Mr.Chairman Result AN ORDINANCE An ordinance levying a tax and for the assessment of property on the north side of Michigan Avenue between Eleventh East and Twelfth East Streets, and on the east side of Twelfth East Street between Yale and Michigan Avenues, in Sidewalk District No. 40, for the construction of cement sidewalks. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Sidewalk District No. 40, for the construction of cement sidewalks, to-wit: In Lots 7, 9, and 14 to 16, inclusive, Block 17-A, Five Acre Plat "A", Big Field Survey, abutting on the north side of Michigan Avenue between Eleventh East and Twelfth East Streets, and on the east side of Twelfth East Street between Yale and Michigan Avenues. This tax is levied to defray the expense of constructing cement sidewalks five (5) feet wide and four (4) inches thick, with three and one-quarter (34) inch base and three-quarter (-) inch topping, upon the portions of said streets opposite the property hereinbefore and hereinafter described to be especially affected and benefited by said improvement, and it is hereby adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied, and -1- said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portion:, of said streets, fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is ten hundred forty-two and 26/100 (41,042.26) dollars, or 73/100 (40.73) dollars per front or linear foot of abutting property, there being 1427.76 feet of abutting property within the boundaries of the lots, block and streets abov:: ,:ntioned in said district, which is the total cost and cost per front foot of said sidewalks, according to the contract entered into for the perform- ance of said work and making said improvement, with Ryberg Brother::, Contractors, dated the 3rd day of August, 1916, and the Treasurer is hereby authorized and directed to assess, in accordance with th provisions of this ordinance, for the purpose herein mentioned: Fronting on Michigan Avenue. Beginning 103.43 feet south from the northwest corner of Lot 9, Block 17-A, Five Acre Plat "A", Big Field Survey; thence east 680.23 feet, being a part of Lot 9, Block 17-A, Five Acre Plat "A", Big Field Survey. Fronting on Twelfth East Street. Beginning 31.93 feet west and 66 feet north from the southwes, corner of Lot 16, Block 17-A, Five Acre Plat "A", Big Field Survey thence north 68.59 feet; thence along a curve to the right, radius 73.26 feet, 73.23 feet; thence along a curve to the left, radius 164.64 feet, 164.57 feet; thence north 175.1 feet; thence along a curve to the left, radius 394.26 feet, 148.22 feet; thence north 21° 33' 24" west 98.33 feet; thence along a curve to the right, radius 172.76 feet, 19.49 feet, being a part of Lots 7, and 14 to 16, inclusive, Block 17-A, Five Acre Plat "A", Big Field Survey, as the same are shown upon the official plats of Said City to a depth of twenty-five (25) feet back from said streets, and to collect said tax. -2- SECTION 2. This tax shall become and be delinquent in five equal yearly installments, with interest on the whole sum unpaid at the rate of six per cent per annum, payable at the time each installment is due, to-wit: One-fifth thereof one year after the ordinance confirming the levy of the tax for the payment for such improvement becomes effective; one-fifth thereof in two years aftel' said ordinance becomes effective; one-fifth thereof in three years after said ordinance becomes effective; one-fifth tl}ereof in four years after said ordinance becomes effective; and oie-fifth there- of in five years after said ordinance becomes effective. One or more of said installments, in the order in which thbj^are'.payable, or the whole special tax, may be paid at any time within thirty days after the ordinance confirming the levy ofthe tax becomes effective, without interest. In the event of any installment or the interest aforesaid not being paid on the date the same becomes due, the whole amount of the special tax unpaid at the time said installment and interest are due, shall become due and payable, and shall draw interest at the rate of eight per cent per annum until the sale of the property assessed; provided, one or more installments, in the order in which they are payable, or the whole special tax unpaid, may be paid on the day any installment becomes due, by paying the amount thereof and interest to said date. SECTION 3. This ordinance shall take effect one day after its first publication. Sidewalk Extension No. 184.
