Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Subsections (1) and (3) of Section 20-16-1 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to definitions of secondhand and junk dealers, be, and the same hereby are amended as follows: Sec. 20-16-1. * * * (1) Secondhand Dealer. "Secondhand dealer" shall mean any person who keeps a store, office or place of business for the purchase, barter or exchange or sale of any secondhand merchandise of value, or who engages in the business of dealing in secondhand goods. For the purpose of this chapter, a "secondhand dealer" shall not be meant to include any person who deals in the purchase, barter, exchange or sale of used motor vehicles and trailers, nor a scrap metal processor licensed under Section 20-16A-4 of these revised ordinances. * * * (3) Junk Dealer. "Junk dealer" shall mean any person who engages in buying or selling old metals, glass, rags, rubber, paper or other junk from a fixed place of business. For the purposes of this chapter, a "junk dealer" shall nOt include a scrap metal processor licensed under Section 20-16A-4 of these revised ordinances. * * * SECTION 2. That Title 20 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to License and Business Regulation, be, and the same hereby is, amended by adding thereto a new Chapter 16A, relating to scrap metal processors, to read as follows: -2- Chapter 16A SCRAP METAL PROCESSORS Sections: 20-16A-1. Scrap metal processor. 20-16A-2. Records to be maintained. 20-16A-3. Dealing with minors prohibited. 20-16A-4. License required. 20-16A-5. License fee. Sec. 20-16A-1. Scrap metal processor. A scrap metal pro- cessor shall mean any person who, from a fixed location, utilizes machinery and equipment for processing and manufacturing iron, steel or non-ferrous scrap into prepared grades and whose prin- cipal product is scrap iron, scrap steel or non-ferrous metallic scrap for sale for remelting purposes. Sec. 20-16A-2. Records to be maintained. Each scrap metal processor shall maintain for at least two years written records of all materials purchased or received. Such records shall con- tain the name and address of the person from whom said materials were purchased and received, the date of said transaction, the type of identification presented, a description of the property and the license number of the vehicle used by the seller to de- liver such material to the purchaser. Sec. 20-16A-3. Dealing with minors prohibited. It shall be unlawful for any licensee under this chapter by himself, his agents or servants, to purchase or receive any material referred to in section 20-16A-1 from any person under 18 years of age without the written consent of a parent or guardian of said person. Sec. 20-16A-4. License required. It shall be unlawful for any person to operate as a scrap metal processor without first obtaining a license to do so. Sec. 20-16A-5. License fee. The license fee for operating as a scrap metal processor shall be $200.00 per annum. SECTION 3. This Ordinance shall take effect upon its first publication.
