126 of 1910 - Ordinance 126 of 1910 – Paving Extension No. 51, First Partial Estimate. APT ORDINANCE. An ordinance levying a tax and for the assessment of the property hereinafter described on First Avenue from the west line of "J" Street to the west line of Virginia Street in paving districts 1 No. 24 and 30 for the purpose of providing for the grading, guttering and curbing and paving thereof. Be it ordained by the City Council of Salt lake City, Utah: Section 1. That the City Council does hereby levy the tax and provide far the assessment of the same upon the property hereinafter described in Paving Districts No. 24 and 30 for the purpose of providing for the grading, guttering and curbing, and paving of portions of said districts, to-.wit: In Lots 3 and 4, Block 1; 3 and 4, Block 2; 3 and 4, Block 3; 3 and 4, Block 4; 3 and 4, Block 5; 3 and 4, Block 6; 3 and 4, Block 7; 3 and 4, Block 8; 1 and 2, Block 9; 1 and 2,Block 10; 1 and 2, Block 11; 1 and 2, Block 12; 1 and 2, Block 13; 1 and 2, Block 14; 1 and 2, Block 15; 1 and 2, Block 16; all in Plat "G", Salt Lake City Survey abutting on both sides of First Avenue between "N" and Virginia Streets; and Lots 3 and 4, Block 1; 3 and 4, Block 2; 3 and 4, Block 3; 3 and 4, Block 4; 1 and 2, Block 25; 1 and 2, Block 26; 1 and 2, Block 27; 1 and 2 Block 28, all in Plat "D", Salt Lake City Survey, abutting on both sides of First Avenue between "J" and "N" Streets. This tax is levied to defray the expense of grading and paving with asphalt ( said asphalt pavement to be forty (40') Meet wide between curbs, and Nine and one half (9- ) inches thick) the portions of said First Avenue hereinbefore and hereinafter described to be especially affected and benefitted by said improvement, :nd it is hereby adjudged, determined and established that said property will be especially benefitted thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portions of said street fronting upon and Ito a depth of Twenty--fin (25) feet back thereof, and the tax hereby levied and to be assessed upon said parcels of land is Forty-Three Thousand One Hundred Sixteen and 75-100 ($43,116.75) dollars or, Five and 541606-1,000,000 ($5.541606) dollars per front foot of abutting property for roadway Forty (40) feet wide, there being 7780.55 feet of abutting property within the boundaries of the lots, blocks and street above mentioned in said districts, which is the total cost and cost per front foot of said pavement, according to the contract entered into for the performance of said work and making said improvement, with P. J. Horan, dated the 27th. day of December 1909, and the Treasurer is hereby authorized and directed to assess in accordance with the provisions of this ordinance for the purpose herein mentioned: FORTY FOOT ROADWAY. The north side of Lots 3 and 4, Block 11 the north side of Lots 3 and 4, Block 2; the north side of Lots 3 and 4, Block 3; the north side of Lots 3 and 4, Block 4; the north side of Lots 3 and 4, Block 5; the north side of Lots 3 and 4, Block6; the north side of Lots 3 and 4, Block 7; the north side of Lots 3 and 4, Block 8; the south side of Lots 1 and 2, Block 9; the south side of Lots 1 and 2, Block 10; the south side of Lots 1 and 2, Block 11, the south side of Lots 1 and 2, Block 12; the south side of Lots 1 and 2, Block 13; the south side of Lots 1 and 2, nook 14; the south side of Lots 1 and 2, Block 15; the south side of Lots 1 and 2, Block 16, all in Plat "G" Salt Lake City Survey; and the north side of Lots 3 and 4, Block 1, the north side of Lots 3 and 4, Block 2; the north side of 3 and 4, Block 3; the north side of Lots and 4, Block 4; the south side of Lots 1 and 2, Block 25; the south side of Lots 1 . and 2, Block 26; the south side of Lots 1 and 2, Block 27; the south side of Lots 1 and 2, Block 28; all in Plat "D", Salt Lake City Survey, as the same is shown upon the of-ricial plats of said City to a denth of Twenty-five (25) feet back from said street, and to collect said tax. Section 2. Said tax shall become and be delinquent in ten equal yearly installments, with interest on the whole sum unpaid at the rate of 6% per annum, payable at the time each installment is due, to-wit; One tenth thereof one year after the approval of the ordinance confirming the levy of the tax forv£he 'paymea t for such improvement; one-tenth thereof in two years after such approval; one.- tenth thereof in three years after such approval; oae-'tenth in four years after such approval; one-.tenth in five Years after such approval; one-tenthnin six years after such approval; one-tenth in seven years after such approval; one-tenth in eight years after such approval; one-tenth in nine years after such aoaroval, and one-tenth in ten years after such approval. One or more of said installments, in the order in which they are payable, or the whole special tax may be paid at any time within Thirty days after the aPProval of the ordinance confirming the levy of the tax, without interest. In the event of any installment or the interest aforesaid not being paid on the date the same becomes due, the whole amount on the special tax unpaid at the time said installment and interest are due, shall become due i and payable, and shall draw interest at the rate of 8510 per annum until sale of the property assessed. provided, one or more installments, inH the order in which they are payable, or the whole special tax unpaid may be paid on the day any installment becomes due, by paying the amount thereof and interest to said date. y n Section 3.
