Result AN ORDINANCE AN ORDINANCE levying a tax and for the assessment of property on Fifth South Street between Second East and Fifth East Streets, in Paving Districts Nos. 27 and 28, for the purpose of providing for the grading, guttering and curbing, constructing drainage system and paviing thereof. Be it ordained by the Board of Commissioners of SaltLake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Paving Districts Nos. 27 and 28, for the purpose of providing for the grading, gutter- ing and curbing with cement, constructing drainage system across intersections, and paving thereof, towit: In Lots 5, 6, 7 and 8, Block 36, Plat "A"; 5 and 6, Block 22; and 5, 6, 7 and 8, Block 23, Plat "B", Sa3.lt Lake City Survey, abutting on the south side of Fifth South Street between Second Bast and Fifth East Streets. This tax is levied to defray the expense of grading, gutter- ing and curbing with cement, constructing drainage system of vitrified pipe across intersections, and paving with Utah rook asphalt, with two (20 inch wearing surface on a six (6) inch con- crete base, a roadway seventy-two (72) feet wide between curbs, that portion of said street opposite the property hereinbefore and hereinafter described to be especially affected and benefited by 116 said improvement, and it is hereby adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portions of said street, fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is fourteen thousand nine hundred twenty-two and 76/100 ($14,922.76) dollars, or seven and 73/100 ( 7.73) dollars per front or linear foot of abutting property for seventy-two foot roadway, therebeing 1930.50 feet abut- ting property within the boundaries of the lots, blocks and street above mentioned in said district# which is the total cost and cost per front foot of said improvement, according to the contract enter- ed into for the performance of said work and making said improvement, with P. J. Moran, Contractor, Incorporated, a corporation, dated the 13th day of August, 1913, and the Treasurer is hereby authorized and directed to assess, in accordance with the provisions of this ordin- ance, for the purpose herein mentioned: The north side of lots 5, 7 and 8, the north side of the east 74.26 feet and west 74.25 feet of lot 6, Block 36, Plat "A"; the north side of lots 5 and 6, Block 22, the north aide of lots 5 and 8, the north aide of the west 148.5 feet of lot 6, and the north side of the east 148.6 feet of lot 7, Block 23, Plat "B", all in Salt Lake City Survey, as the same are shown upon the official plats of said City to a depth of twenty-five (25) feet back from said street, and to collect said tax. SECTION 2. Said tax shall become and be delinquent in ten equal yearly installments, with interest on the whole sum unpaid at the rate of six per cent per annum, payable at the time each install- ment is due, towit: One-tenth thereof one year after the ordinance confirming the levy of the tax for the payment for such improvement becomes effective; one-tenth thereof in two years after said ordinance -2- becomes effective; one-tenth thereof in three years after said ordin- ance becomes effeotive; one-tenth thereof in four years after said ordinance becomes effective; one-tenth thereof in five years after said ordinance becomes effective; one-tenth thereof in six years after said ordinance becomes effective; one tenth thereof in seven years after said ordinance becomes effective; one-tenth thereof in eight years after said ordinance becomes effective; one-tenth there- of in nine years after said ordinance becomes effective, and one-tenth thereof in ten years after said ordinance becomes effective. One or of said moreL3.nstallments, in the order in which they are payable, or the whole special tax, may be paid at any time within thirty days after the ordinance confirming the levy of the tax becomes effective, with- out interest. In the event of any installment, or the interest afore- said not being paid on the date the same becomes due, the whole amount of the special tax unpaid at the time said installment and interest are due, shall become due and payable, and shall draw interest at the rate of eight per cent per annum until the sale of the property assessed; provided, one or more installments, in the order in which they are payable, or the whole special tax unpaid, may be paid on the day any installment becomes due, by paying the amount thereof and interest to said date.
