Scheid____ Shearman ;r t ' i� 9 11 Wells �� Mr.Chairman Imo:` Result AN ORDINANCE An ordinance levying a tax and for the assessment of property on Fifteenth Fast Street between Yale Avenue find Tenth South Street, in Paving District No. 32, for the purpose of providing for the grading, curbing and guttering over Red Butte Gulch, construoting drainage system, and paving thereof. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Paving District No. 32, for the purpose of providing for the grading, ourbing and guttering over Red Butte Gulch, constructing drainage system, and paving thereof, to-wit: In Lots 12, Yale Park Subdivision; 17 and 18, all in Block 30; 16, Block 2; 15, Block 1, Yale Park Plat "A" Subdivision; 6 and 7, all in Block 29, end all in Five Acre Plat "C", Big Field Survey, abutting on both sides of Fifteenth East Street between Yale and Harvard Avenues. This tax is levied to defray the expense of grading, curbing and guttering over Red. Butte Gulch, constructing drainage system of corrugated iron pipe fifteen (15) inches in diameter, and paving with asphalt (said asphalt pavement to be forty-four (44) feet between curbs and eight (8) inches thick with five (5) inch concrete -1- base, one and one-half (1*) inch binder, and one and one-half (1*) inch top) , the portions of said street opposite the property here- inbefore and hereinafter described to be especially affected and benefited by said improvement, and it is hereby adjudged, deter- mined and established that said property will be especially bene- fited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at en equal and uniform rate in accordance with the linear foot frontage upon said portio of said street, fronting upon and to a depth of twenty-five (25) feet back therefrom, and the taix hereby levied and to be assessed upon acid parcels of land is seven thousand twenty-four and 66/10. (t7,024.66) dollars,or four and 60/100 (44.60) dollars per front or linear foot of abutting property, there being 1527.10 feet of abutting property within the boundaries of the lots, blocks and street above mentioned in said district, which is the total cost and cost per front foot of said improvement, according to the con- tract entered into for the performance of said work and making said improvement, with P. J. Moran, Contractor, Incorporated, dated the 27th day of 0otober, 1915, end the Treasurer is hereby authorized and directed to assess, in accordance with the provi- sions of this ordinance, for the purpose herein mentioned: The east side of Lot 12, Yale Park Subdivision; the east aide of Lot 17, the east side of the south 221.1 feet of Lot 18, all in Block 30; the west side of the south 256.6 feet of Lot 7, the west side of Lot 6; the west side of Lot 15, Block 2; the west side of Lot 15, Block 1, Yale Park Plat "A" Subdivision, all in Block 29, and all in Five Acre Plat "C", Big Field Survey, as the same are shown upon the offioial plats of said City to a depth of twenty- five (25) feet back from said street, and to oollect said tax. SECTION 2. Said tax shall become and be delinquent in ten equal yearly installments, with interest on the whole sum unpaid at the rate of six per Dent per annum, payable at the time each -2- installment is due, to-wit: One-tenth thereof one year after the ordinance confirming the levy of the tax for the payment for such improvement becomes effective; one-tenth thereof in two years after said ordinance becomes effective; one-tenth thereof in three years Rafter said ordinance becomes effective; one-tenth thereof in four years after said ordinance becomes effective; one-tenth thereof in five years after said ordinance becomes effective; one-tenth there of in six years after said ordinance becomes effective; one-tenth i thereof in seven years after said ordinance becomes effective; one- tenth thereof in eight years after said ordinance becomes effecti , one-tenth thereof in nine years after said ordinance becomes effe - ive; and one-tenth thereof in ten years after said ordinance ibecomes effective. One or more of said installments, in the orde in which they are payable, or the whole special tax, may be paid at any time within thirty days after the ordinance confirming the levy of the tax becomes effective, Without interest. In the even of any installment, or the interest aforesaid not being paid on the date the same becomes due, the whole amount of the special tax unpaid at the time said installment and interest are due, shall become due and payable, and shall draw interest at the rate of eight per cent per annum until the sale of the property assess d; provided, one or more installments, in the order in which they ar payable, or the whole special tax unpaid, may be paid on the day any installment becomes due, by paying the amount thereof and interest to said date.
