118 of 1911 - Ordinance 118 of 1911 – Sidewalk Extension No. 132, Third & Final Estimate. AN ORDINANCE .
An ordinance levying a tax and for the assessment of property
within the district bounded on the north by Ninth South Street, on
the east by State Street, on the south by Martin and Roper Avenues,
and on the west by Fourth West Street, in Sidewalk Districts Nos.
31 and 40, for the construction of cement sidewalks.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That the City Council does hereby levy the tax
and provide for the assessment of the same upon the property here-
inafter described in Sidewalk Districts Nos. 31 and 40, for the
construction of cement sidewalks, to-wit:
In Lots 2, Block 3, Edward's Subdivision, Block 23; 3, 5 and
17, Block 1, Ontario Subdivision, Block 24; 13 and 14, Block 24; 4
and 8, Block 23, all in Five Acre Flat "A", Big Field Survey,
abutting on both sides of Second West Street between Fayette and
Brooklyn Avenues; on the east side of tale Street between Fayette
and Brooklyn Avenues; on the west side of Gale Street between Ninth
South Street and American Avenue; on the north side of Brooklyn
Avenue between Second West and Gale Streets; on the south side of
Brooklyn Avenue between Washington and Second West Streets; on the
north side of American Avenue between Gale and Third West Streets;
and on both sides of Paxton Avenue between First West and Second
West Streets.
This tax is levied to defray the expense of constructing cement
sidewalks upon the property hereinbefore and hereinafter described
to be especially affeotad and benefited by said improvement, and it
is hereby adjudged, determined and established that said property
will be especially benefited thereby to the full amount of the tax
hereby levied, and said parcels of land are hereby assessed at an
equal and uniform rate in accordance with the linear foot frontage
upon said portions of said streets fronting upon and to a depth of

twenty-five (25) feet back therefrom, and the tax hereby levied
and to be assessed upon said parcels of land is one hundred thirteen
amd 25/100 ($113.25) dollars, or 70/100 (40.70) dollars per front
or linear foot of abutting property for sidewalks five (5) feet wide
and four (4) inches thick, there being 161.78 feet of abutting
property within the boundaries of the lots, blocks and streets above
mentioned in said districts, which is the total cost and post per
front foot of said sidewalks, according to the contract entered
into for the performance of said work and making said improvement,
with Smith Brothers Company, dated the 14th day of August, 1911,
and the Treasurer is hereby authorized and directed to assess, in
accordance with the provisions of this ordinance for the purpose
herein mentioned:
Five Foot Sidewalks.
Fronting on the east aide of Second West Street:
Commencing 297.E feet south of the northwest corner of Lot 2,
Block 3, Edward's Subdivision, Block 23, thence south 32.4 feet.
Fronting on the west side of Second West Street:
Commencing at the south corner of Lot 6, Block 1, Ontario Sub-
division, Block 24, thence south 22.5;feet;
Commencing 78.3 feet south of the south corner of Lot 6, Block
1, Ontario Subdivision, Block 24, thence south 22.43 feet.
Fronting on the east side of Gale Street:
Commencing at the north corner of Lot 17, Block 1, Ontario
Subdivision, Block 24, thence north 2.14 feet;
Fronting on the west side of Gale Street:
Commencing at the south corner of Lot 1, Block 4, Coates and
Corum's South Gale Subdivision, Block 24, thence south 12.9 feet.
Fronting on the north side of Brooklyn Avenue:
Commencing at the east corner of Lot 7, Block 1, Ontario Sub-
division, Block 24, thence east 3.66 feet;
Fronting on the south side of Brooklyn Avenue:

Commencing at the west corner of Lot 12, Block 2, West Drive
Subdivision, Block 23, thence west 26.4 feet.
Fronting on the north side of Amerioan Avenue:
Commencing at the east corner of Lot 1, Block 3, Coates and
Corum's South Gale Subdivision, Block 24, thence east 1.35 feet.
Fronting on the north side of Paxton Avenue:
Commencing at the southeast corner of Lot 4, Block 2, Harrington
Donnelly and Newell's Subdivision, Block 23, thence east 13 feet;
Commencing 52 feet east of the southeast corner of Lot 4, Block
2, Harrington, Donnelly and Newell's Subdivision, Block 23; thence
east 12.5 feet.
Fronting on the south side of Paxton Avenue:
Commencing at the northeast corner of Lot 56, Block 1,
Harrington, Donnelly and Newell's Subdivision, Block 23, thence
east 12.5 feet; all in Five Acre Plat "A", Rig Field Survoy, as
the same are shown upon the offioial plats of said city to a depth
of twenty-five (25) feet back from said streets, and to collect
said tax.
SECTION 2. Said tax shall become and be delinquent in five
equal yearly installments, with interest on the whole sum unpaid at
the rate of six per cant per annum, payable at the time each install-
ment is due, to-wit: One-fifth thereof one year after the approval
of the ordinance confirming the levy of the tax for the payment for
such improvement; one-fifth thereof in two years after such approval;
one-fifth thereof in three years after such approval; one-fifth
thereof in four years after such approval; and one-fifth thereof
in five years after such approval. One or more of said installments,
in the order in which they are payable, or the whole special tax
may be paid at any time within thirty days after the approval of
the ordinance confirming the levy of the tax, without interest.
In the event of any installment or the interest aforesaid, not being
paid on the date the same becomes due, the whole amount of the

special tax unpaid at the time said installment and interest are
due, shall become due and payable, and shall draw interest at the
rate of eight per cent per annum until sale of the property assessed;
provided, one or more installments, in the order in which they are
payable, or the whole special tax unpaid may be paid on the day any
installment becomes due, by paying the amount thereof and interest
to said date.
SECTION 3. This ordinance shall take effect upon approval.
