104 of 1980 - Amending section 37-5-3 changing sewer service charges. // SALT LAKE CITY ORDINANCE No. 104 of 1980 (Sewer service charges) AN ORDINANCE REPEALING SECTION 37-5-3 OF THE REVISED ORDINANCES OF SALT LAKE CITY, UTAH, 1965, RELATING TO SEWER SERVICE CHARGES. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Section 37-5-3 of the Revised Ordinances of Salt Lake City, Utah, 1965, is hereby amended to read as follows: sec. 37-5-3. Service charge. The sewer service charge imposed by Section 37-5-2 hereof, shall be as follows: (1). Sewer charges. Each sewer service account shall be charged $2.00 per month minimum charge or $0.45 per 100 cubic feet of the average monthly water meter readings of those using solely City water during the consecutive months of November, December, January, February and March each year, hereafter "winter readings", whichever is higher. Said winter readings shall be the basis for sewer billings for the period July 1 through June 30 following such winter readings. Any user who has more than one water meter, one or more of which measures water eventually discharged into the sewer and one or more other meters measuring water not entering the sewer, will be charged $0.45 cents per 100 cubic feet for all water used which may enter the sewer, but will not be assessed a sewer charge on water meter(s) which measure water, no part of which flows into the sewer system. For those not using City water or using some City water, the City may require a City approved meter, at the sewer user's expense, on the well(s) or other source(s) of water supply for measurement by City during said months to determine the sewer user's water use during said months, the average of which shall become the basis for sewer billings for said period. For each single dwelling unit not using City water and desiring not to install a water meter as required above, the I_R I Director of the Department of Public Utilities may waive the meter requirement, in which event the user will be charged for sewer service as provided in Subparagraph (3)(a) hereof. (2) Metering of sewage flows. Metering of sewer lines will be allowed when the user elects to have the sewage flow metered subject to the following requirements: (a) The charges for sewer service will be based upon the actual sewer meter readings rather than upon the average of said winter readings. (b) The user will furnish and install at users to expense, a meter pursuant /the City's standards and specifications. (3) New sewer connections or change in occupancy. Any new sewer service or existing service having changed occupants (applies only to one to three dwelling units) or those which do not have sufficient or accurate data to establish said monthly winter reading sewer rate shall be assessed monthly charges as follows until such data is available: (a) For each single dwelling unit, $3.50 per month (b) For each duplex, $3.50 per month per dwelling unit. (c) For each triplex, $3.50 per month per dwelling unit. (d) For each multiple dwelling, a minimum monthly charge of $1.75 per dwelling unit or $0.28 per 100 cubic feet of total water consumption, whichever is highest. (e) For all other users, a minimum charge of $4.40 per month or $0.28 per 100 cubic feet of total water consumption, whichever is highest. (4) Sewer charge adjustment. The Director of Public Utilities may make adjustments as needed to ensure equitable service charges. The Director may make such adjustments where excessive quantities of culinary water pass through the water meter, but are consumed on the premises and do not enter the sewage system. In each such instance, the user will have the burden of providing evidence of such inequities by showing that -2- 104 the quantity of water not entering the sewer, but passing through the water meter, exceeds 20 percent of the total flow in order to merit such consideration by the Director. Each such adjustment made by the Director shall be submitted to the Department of Public Utilities Advisory Committee for ratification. If said committee approves the adjustment it shall be effective immediately. If the committee does not act upon the adjustment for thirty (30) days, it shall automatically be deemed approved at the end of said period. If said adjustment is disapproved, the Director may submit the matter to the Mayor whose decision will be final. (5) Residential sewer accounts limitation. Until July 1, 1981, no single dwelling unit shall be charged more than $25.00 per month for sewer service. Thereafter, the foregoing rates shall apply. SECTION 2. In the opinion of the City Council of Salt Lake City, it is necessary to the peace, health and welfare of the inhabitants of Salt Lake City that this ordinance become effective immediately upon first publication, provided however, that, customers presently billed monthly shall be charged but not billed at the new rate until thirty (30) days after said publication, and customers presently billed bi-monthly shall be charged but not billed at the new rate until sixty (60) days after said publication.
