Green Stewart Mr. Chairman Result AN ORDINANCE AN ORDINANCE VACATING A PORTION of Second South Street and a portion of Main Street at the intersection of said streets. WHEREAS, on Tune 1, 1872 (the time of the issuance of United States Patent, granting all of Section One (1) in Township One (1) South, Range One (1) West, Salt Lake Base and Meridian, in the Distriot of lands subject to sale at Salt Lake City, Utah, to Daniel H. Wells, as Mayor of said Salt Lake City, Utah, in trust for the several use and benefit of inhabitants of said City, accord- ing to their respective interests), there was no plat or map of the lots, blocks, streets or alleys of salt Lake City conforming to the actual use and occupancy of the land by reference to any survey or ties to given points or monuments, such plate or maps as were then in existence being only theoretically perfect plats of the various blooks and lots, based in no wise on actual survey or actual use and occupancy; and there were no surveys of said property at that time, of which there are now any public or known records, AND WHEREAS, the first survey of Lot eight (8), Block Fifty-eight (58), Plat "A", Salt Lake City Survey, and the streets on which the same abuts, (which said lot, block and plat are within the limits of said Section I, Township 1 South, Lange 1 West, S.L. B. & M.) of which there is any public or known record was made by the City Engineer's office of said City, in the year 1890, and is commonly known and referred to as the "Survey of 1890," AND WHEREAS, ever since a time prior to the issuance of said United States Patent to said Daniel'H. Wells, Mayor as afore- "_ r v said, the owner of the North Forty-six and twenty two hundredths feet (N. 46.22 feet) of said lot, and its predecessors in title, use and interest, have and do now use, occupy and possess as a part of said lot, the pieces of property hereinafter particularly described and vacated, which, according to the lines of said sur- vey of 1890 are shown to be parts of the streets on which said lot abuts, but which in fact, have never bean used or considered as any part of said streets, but have, at all times been used, occupied and considered as part of said Lot eight (8), AND WHEREAS, Salt Lake City has. not and does not claim the title or right to an easement over, or any use of, said piece of property or any part thereof, as a street or otherwise, and recognized the rights of the owners of said lot by conveyance by quitclaim on July 20, 1922, to the National Bank of the Republic of Salt Lake City, as owner of a portion of said lot, which said quit claim deed was recorded September 18, 1922, in Book 11-S of .Deeds, Page 38-9 thereof, in the office of the County Recorder o+ Salt Lake County, Utah. AND WHEREAS, some question has arisen concerning the sufficiency of said quit claim deed to effectively and completel' remove the cloud placed upon the title of the owners of said lot to said particularly described pieces of property, by reason of the said survey of 1890, AND WREREAS, said pieces. of property are neither used nor required as part of the public streets of wit Lake City, no, in any way for the use or benefit of the public, and it is not necessary, proper or convenient that the streets upon which the North Forty-six and twenty-two hundredths feet (N. 46.22 ft.) of said lot abut should conform to the width as shown by said sur- vey of 1890, or should include the property hereinafter particu- larly described.; TsBE PORE, be it ordained by the Board of Commissioner of Salt Lake City, Utah: -2- i � I SECTION I. That so much of Main Street and of the inter- section of Main and Second South Streets, in salt Lake City and County, Utah, as lies within the following described boundaries, to-wit: "Commencing at the Northeast (NE) corner of Lot Eight (8), Bleak. Fifty-eight (58), Plat "A", Salt Lake City Survey, running thence South Forty-sip and twenty-two Hundredths feet (46.22. ft.), along the Last boundary line of said Lot, thence .bast One and sixty-three hundredths feat (1.63 thence North Forty-six and Ninty eight hundredths feet (46.98 ft.) thence 4Yest One and sixty-three hundredths feet (1.63 ft.), to a point which is North Seventy-six hundredths feet (O.76 ft.), from the Northeast corner of said Lot, thence South Seventy-six Hundredths feet (0.76) to the Northeast corner of said lot, the place of beginnin:. Be and the same is hereby vacated. AND BE IT FURTTTR ORDAINED) that so much of Second. South Street, in Salt Lake City and County, Utah, as lies within the following described boundaries, to-wit: *Commencing at the Northeast ONE) corner of Lot Might ht (8), Block Fifty-eight (58), Plat Survey running thence North Seventy-six Hundredths feet (0.76 ft.), thence ',lest One Hundred Sixty-three and eight hundred thirty-five thousandths feet (165.835 ft.), thence South Seventy-six Hundredths feofet (0.76 said lot,,thence East nOne t nHundred the rsi ty-th thee line and eight hundred thirty-fire thousandths (163.835 ft.) feet, along the North boundary line of said lot to the Northeast corner thereof, the place of beginning" Bel.and the same is hereby vacated.. SECTION 2. That Salt Lake City transfer and convey to The Continental National Bank of salt Lake City, a corporation, all such right, title and interest, if any, as said Salt Lake City may have in and to the said above particularly described pro party, and that the Mayor of Salt Lake City be, and he hereby is, authorised and directed to sign, execute and deliver to said. Con- tinental National Bank of Salt Lake City, and that the City re- corder be, and he hereby is, authorized and. directed to attest a affix the Seal of Salt Lake City to such instruments of conveyano= and other documents as in the opinion of said officers may be necessary or proper to carry out the purpose of the foregoing ordinance, all as the act and deed of Salt Lake City. -3- r: i SECTION 3. In the opinion of the Board of Commissioners of Salt Lake City, it is necessary to the peace, health and safet' of the City that this ordinanoe shall become effective immediatel'. SECTION 4. This ordinance shall take effect upon its first publication.
