AN ORDINANCE AN ORDINANCE AMENDING Chapter 20 of Title 18 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to Dairy and Milk Inspection. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Chapter 20 of Title 18 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to dairy and milk inspection, be, and the same hereby is, amended to read as follows: CHAPTER 20 DAIRY AND MILK INSPECTION - BULK MILK HAULERS Sections: 18-20-1. Permit required. 18-20-2. Qualification requirements. 18-20-3. Fee and duration of permit. 18-20-4. Quality of milk. 18-20-5. Milk weight. 18-20-6. Butterfat sample. 18-20-7. Bacterial sample. 18-20-8. Transferring milk to the tanker. 18-20-9. Rinsing. ].8-20-10. Personal cleanliness. 18-20-11. Manhole cover on tanker. 18-20-12. Validity. 18-20-13. Penalty. 18-20-14. Power to make rules and regulations. Sec. 18-20-1. Permit required. It shall be unlawful for any person to haul milk in bulk into Salt Lake City for processing or sale, either from within the city or outside the city, from the farm or other producing areas without. first obtaining a permit from the Salt Lake City-County Health Department. Sec. 18-20-2. Qualification requirements. Application may be made upon a form to be provided by the Health Depart- ment. Before a permit may be issued, a licensed sanitarian must accompany the applicant over the proposed route and instruct the applicant in proper methods and procedure in receiving and handling milk. The Health Commission may require the applicant to take an appropriate test to deter- mine the applicant's fitness and knowledge of procedures required by the Health Department. Sec. 18-20-3. Fee and duration of permit. The fee for the permit shall be $3.00. Such permit must be renewed year- -2- ly on the 1st day of January of each year, but further examination may be waived. Said permit may be revoked at any time for a violation of this Act or for a vio- lation of Sanitary Procedure. Sec. 18-20-4. Quality of milk. Before accepting any milk, the hauler shall inspect the milk to deter- mine: 1. That the physical appearance of the milk is natural and does not contain any blood, insects, or sediment visible to the naked eye. 2. That the temperature of the milk is 50° F. or lower. Temperature reading shall be taken by an accurate thermometer independent of the milk tanker thermometer. 3. That there is no foreign odor to the milk such as an odor of weeds, silage, medicine, dis- infectant, or pesticides. To check the odor the hauler must open the porthole in the lid of the tank. Sec. 18-20-5. Milk weight. The hauler must determine the weight of the milk in accordance with the rules and regulations prescribed by the health authority. Sec. 18-20-6. Butterfat sample. The hauler must take a sample of the milk to aid in determination of the butter- fat content of the milk. Said sample shall be taken in accordance with the rules and regulations prescribed by the health authority. Sec. 18-20-7. Bacterial sample. The hauler must take a sample of milk to aid in determination of the bacterial count. Said sample shall be taken in accordance with the rules and regulations prescribed by the health authority. Sec. 18-20-8. Transferring milk to the tanker. The transfer hose must be kept capped immediately before hook- ing into the bulk tank and must be capped immediately upon unhooking therefrom. The outside of the transfer hose shall be kept clean. Sec. 18-20-9. Rinsing. The hauler must rinse the milk tank free of milk or foam, and must rinse the floor free of milk. Sec. 18-20-10. Personal cleanliness. The hauler must keep his hands clean at all times. No smoking is permitted in the milk room. The hauler's clothes must be clean. Sec. 18-20-11. Manhole cover on tanker. The manhole cover on the tanker must be kept closed at all times after the tanker is washed and sanitized. Sec. 18-20-12. Validity. Provisions contained herein are separable and if any provisions herein shall be invalid it shall not affect the validity of the remainder. If this ordinance conflicts or seemingly conflicts with the pro- visions of any other ordinance, the ordinance requiring the most effectual control shall be construed to govern the situation. Sec. 18-20-13. Penalty. Any person who violates the provisions of this ordinance shall be guilty of a misdemeanor -3- and shall be punished by a fine of not more than $299 and imprisonment for 6 months or both such fine and imprison- ment. Sec. 18-20-14. Power to make rules and regulations. The Salt Lake City-County Director of Health may make such rules and regulations to enforce the foregoing provisions as he deems just and proper. SECTION 2. In the opinion of the Board of Commissioners, it is necessary to the peace, health and welfare of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 3. This ordinance shall take effect upon its first publication.
