Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Subsections (a), (b) and (d) of Section 25-11-9, Revised Ordinances of Salt Lake City, Utah, 1965, relating to overtime, be, and the same hereby are, amended to read as follows: "Sec. 25-11-9. (a) Hours of service and overtime. Forty hours shall constitute a normal work week and eight hours a normal work day; provided, however, only work in excess of forty hours per week shall be considered as overtime work. Overtime work is to be discouraged. In case of emergency or whenever public interest demands, an employee may be requested to perform overtime work by the department head or his depart- ment representative. Any work performed in excess of forty hours in one work week shall be considered overtime and shall be compensated as provided in subsection (b). (b) Overtime compensation. It shall be the policy of the city to compensate employees required to perform overtime work either by: (1) Pay at one and one-half the applicable hourly rate; or (2) Allowance of time off from employment with pay on the basis of one and one-half hours off for each hour of overtime worked. The foregoing notwithstanding, no employee or officer of the city in pay class 13 or above, as provided in Section 25-4-5, shall be eligible for any overtime pay, if said employee or officer is exempt from the overtime provisions of the United States Fair Labor Standard Act. However, said exempt employees and officers shall be permitted compensatory time off for all authorized overtime hours worked, upon per- mission of the department head or his designated represent- ative first had and obtained. Firemen who are required to be on duty more hours than required by their regular duty routine shall be compensated on the same basis as hereinabove specified. (c) . . . (d) Standby pay. An employee required by the department head or his designated representative to be on a standby basis shall receive two (2) hours straight time pay. As used in this section, "standby basis" shall mean that an employee is specifically requested by the department head or his des- ignated representative to keep himself available for city service and either remain at home or leave word where he can be reached by the appropriate department head for an immediate call to service. In the opinion of the Board of Commissioners, it is necessary to the peace, health and welfare of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 3. This ordinance shall take effect upon its first publication. Passed by the Board of Commissioners of Salt Lake City, Utah, this 5th day of September, 1974.
