An ordinance levying a tax and for the assessment of property on Fifteenth East Street bet,3een. riilliamc and lartin Avenues, in Paving District No. 52, for the purpose of providing for the grad- ing and guttering and curbing thereof. Be it ordained by the Board of Cornm-tssionorc of S:l.t Lace City, Utah: SECTION 1. That the Board of Commissioners of Selt Lake City, dries hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Paving District No. 32, for the purpose of providing :dor the grading and guttering and curbing thereof, to-wit: In Lot 44, Block 21, Douglas Park Subdivision of Block 30; in Lots 14, 15, 16, 17, 18 and 19, Block 30; and in Lots 99 to 116, • inclusive, lorningside Subdivision of Block 30, Five Acre Plat "C", Big Field Survey, abutting on the west side of Fifteenth East Street between VTil.liams and M0rtin Avenues. This tax is levied to defray the expense of grading, and guttering and curbing with cement, the portion of said street oppo- site the property hereinbefore end hereinafter described to be es- pecially affected and benefited by said improvement, and it is here- by adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portion of said street fronting Ino:n and to c, do.5)th of twenty- five (25) feet beck therefrom, .and the tax 'hereby levied and to be assessed upon said parcels of land id four thousand nine hundred eighteen and 90/100 (:;p4,918.90) dollars, or two and 502/1000 (w2.50') dollars per front or linear foot of abutting property, there being 965.99 feet of abutting property within the boundaries of the lote, lock and street above mentioned in said district, which :its the 101. -2- total cost and cost per front foot of said improvement, according to the contract entered into for the porformonce of said work and making said improvement, with Eldred and Son, dated. the 14th day 0 August, 1911, and the Treasurer is hereby authorized and directed to assess, in accordance with the provisions of this ordinance, fo the purpose herein mentioned: The east side of the south 23.54 feet of Lot 44, Block 21, Douglas Park Subdivision of Block 30; the east side of the north 120.85 feet of the south 163.75 feet of Lot 14, the east side of the south 231 feet of the north 254.1 feet of Lot 15, the oast side of the south 254.1 feet of Lot 16, the east side of Lots 17 to 19, inclusive, Block 30; the east side of Lots 99 to 115, inclusive, ktorningside Subdivision of Block 30, all in Five Acre Plat "0", Big Field Survey, as the same are shown upon the official plats of said city to a depth of twenty-five (25) feet back from said stree' , a.nd to collect said tax. SECTION 2. Said tax shall become and be deli;quent in five equal yearly installments, with interest on the whole sum unpaid at the rate of six per cent per annum, payable at the time each installment is due, to-wit: One-fifth thereof one year after the ordinance confirming the levy of the tax for the payment for such improvement becomes effective; one-fifth thereof in two years'aftesi said ordinance becomes effective; one-fifth thereof in. three years after said ordinance becomes effective; one-fifth thereof in four years after said ordinance becomes effective; and. one-fifth there- of in five years after said ordinance becomes effective. One or more of said installments, in the order in which they are payable, or the whole special tax, may be paid at any time within thirty da s after the ordinance confirming the levy of the tax becomes offecti , Without interest. In the event of any in t..17_nct.t or the interest aforesaid not being paid on the date the same becomes due, the whole -3- amount of the special tax unpaid at the time said installment and interest are due, shall become due and loayahle, and shall draw interest at the rate of eight per cent per annum until the sale of the property assessed; provided, one or more installments, in the order in which they are payable, or the whole special tax unpaid, may be paid on the day any: installment becomes due, by paying the amount thereof and interest td said date.
