AN ORDINANCE
Result

The Board of Commissioners of Salt Lake City, Utah, hereby finds after
due consideration, that parking lots, as hereinafter defined, which are not
properly lighted and kept clean of refuse and waste material constitute a
hazard to the health, comfort and convenience and to the personal safety and
well-being of the inhabitants of Salt Lake City and also constitute a hazard
to property, and invite, or are condusive to, violations of the laws governing
the peace and security of the inhabitants of Salt Lake City, and it is there-
fore necessary to promote and improve the morals, peace and good order, com-
fort and convenience of the city and the inhabitants thereof, and for the pro-
tection of property therein to provide by ordinance that said parking lots are
properly lighted and kept clean of refuse and waste material.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF
SALT LAKE CITY, UTAH:
SECTION 1. There is hereby added to the Revised Ordinances of Salt
Lake City, Utah, 1965, a new title to be known as Title 28, entitled "Parking
Lots," consisting of Chapter 1, "Parking Lot Regulations," to read as follows:
TITLE 28.
PARKING LOTS.

"Sec. 28-1-1. Parking lot defined. "Parking lot" shall mean an
open area other than a street used for the parking of more than four
(4) automobiles and available for public use whether free, for compen-
sation, or as an accommodation for clients or customers.
"Sec. 29-1-2. Permit required. No parking lot or parking area
shall be constructed without first obtaining a permit authorizing
such construction. No Permit shall be issued without first secur-
ing the recommendations of the city traffic engineer and the city
planning commission, and no permit shall be issued until the applic-
ant has complied with the provisions of this chapter.
"Sec. 28-1-3. Sidewalk encroachments, preventions. The parking
lot shall be provided with attractive wall, guardrail, or screening
shrubbery, at least along the street side, to limit points of ingress
and egress, to prevent encroachment of parked vehicles on any sidewalk,
and to improve the general appearance, and where necessary, with a
bumper curb parallel with the inside of the wall or guardrail at such
distance that the wheels of the motor vehicles in the parking lot are
stopped prior to the motor vehicle contact with the wall or guardrail.
"Sec. 28-1-4. Driveways. Driveways must not exceed thirty
feet in width where they cross the sidewalk; adjacent driveways must
be separated by an island at least twelve feet in width; and drive-
ways must be at least ten feet from the property line of any inter-
secting street.
"Sec. 28-1-5. Attendant buildings. Attendant building must be
located far enough from the entrance to prevent congestion at the side-
walk and must be constructed so as not to detract from the appearance
of the surrounding neighborhood. Every operator of a parking lot,
before constructing or reconstructing, or locating or relocating an
attendant building, shall secure the approval of the city traffic
engineer and the city planning director.
"Sec. 28-1-6. Ground surfaces. Ground surfaces of the parking
area shall be paved or hard surfaced.
"Sec. 28-1-7. Lighting conditions. Parking lots which are
operated and open to use during the hours of darkness after one
hour after sunset shall be provided with lights and lighting facili-
ties that will provide 0.03 watts per square foot with incandescent
light source, or 0.01 watts per square foot with either mercury vapor
or fluorescent light source, but in no event less than 0.2 foot candle
average maintained illumination on the entire parking lot surface and
an average ratio of six to one.
"Sec. 28-1-8. Id. Permit required. Before installing the
lighting facilities required by section 28-1-2, and before altering
or adding to any lighting facilities presently existing, the operator
of a parking lot shall first make application to the chief of the
division of electrical inspection for a permit, and shall submit with
such application a detailed plan for such facilities. If it shall be
found that the installation will conform to the requirements of this
chapter and the electrical code a permit shall be issued upon payment
of the fee required by the electrical code covering work in commercial
and industrial property.

"Sec. 28-1-9, Car capacity. The maximum car capacity indicated
on the application shall be reasonable and the arrangement of parking
facilities shall not necessitate the backing of cars onto adjoining
public sidewalks, parkways, roadways or thoroughfares in conducting
parking and unparking operations.
"Sec. 28-1-10. Clean condition. Every operator of a parking
lot, as herein defined, whether he be owner, lessee, representative
or agent, shall keep said parking lot in a clean condition at all
times free from all kinds of refuse and waste material. It shall
be a sufficient compliance with this section to clear said parking
lot from refuse and waste material once each day.
"Sec. 28-1-11. Enforcement. It shall be the duty of the city
electrical inspector to enforce the provisions of this chapter with
respect to lighting facilities. It shall be the duty of the board
of health to enforce the provisions of this chapter as to keeping
said premises in a clean condition.
"Sec. 28-1-12. Violation. It shall be unlawful for any operator
of a parking lot, as herein defined, whether he be owner, lessee,
representative or agent, to fail to comply with or violate any pro-
vision of this chapter."
SECTION 2. In the opinion of the Board of Commissioners it is necessary
to the peace, health and welfare of the inhabitants of Salt Lake City, Utah,
that this ordinance become effective immediately.
SECTION 3. This ordinance shall take effect upon its first publication.
Passed by the Board of Commissioners of Salt Lake City, Utah, this
7th day of December, 1965.
