Morris Shearman Wells Mr.Chairman AN ORDINANCE Result An ordinance levying e tax and for the assessment of property • on Yale Avenue between Eleventh East and Fifteenth East Streets, in Paving Districts Nos. 31 and 32, end in Paving Extension No. 91, for the purpose of providing for the paving thereof. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Paving Districts Nos. 31 and 32, for the purpose of providing for the paving thereof, to-wit: In Lots 1 to 21, inclusive, Block 2, Gilmer Square Subdivision of Block 17 A; 6, 7, 16 and 17, Block 17-A, Five Acre Plat "A"; 6 and 7, Block 30; 1 to 21, inclusive, Yale Park Subdivision of Block 30; and 56, and 1 to 3, inclusive, Block 2, Douglas Park Second Addition, Block 30, Five Acre Plat "C", all in Dig Field Survey, abutting on both sides of Yale Avenue between Eleventh East and Fifteenth East Streets. This tax is levied to defray the expense of paving with bitulithic pavement six (6) inches thick, roadway (said roadway to be thirty (30) feet between curbs from Eleventh East Street to a point about two hundred (200) feet west of Fifteenth East Street, and thirty-six (36) feet between curbs from said point about Pao.- hundred (200) feet west of Fifteenth East Street to Fifteenth East. -1- 104 Street) , that portion of said street opposite the property herein- before and hereinafter described to be especially affected and ( benefited by said improvement, and it is hereby adjudged, deters; mined and established that said property will be especially bene- fited thereby to the full amount of the tax hereby levied, and said parcels of lend are hereby assessed at en equal and uniform rate in accordance with the linear foot frontage upon said portion of said street fronting upon end to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed i upon said parcels of land is eighteen thousand eight hundred eighty 1 end 38/100 (41.8,880.38) dollars; seventeen thousand four hundred II two and 43/100 ( 17,402.43) dollars, or three end 8/100 03.08) dollars per front or linear foot of abutting property for thirty (30) foot roadway, there being 5650.14 feet abutting said portion of said improvement; and fourteen hundred seventy-seven and 95/100 ($1477.95) dollars, or three and 79/100 (0.79) dollars per front or linear foot of abutting property for thirty-six (36) foot read- wey, there being 389.96 feet abutting said portion of said improve-- ment, within the boundaries of the lots, blocks and street above mentioned in said district, which is the total cost and cost per front foot of said improvement, according to the contract entered into for the performance of said work and making said improvement, with Strange-Maguire Paving Company, dated the 9th day of October, 1913, and the Treasurer is hereby authorized and directed to asse s, in accordance with the provisions of this ordinance, for the purpose herein mentioned: Thirty Foot Roadway. (Curb and Gutter Built) All of Lots 1 to 21, inclusive, Block 2, Gilmer Square Sub- division of Block 17-A; the east 31.93 feet of Lot 7, the east 747.56 feet of Lot 6, the west 741.71 feet of Lot 16, the west 741.71 feet of Lot 17, Block 17-A, Five Acre Plat "A"; the east 171.01 feet of the north side, and the east 770.15 feet of the -2- west 787.15 feet of the south side of Lot 7, the east 612.62 feet ' of the west 629.62 feet of Lot 6, Block 30; all of Lots 1 to 9, iinclusive, the west 39.87 feet of Lot 10, all of Lots 13 to 21, inclusive, Yale Park Subdivision of Block 30, Five Acre Flat "0", all in Big Field Survey. • Thirty-six Foot Roadway . (Curb and Gutter Built) The east 10.28 feet of Lot 10, all of Lots 11 and 12, Yale li I Paxk Subdivision, Block 30; all of Lots 56, and 1 to 3, inclusive, Block 2, Douglas Park Second Addition, Block 30, all in Five Acre ! Flat "C", Big Field Survey, as the sane are shown upon the offioia , plats of said City to a depth of twenty-five (25) feet back from said street, and to collect said tax. , SECTION 2. Said tax shall become and be delinquent in ten I equal yearly installments, with interest on the whole sum unpaid at the rate of six per cent per annum, payable at the time each installment is due, to-wit: One-tenth thereof one year after the jordinance confirming the levy of the tax for the payment for such improvement becomes effective; one-tenth thereof in two years after said ordinance becomes effective; one-tenth thereof in three years after said ordinance becomes effective; one-tenth thereof in four years after said ordinance becomes effective; one-tenth there of in five years after said ordinance becomes effective; one-tenth thereof in six years after said ordinance becomes effective; one- ( tenth thereof in seven years after said ordinance becomes effectiv one-tenth thereof in eight g years after said ordinance becomes effective; one-tenth thereof in nine years after said ordinance becomes effective; and one-tenth thereof in ten years after said ordinance gitA**eggg becomes effective. One or more installments, in the Ii order in which they are payable, or the whole special tax, may be paid at any time within thirty days after the ordinance confirmin: srustinsming the levy of the tax becomes effective, without interest. In the event of any installment, or the interest aforesaid, not ; -3- 1 being paid on the date the same becomes due, the whole amount of lithe special tax unpaid at the time said installment and interest II are due, shell become due and payable, end shall drew interest at the rate of eight per cent per annum until the sale of the propert assessed; provided, one or more installments, in the order in whic they are payable, or the whole special tax unpaid, may be paid on the day any installment; becomes due, by paying the amount thereof and interest to said date.
