AN ORDINANCE AMENDING Section 41-5-22.2 of the Revised Ordinances
of Salt Lake City, Utah, 1965, relating to street excavations on heavily
traveled streets.
Be it ordained by the Board of Commissioners of Salt Lake City,
Utah:
SECTION 1. That Section 41-5-22.2 of the Revised Ordinances of
Salt Lake City, Utah, 1965, as amended, relating to street excavations
in heavily traveled streets, be, and the same hereby is, amended by
adding thereto a new subsection (c) to read as follows:
"Sec. 41-5-22.2. * * *
"(c) In addition to all other requirements of this chapter
relating to excavations in streets and alleys, the person to
whom a permit is issued for excavating in a public street or
highway within the district bounded on the north by the north
side of North Temple Street, on the east by the east side of
Fifth East Street, on the south by the south side of Ninth
South Street, and on the west by the west side of First West
Street, shall observe the following regulations and requirements:
"1. No such excavation work, whether of an emergency nature
or not, shall be commenced until the city engineer and the chief
of police have been notified of the location and necessity of
such excavation.
"2. If, in the opinion of the chief of police, it is neces-
sary to require the use of uniformed police personnel to direct
traffic at the excavation site in order to insure safe and
adequate traffic flow, he shall provide off-duty police officers
to direct such traffic and the city shall be reimbursed by the
person to whom the excavation permit is issued for the entire
cost and expense thereof, including overtime and holiday pay
for the employment of such officers for such traffic control duty.
The bond provided for in Sections 41-5-10 and 41-5-11 shall
guarantee the payment to Salt Lake City of the foregoing amounts."
SECTION 2. In the opinion of the Board of Commissioners, it is
necessary to the peace, health and welfare of the inhabitants of Salt
Lake City, that this ordinance become effective immediately.

SECTION 3. This ordinance shall take effect upon its first
publication.
Passed by the Board of Commissioners of Salt Lake City, Utah,
this 22nd day of January, 1970.
