1 AN ORDINANCE .
• An ordinance amending Section 4 of an ordinance passed by the
City Council of Salt Lake City December 2, 1907, and approved by
the Mayor December 3, 1907, entitled "An ordinance ratifying and
confirming the transfer of franchises to the Utah Light and Rail-
way Company, a corporation, extending the life of said franchises,
and amending the same, including the franchise to the Utah Power
Company", passed by the City Council August 3, 1905, and approved
by the Mayor August 4, 1905, by adding a new subdivision to Seetio
4, to be known as Subdivision 28.
Be it ordained by the Board of Commissioners of Salt Lake
City, Utah:
SECTION 1. That Section 4 of an ordinance passed by the Cit•
Council of Salt Lake City December 2, 1907, and approved by the
Mayor December 3, 1907,entitled "An ordinance ratifying and con-
firming the transfer of franchises to the Utah Light and Railway
Company, a corporation, extending the life of said franchises, an.
amending the same, including the franchise to the Utah Power Com-
pany", passed by the City Council August 3, 1905, and approved by
the Mayor August 4, 1905, be, and the same is hereby amended by
inserting after Subdivision 27 the following:
28. A double track on Beck Street, beginning at the
junction of said street with Second West Street at a point
400 feet north of the center line of Seventh North Street;
thenoe northwesterly along the center line of said Beck Stree
for a distance of approximately 2700 feet to Garnet Avenue;
thence a single track northwesterly along the west side of
Beck Street for a distance of approximately 900 feet to con-
nect with the present track known as the North Salt Lake lin,;
also a single track beginning at a point where the present
North Salt Lake line intersects Beck Street approximately
1100 feet south and 1500 feet east from the center of Secti

23, Township 1 north, Range 1 west, thence northwesterly
parallel with and 17 feet easterly of the west property line
of said Beck Street approximately 1700 feet; thence also a
single track north along the west side of said Beck Street
and adjacent to the tracks of the Salt L,ke & Ogden Railway
Company approximately 3200 feet to a point near Beck's Hot
Springs where the street makes a turn to the right and passes
through a deep cut; also a single track beginning at a point
approximately 1700 feet north and 350 feet east of the south
* corner of Section 14, Township 1 north, Range 1 west, then
northeasterly along the west side of said Beck Street approx-
imately 1600 feet to the northern .imits of Salt Lake City.
The said grantee shall in the 6orstruction of its tracks
on Beck Street between the end of the asphalt pavement at the
Warm Springs and Garnet Avenue, as above described, build a
�{ crushed rock or slag macadam roadway nine inches in thickness,
which roadway shall be constructed, according to the /standard
methods for this class of road building and shall include the
space in and between its tracks and a strip 15 feet in width
on each side of the outer rails, with a five-foot earth berm
along the outer edges of said roadway. The said tracks and
macadam roadway shall conform to the grades established by
the City Engineer, and the grantee shall maintain flush with
the top of the rails the portion of the said macadam roadway
between its outer rails, and Salt Lake City shall maintain
the portion of the roadway lying outside of the outer rails,
and the five-foot berm aforesaid.
If the man#oles over the gravity sewer arp in t.ny way
interfered with or disturbed by the construction ot the tracks
aforesaid, the grantee shall reconstruct the same to the sat s-
faction of the City Engineer.
Wherever the present macadam roadway on the said Beck

Street is displaced or disturbed by the grantee, except that
portion between the end of the asphalt pavement on Second
West Street and Garnet Avenue, it shall reconstruct and exte.d
the same for a width of 30 feet, measuring from the rail nea -
est to said macadam roadway, in the manner hereinbefore pro-
vided for macadam construction.

a eufficient strip of ground adjpiaiag the -east side of said
Beck Street to make the name a tho oughfa e' fifty feet in
width over and above and in addition to that part which is
ocoupiod by the track or tracks 'of the grantee.
SECTION 2. That said grantee, its successors or assigns,
shall construct, complete and have in operation at least one rail
way track, with the necessary switches, on all portions of the
streets covered by this ordinance on or before the 31st day of
December, 1913; and, in the event of failure of said grantee to
have completed and in operation at least one track on said street
within the time mentioned, then as to the portion of said street
not so occupied at the expiration of said period herein provided,
this franchise and all provisions thereof shall be null and void.
SECTION. t The grantee hereunder shall, within thirty days
after the passage of this ordinance, file its acceptance of the
same in writing with the City Recorder of Salt Lake City` and in
case of its failure so to do, this franchise shall be null and
void.
SECTION 4. This ordinance shall take effect upon its first
publication.
