollars ($1,000,000.00) of said authorized issue of One Million Two Hundred Thousand Dollars ($1,200,000.00), being bonds numbers one (1) to fifteen (15), both inclusive, in the denomination of Fifty Thousand Dollars ($50,000.00) each, and bonds numbers sixteen (16) to twenty-five (25), both inclusive, of the denomination of Twenty-five Thousand Dollars ($25,000.00) each, and WHEREAS, by resolution duly passed by the Board of Commissioners on the 6th day of July, 1933, provision was made for the sale of the - 2 - remaining Two Hundred Thousand. Dollars (4200,000.00) bonds of said issue, being bonds numbers twenty-six (26) to thirty-three (53), both inclusive, of the denomination of Twenty-five Thousand Dollars (gb'25,000.00) each, and WHEREAS, said issue of One Million Two Hundred Thousand Dollars ($1,20O,000.00) Tax Anticipation Bonds was not in excess of the estimated revenues for the year 1933 and all of said bonds were duly and lawfully issued and sold and are now the lawful and valid outstanding obligations of Salt Lake City, interest on all of said bonds having been paid promptly when due, and none of said bonds have ever been adjudicated to be invalid and there is no litigation pending or threatened involving the validity of said bonds, or any of them, said bonds being the legal, valid and binding obligations of said Salt Lake City, and WHEREAS, at the time said bonds were issued it was estimated that sufficient revenues from the collection of taxes would be available for the payment of said bonds at maturity, but due to diminished revenues from taxation Salt Lake City has or will have available on January 16, 1934 only the sum of One Million Dollars ($1,000,000.00) with which to retire said bonds, and it is necessary and for the best interests of said City that Refunding Bonds of said City be issued to provide funds for the payment of the remaining Two Hundred Thousand Dollars ($p200,004.00) of said bonds. NOW, THEREFORE, dd IT ORDAINED by the Board of Commissioners of Salt Lake City, Utah: • S CTIOW 1. That said One Million Dollars ($1,000,000.00) available for the redemption of said bonds shall be applied to the payment of the 1 following bonds: Bond number one (1) of the denomination of Fifty Thousand Dollars ($50,000.00); bonds numbers four (4) to fourteen (14), both inclusive, of the denomination of Fifty Thousand Dollars ($50,000.00) each; bonds numbers sixteen (16) to twenty-three (23), both inclusive, of the denomination of Twenty-five Thousand Dollars 025,000.00) each, and bonds numbers twenty-six (26) to thirty-three (33), both inclusive, of the denomi.n:,tion of Twenty-five Thousand Dollars ($25,000.00) each, in the aggregate amount of One Million Dollars ($1,000,000.00), and that for the purpose of paying and redeeming - 5 - Two Hundred Thousand Dollars ($200,000.00) Salt Lake City Tax Anticipation Bonds, Series of January 16, 1953, dated January 16, 1933, and due and payable January 16, 1934, being bonds numbers two (2), three (5) and fifteen (15) of the denomination of Fifty Thousand Dollars (40,000.00) each, end bonds numbers twenty-four (24) and twenty-five (25) of the denomination of Twenty-five Thousand Dollars (025,000.00) each, bearing interest at the rate of three and 20/100 (3.20%) per cent per annum, payable semi-annually on the 15th day of July, 1935 and the 16th day of January, 1934, there shall be issued Refunding Bonds of Salt Luke City in the amount of Two Hundred Thousand Dollars ($200,000.00), dated January 15, 1934, bearing interest at the rate of four per cent (4%) per annum, payable semi-annually on July 15th and January 15th in each year, commencing July 15, 1934, in denominations of One Thousand Dollars ($1,000.00) each, numbered from one (1) to two hundred (200), both inclusive, payable serially in numerical order Forty Thousand Dollars ($40,000.00) on January 15th in each of the years 1935 to 1939, both inclusive. Said bonds and each of them shall be, except as to numbers and maturities, in substantially the following form, to-wit: - 4 - UNITED STATES OF AMERICA STATE OF UTAH SALT LAKE COUNTY SALT LAKE CITY REFUNDING BOND SERIES OF JANUARY 15, 1934 No $1,000.00 Salt Lake City, in Salt Lake County, State of Utah, hereby acknowledges itself to be indebted and for value received hereby promises to pay to the bearer hereof the sum of ONE THOUSAND DOLLARS ($1,000.00) in lawful money of the United States of America on the fifteenth day of January, A. D. 19 , at The National City Bank of New York in New York City, with interest thereon at the rate of four per cent (4%) per annum, from date until paid, payable semi-annually in like money on the fifteenth days of January and July in each year, commencing July 15, 1934, said interest to maturity being represented by interest coupons hereto attached. This bond is issued for the purpose of refundin; legal and valid outstanding bonded indebtedness of said city and is one of a series of bonds of like date and amount and known as "Salt Lake City Refunding Bonds, Series of January 15, 1934," issued under and pursuant to the provisions of the Constitution and Laws of the State of Utah. The Board of Commissioners of Salt Lake City shall annually levy a sufficient tax to pay the interest on this bond as it falls due and also to constitute a sinking fund for the payment of the principal-thereof as the same falls due. It is hereby certified, recited and declared that all conditions, acts and things essential to the validity of this bond enist, have happened and have been done and that every requirement of law affecting the issue hereof has been duly complied with, and that this bond is within every debt and other limit prescribed by the Constitution and Laws of said State, and that the full faith and credit of said Salt Lake City are hereby irrevocably pledged to the punctual payment of the principal and interest of this bond, according to its terms. IN lTNESS tHEREOF, Salt Lake City has caused this bond to be signed by its Mayor and its City Treasurer and its corporate seal to be hereunto affixed, attested by its City Recorder, and the annexed coupons to bear the facsimile signature of the City Treasurer, as of the fifteenth day of January, A. D. 1934. Ail the covenants, statements, representations and agreements contained In said bonds and coupons and all recitals and representations of this ordinance, are hereby considered end understood and; it is hereby ordained and declared that said covenants and promises therein are the covenants and promises of said Salt Lake City and that the representations and statements therein are the representations and statements of said City and it is further stated and represented that Salt Lake City is a. municipal corporation of the first class under the Constitution and Laws of the State of Utah. - 6 - ��. SECTION} 2. The interest failing due on said bonds on July 15, 1934, shall be paid out of the general fund of said City, and for the purpose of reimbursing said general fund for said payment of interest and to meet the principal filing due on said bonds on Janucry 15, 1935 and to pay the interest falling due on said bonds on January 15, 1955 and July 15, 1935, there shall be levied in the year 1934 on all taxable property within said City, in addition to all other taxes, a direct tax sufficient to produce the sum of ti51,200.00, being $11,200.00 for interest and 340,0o0.00 for. principal.
