Barker Harmsen C�GyLticrl Zl Harrison Phillips Result , AN ORDINANCE AN ORDINANCE AMENDING TITLE 51, relating to the zoning ordinances of the Revised Ordinances of Salt Lake City, Utah, 1965, by adding thereto the following sections, all relating to the preservation of historic buildings. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Chapters 2, 13, 14, 15, 16, 17 and 19 of Title 51 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to zoning, be, and the same hereby are, amended by adding thereto Sections 51-2-33.2, 51-13-7, 15-13-8, 51-13-9, 51-13-10, 51-14-4, 51-15-4, 51-16-5, 51-17-8, 51-18-7 and 51-19-3, relating to the preservation of historic buildings and permitting as conditional uses certain types of commercial activities within such historic buildings, said sections to read as follows: Sec. 51-2-33.2. Historic buildings. "Historic building" shall mean any building listed in the National Register of Historic Places or on the Utah State Register of Historic Sites. * * is Sec. 51-13-7. Conditional uses in historic buildings. In a Residential "R-1" district the Board of Adjustment may permit as a conditional use in historic buildings, the following uses: (1) Offices and accessory commercial uses as deemed appropriate if designed for use by the occupants of and visitors to the offices, provided that access to such uses is only from within the building and that there is no exterior evidence of such uses such as signs or display windows. (2) Limited retail businesses which do not change the basic character of the building in the district in which it is located. Sec. 51-13-8. Conditional uses in historic buildings. Aspects to be considered by Board of Adjustment. The Board of Adjustment may approve an application for conditional uses if the facts presented are such as to establish: (a) That such use or feature as proposed will not be detrimental to the health, safety, convenience or general welfare of persons residing or working in the vicinity, or injurious to property, improvements or potential development in the vicinity, with respect to aspects including but not limited to the following: The size and shape and arrangement of structures; The accessibility and traffic patterns for persons and vehicles, the type and volume of such traffic, and the adequacy of proposed off-street parking and loading; -2- The safeguards afforded to prevent noxious or offensive emissions such as noise, glare, dust, and odor; and The desirability of providing landscaping, screening, open spaces, parking and loading areas, service areas, lighting and signs. (b) That such use or feature as proposed will comply with the applicable provisions of this title and will not adversely affect the Master Plan of Salt Lake City; also (c) That such use or feature proposed is conducive to the preservation of the historic and/or architectural character- istics of the building. Sec. 51-13-9. Conditional uses of historic buildings. Assuring preservation. When authorizing a conditional use as provided herein the Board of Adjustment may prescribe such conditions as are in its opinion necessary to assure the preservation of the historic building for which the conditional use authorization is sought and such conditions as are necessary to secure the objectives of this title. Before the Board of Adjustment shall render a final decision on an application for a conditional use, it shall first secure the recommendation of the Salt Lake City Historical Building Committee and the recommendation of the Planning and Zoning Commission. Sec. 51-13-10. Who may make application. Applications for conditional uses may be filed by the owner of the property for which the conditional use is sought, or his authorized representatives. Sec. 51-14-4. Conditional uses. In a Residential "R-2" district the Board of Adjustment may permit as a conditional use any con- ditional use permitted in a Residential "R-1" district, subject to the same restrictions contained therein. * * * Sec. 51-15-4. Conditional uses. In a Residential "R-2A" district the Board of Adjustment may permit as a conditional use any con- ditional use permitted in a Residential "R-2" district, subject to the same restrictions applicable thereto. * * * Sec. 51-16-5. Conditional uses. In a Residential "R-4" district the Board of Adjustment may permit as a conditional use any condi- tional use permitted in a Residential "R-2A" district, subject to the*siml restrictions applicable thereto. Sec. 51-17-8. Conditional uses. In a Residential "R-5" district the Board of Adjustment may permit as a conditional use any condi- tional use permitted in a Residential "R-4" district, subject to the same restrictions applicable thereto. * * * Sec. 51-18-7. Conditional uses. In a Residential "R-6" district the Board of Adjustment may permit as a conditional use any conditional use permitted in a Residential "R-5" district, subject to the same restrictions applicable thereto. * * * Sec. 51-19-3. Conditional uses. In a Residential "R-7" district the Board of Adjustment may permit as a conditional use any condi- tional use permitted in a Residential "R-6" district, subject to the same restrictions applicable thereto. ^n -3- SECTION 2. In the opinion of the Board of Commissioners it is necessary to the peace, health and safety of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 3.
