AN ORDINANCE LEVYING A TAX and for the assessment of property (Sanitary Sewer No. 930) for the purpose of constructing a sewer. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described (Sewer Extension No. 930) for the purpose of constructing a sewer, to-wit: AREA: Blocks 2, 3 and 4, Block 8, Plat "C" Seventh South Subdivision, Salt Lake City Survey also Block 1, J. H. Whalons Addition, also commencing 15 feet South of the Southeast corner of Lot 1, Block 3, Seventh South Subdivision, Block 8, Plat "C", Salt Lake City Survey, thence south 453.78 feet, all in Section 11, Township 1 South, Range 1 West, Salt Lake Base and Meridian. BOUNDARIES: North - 7th South Street South - Indiana Avenue East - 9th West Street West - Jordan River STREETS: Along the following named streets the abutting property will be assessed for the total cost of constructing an 8-inch Sanitary Sewer, together with wyes, manholes, flushtanks and other incidental costs at the herein below estimated cost per front foot of abutting property: 10th West Street - East side, south from 7th South Street 385 feet; 10th West Street - West side, south from 7th South Street 350 feet; Goshen Street - East side, south from 7th South Street 749.21 feet; Goshen Street - West side, south from 7th South Street 803.79 feet. 10 -2- This tax is levied to defray the expense of constructing and lay- ing a sanitary sewer line including wyes, manholes and flush tanks, under the portions of said streets opposite the property hereinafter and here- inbefore described to be especially benefited and affected by said improvement, and it is hereby adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied and said parcels of land are hereby assessed at a uniform rate in accordance with the linear foot frontage upon and to the entire depth of the same ownership back therefrom not exceeding 330 feet, and the tax hereby levied and to be assessed upon said parcels of land is Eleven Thousand Four Hundred Sixty Three and 86/100 Dollars, ($11,463.86), or $6.17 per front foot of abutting property, there being 1858.0 feet abutting said improvement, which is the total abutters cost and cost per front foot of said sewer, according to the contract entered into for the performance of said work and making said improvements with Schocker Construction Company, dated June 29, 1965, and the City Treasurer is here- by authorized and directed to assess in accordance with the provisions of this ordinance for the purposes herein mentioned. Fronting on the East side of 10th West Street All of Lots 2 through 17 inclusive, and a vacated 15 foot alley between Lots 10 and 11, Blk. 3, Seventh South Subdivision, Block 8, Plat C, Salt Lake City Survey. Beginning at the Southwest corner of Lot 2, Block 3, Seventh South Subdivision, thence south 20.0 feet, Block 8, Plat C, Salt Lake City Survey Fronting on the West side of Goshen Street All of Lots 20-28 inclusive and Lot 1, and a vacated 15 foot alley between Lots 21 and 22, Blk. 3, Seventh South Subdivision, Block 8, Plat C, Salt Lake City Survey. Commencing at a point 15 feet south of the Southeast corner of Lot 1, Block 3, Seventh South Subdivision, thence south 51.85 10 -3- feet, Block 8, Plat C, Salt Lake City Survey. Commencing at a point 66.85 feet south of the Southeast corner of Lot 1, Block 3, Seventh South Subdivision, thence south 401.93 feet, of the N.E.4 of the N.W.4 of Sec. 11, T.1 S., R.1 W., Salt Lake Base and Meridian. Fronting on the East side of Goshen Street All of Lots 2 through 10 and a 15 foot vacated alley between Lots 8 and 9 and 1/2 of a vacated 15 foot alley south of Lot 2, Blk. 2, Seventh South Subdivision, Block 8, Plat C, Salt Lake City Survey. All of Lots 6 through 12 incl., Blk. 1, J. H. Whalons Addition of the N.E.n of the N.W.4, Sec. 11, T.1 S., R.1W., Salt Lake Base and Meridian. Commencing at the Northwest corner of Lot 12, Block 1, J. H. Whalons Addition, thence north 54.16 feet of the N.E.a of the N.W.a, Sec. 11, T.1 S., R.l W., Salt Lake Base and Meridian. SECTION 2. That the assessment list made by the City Treasurer, as corrected, approved and completed by the Board of Equalization and Review of the property described in Section 1 of this ordinance (Sewer Extension No. 930) of Salt Lake City, for the purpose of constructing a sewer upon said portions of said streets, is hereby confirmed, and the assessments made and returned in said completed lists and the report of the Board of Equalization and Review to the Board of Commissioners of Salt Lake City are hereby ratified, approved and confirmed. SECTION 3. Said tax shall be payable in five (5) equal yearly installments as provided by law and ordinance, with interest on the whole sum unpaid at the rate of five (5) per cent per annum, payable at the time each installment is due; provided, however, that one or more of such installments in the order payable, or the whole tax, may be paid without interest within fifteen (15) days from the date this ordinance becomes effective. One or more installments in the order in which they are pay- able, or the whole special tax, may be paid after said fifteen days and before the first installment becomes due by paying the same with interest from the date of levy to the date such first installment is due. One or more installments in the order in which they are payable, or the whole special tax, may be paid on the date any installment becomes due by paying 10 -4- the amount thereof and interest to the date of payment. Default in the payment of any such installment of principal or interest when due shall cause the whole of the unpaid principal and interest to become due and payable immediately and the whole amount of the unpaid principal shall thereafter draw interest at the rate of ten per cent per annum until paid, but at any time prior to the date of sale or foreclosure, the owner may pay the amount of all unpaid installments past due with interest at the rate of ten per cent per annum to date of payment on the delinquent installments, and all accrued costs and shall thereupon be restored to the right thereafter to pay in installments in the same manner as if default had not occurred. SECTION 4. This ordinance shall take effect one day after its first publication.
