122 of 1911 - Ordinance 122 of 1911 – Sewer Extension No. 248, Second Partial Estimate. 4. AN ORDINANCE . An ordinance levying a tax and for the assessment of property on all streets within the district bounded on the north by Fourth North Street, on the east by West Capitol Street, on the south by First North Street, and on the west by First West Street, in Sewer District No. 1, for the construction of sewers. Be it ordained by the City Countil of Salt Lake City, Utah: SECTION 1. That the City Council does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Sewer District No. 1, for the construction of sewers, to-wit: In Lots 4, 5 and 6, Block 16; 1 and 2, Block 21; 1, 2, 6, 7 and 8, Block 20; 1, 2, 3, 4, 5 and 6, Block 17; 1, 2, 5, 6, 7 and 8, Block 12; 1, 2, 3, 4, 5, 6, 7 and 8, Block 11; 1, 2, 3 and. 4, Block 18; 3 and 4, Block 8, Plat "E"; 1 to 9, inclusive, Block 2, Plat "J"; 7, 8, 9 and 10, Capitol Subdivision, Block 10; 10, Block 1; part of the southwest quarter of Section 31, Township 1 north, Range 1 east; 1, 2, 3 and 4, Block 19, Plat "E"; 1 to 12, inclusive, Block 5; 1, 2, 3, 4 and 5, Block 6; 6, Block 7, Plat "J"; 1, Block 30, Plat "E", abutting on both sides of Third North Street between North Main and Quince Streets; on both sides of Apricot Avenue be- tween Wall and Center Streets; on both sides of Second North Street between West Capitol and Center Streets; on both sides of North Main Street between Second North and Fourth North Streets; on the west side of Wall Street between Seoond +forth Street and Apricot Avenue; on the west side of West Capitol Street between Third North Street and Zane Avenue, and between Second North Street and Apricot Avenue; on the east side of West Capitol Street between Fourth North Street and Zane Avenue; and on both sides of Zane Avenue between West Cap- itol and Wall Streets. This tax is levied to defray the expense of constructinne vitri- fied pipe sewers eight (8) inches in di•emeter upon the portions of said streets opposite the property hereinbefore and hereinafter -2- described to be especially affected and benefited by said improve- ment, and it is hereby adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are here- by assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portions of said streets fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is seven thousand four hundred twenty-four and 54/100 ( 7,424.54) dollars, or 8377821/10,000,000 ($0.8377821) dollars per front or linear foot of abutting property for sewer in center of streets, there being 8862.13 feet of abutting property within the boundaries of the lots, blocks and streets above mentioned in said district, which is the total cost and cost per front foot of said sewers, according to the contract entered into for the performance of said work and making said improvement, with James Kennedy Construction Compeny, dated the 13th day of June, 1911, and the Treasurer is hereby authorized and directed to assess in accordance with the provisions of this ordinance for the purpose herein mentioned: Sewer in Center of Streets. Fronting on Third North Street: The eat 79.5 feet of Lot 4, all of Lot 5, the west 86.96 feet of Lot 6. Block 16; the east 103.33 feet of Lot 2, the west 133.54 feet of Lot 1, Block 21; the east 140 feet of Lot 2, the west 140 feet of Lot 1, Block 20; the east 84 feet of Lot 4, all of Lot 5, the west 84 feet of Lot 6, Block 17, Plat "s". Frontirg on Apricot Avenue: The east 84 feet of Lot 3, all of Lot 2, the west 84 feet of Lot 1, Block 17; the east 138.36 feet of Lot 5, the west 140 feet of Lot 6, Block 12; the east 85 feet of Lot 5, all of Lot 6, the west 85 feet of Lot 7, Block 11; the east 133.43 feet of Lot 2, the west 133 feet of Lot 1, Block 18, Plat "E". Fronting on Second North Street: The east 102.88 feet of Lot 3, the west 123.65 feet of Lot 4, Block 8; the east 148.36 feet of Lot 2, the west 138.34 feet of Lot 1, Block 12; the east 85 feet of Lot 3, all of Lot 2, the west 85 feet of Lot 1, Block 11, Plot "E"; the east 170 feet of the west 195 feet of Lot 1, Block 2, Plat "J"; the east 115.25 feet of Lot 7, all of Lots 8, 9 and 10, Capitol Subdivision, Block 10; the west 79.4 feet of Lot 10, Block 1, Plot "E"; the part of the southwest quarter of Section 31, Township 1 north, Range 1 east, fronting on Second North Street, commencing 79.4 feet east of Wall Street, thence east 80.6 feet. Fronting on North Main Street: The south 116.90 feet of Lot 6, all of Lots 1, 7 and 8, Block 20; all of Lots 1, 2, 3 and 4, Block 19; all of Lots 1 and 6, Block 17; all of Lots 2, 3 and 4, Block 18; all of Lois 1, 5, 7 and 8, Block 12; all of Lots 3, 4 and 5, Block 11, Plat "E". Fronting on Wall Street: All of Lots 1, 7 and 8, Block 11, Plat "B". Fronting on West Capitol Street: All of Lots 1 to 9, inclusive, Block 2; all of Lots 1 to 12, inclusive, Block 5; the south 127 feet of Lot 1, Block 6; all of Lot 6, Block 7, Plat "J". S?CTTON 2. ei3 tax shall become and be delinquent in five equal yearly installments, with interest on te whole :Bum unp€Ad at the rate of six per cent per annum, payable at the time eachinstall - sent is due, to-wit: One-fi fth thereof one yeer after the approval. -4- of the ordinance confirming the levy of the tax for the payment for such improvement; one-fifth thereof in two years after such approval one-fifth thereof in three years after such approval; one-fifth thereof in four years after such approval; and one-fifth thereof in five years after such approval. One or more of said install- ments, in the order in which they are payable, or the whole special tax may be paid at any time within thirth days after the approval of the ordinance confirming the levy of the tax, without interest. In the event of any installment or the interest aforesaid not bein paid on the date the same becomes due, tee whole amount of the special tax unpaid at the tine said installment and interest nre due, shall become due and pcynble, end shall drrw interest at the , rate of eight per cent per annum until the sale of the property assessed; provided, one cr more installments, in the order in which they are payable, or the whole special tax unpaid, may be paid on the day any installment becomes due, by paying the arount thereof and interest to said date. 31CTION 3.
