Result AN ORDINANCE An ordinance levying a tax and for the assessment of property on Sixteenth East Street between Roosevelt and Bryan Avenues; on Emerson Avenue between Fifteenth East and Seventeenth East Streets; and on Kensington Avenue between Sixteenth East and Seventeenth East Streets, in 'Paving District No. 32, for the purpose of provid- thereof, ing for the grading, curbing and gutterin/oonstructing drainage system and cement sidewalks thereon. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Paving District No. 32, for the purpose of providing for the grading, curbing and guttering thereof, and constructing drainage system and cement sidewalks thereon, to-wit: In Lots 30 to 52, inclusive, Block 7; 4 to 26, inclusive, Block 8, University Heights Subdivision; 58, Block 3; 3, Block 4, College View Subdivision; 4 to 19, inclusive, Block 1; 4 to 42, inclusive, Block 2; 4 to 27, inclusive, Block 3, University Heights Second Addition, all in Block 12, Five Acre Plat "C", Big Field Survey, abutting on both sides of Sixteenth East Street between Roosevelt and Bryan Avenues; on both sides of Emerson Avenue between Fifteenth East and Seventeenth East Streets; and on both sides of Kensington Avenue between Sixteenth East and Seventeenth East Streets. -1- 130 This tax is levied to defray the expense of grading, curbing and guttering with cement, ess3wm ', constructing drainage system of cement, vitrified, corrugated iron and wrou •Lt iron pipe from six (6) inches to twelve (12) inches in diameter, and build cement sidewalks five (5) feet wide and four (4) inches thick (said side- walks to consist of three and one-quarter (34) inch base end three quarter(*) inch topping) upon the portions of said streets opposit= the property hereinbefore and hereinafter described to be expeoiel'y affected and benefited by said improvement, and it is hereby adjud:ed determined and established that said property will be espeoially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portion= of said streets fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is ninety-three hundred sixty-seven and 40/100 ($9367.40) dollars; twenty-one hundred ninety-five and 55/100 ($2195.55) dollars, or two and 25/100 (02.25) dollars per front or linear foot of abutting property for fifty (50) foot road way, there being 975.80 feet abutting said portion of said improve ment; and seventy-one hundred seventy-one and 85/100 (07171.85) dollars, or two and 17/100 (02.17) dollars per front or linear foot of abutting property for thirty-six (36) foot roadway, there being 3305 feet abutting said portion of said improvement, within the boundaries of the lots, blocks and streets above mentioned in said district, which is the total cost and cost per front foot of said improvement, according to the oontraot entered into for the performance of said work and making said improvement, with H. G. Gilkerson, dated the 23rd day of April, 1914, and the Treasurer is hereby authorized and directed to assess, in accordance with the provisions of this ordinance, for the purpose herein mentioned: Fifty Foot Roadway. (Sixteenth East Street) -2- The east side of Lots 49 to 52, inclusive, Block 7; the east side of Lots 23 to 26, inclusive, Block 8, University Heights Sub- division; the east side of Lot 58, Block 3; the east side of Lot 3, Block 4, College View Subdivision; the west side of Lots 14 to 19, inclusive, Block 1; the west side of Lots 14 to 23, inclusive, Block 2; the west side of Lots 24 to 27, inclusive, Block 3, University Heights Second Addition, all in Block 12, Five Acre Plat "C", Big Field Survey. Thirty-six Foot Roadway. (Emerson and Kensington Avenues The south side of Lots 30 to 49, inclusive, Mock 7; the north side of Lots 4 to 23, inclusive, Block 8, University Heights Sub- division; the south side of Lots 4 to 24, inclusive, Block 3; the north side of Lots 23 to 42, inclusive, Block 2; the north side of Lots 19, and 4 to 13, inclusive, Block 1; the south side of Lots 4 to 14, inclusive, Block 2, University Heights Second Addition, all in Block 12, Five Aore Plat "C", Big Field Survey, as the same are shown upon the official plats of said city to a depth of twenty- five feet back from said streets, and to collect said tax. SECTION 2. Said tax shall become and be delinquent in five equal yearly installments, with interest on the whole sum unpaid at the rate of six per Dent per annum, payable at the time each in- stallment is due, to-wit; One-fifth thereof one year after the ordinance confirming the levy of the tax for the payment for such improvement becomes effective; one-fifth thereof in two years after said ordinance becomes effective; one-fifth thereof in three years after said ordinance becomes effective; one-fifth thereof in four years after said ordinance becomes effective; and one-fifth thereof in five years after said ordinance becomes effective. One or more of said installments, in the order in which they are pay- able, or the whole special tax, may be paid at any time within thirty days after the ordinance confirming the levy of the tax becomes effective, without interest. In the event of any install- -3- ment or the interest aforesaid not being paid on the date the same becomes due, the whole amount of the special tax unpaid at the time said installment and interest are due, shall become due and payable, and shall draw interest at the rate of eight per cent per annum until the sale of the property assessed; provided, one or more installments, in the order in which they are payable, or the whole special tax unpaid, may be paid on the day any installment becomes due, by paying the amount thereof and interest to said dat:.
