131 of 1916 - Levying Tax on Sidewalk Extension No. 181-2nd Partial ROLL CALL VOTING AYE NAY Salt Lake City, Utah,_Oataber_24_,____191__6 Green Scheid - I move that the ordinance Sc passed. _1( _-- V .__ - Shearman Wells61 • , a Mr.Chairman Result AN ORDINANCE An ordinance levying a tax and for the assessment of property on the west side of Highland Park Drive from 587 feet south of Twelfth South (now Twenty-first South) Street to Ashton Avenue, in Sidewalk District No. 44, for the purpose of providing for the grading, constructing cement sidewalk, and constructing concrete conduit for Jordan and Salt Lake Canal, the cost of the construction of said conduit to be paid by Salt Lake City. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Sidewalk District No. 44, for the purpose of providing for the grading, constructing cement sidewalk and constructing concrete conduit thereon for Jordan and Salt Lake Canal, the cost of the construction of said conduit to be paid for by Salt Lake City, to-wit: In Lots 1, and 5 to 7, inclusive, Block 3, Granite Subdivision; 8, all in Block 46, Ten Acre Plat t"Att, Big Field Survey, abutting on the west side of Highland Park Drive from Ashton Avenue north to first angle point. This tax is levied to defray the expense of grading, construct- ing cement sidewalk five (5) feet wide and. four (4) inches thick, with three and one-quarter (3a) inch base and three-quarter ( ) inch topping, and constructing concrete conduit for Jordan and -1- Salt Lake Canal, the cost of the construction of said conduit to be paid for by Salt Lake City, upon the portions of said street opposite the property hereinbefore and hereinafter described to be especially affected and benefited by said improvement, and it is hereby adjudged, determined and established that said property wil be especially benefited thereby to the full amount of the tax here by levied, and said parcels of land are hereby assessed at an equa and uniform rate in accordance with the linear foot frontage upon said portions of said street, fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is five hundred forty five and 66/100 (6545.66) dollars, or 95/100 (0.95) dollars per front or linear foot of abutting property, there being 574.38 feet abutting said improvement within the boundaries of the lots, block: and street above mentioned in said district, which is the total cost and cost per front foot of said sidewalk, according to the contract entered into for the performance of said work and making said improvement, with Ryberg Brothers, dated the 19th day of June 1916, and the Treasurer is hereby authorized and direoted to asses in accordance with the provisions of this ordinance, for the pur- pose herein mentioned: The east side of Lots 1, and 5 to 7, inclusive, Block 3, Granite Subdivision; commencing at the northeast corner of Lot 5, Block 3, Granite Subdivision of Block 46, Ten Acre Plat "A", then°; north 20° 02' 46" west 96.44 feet, being part of Lot 8; commencing north 20° 02' 46" west 106.14 feet from the northeast corner of Lot 5, Block 3, Granite Subdivision of Block 46, Ten Acre Flat "A" thence north 20° 02' 46" west 300 feet, being a part of Lot 8, all in Block 46, Ten Acre Plat "A", Big Field Survey, as the same are shown upon the official plats of said City to a depth of twenty- five (25) feet back from said street, and to collect said tax. SECTION 2. This tax shall become and be delinquent in five -2- equal yearly installments, with interest on the whole sum unpaid at the rate of six per cent per annum, payable at the time each installment is due, to-wit: One-fifth thereof one year after the ordinance confirming the levy of the tax for the payment for such improvement becomes effective; one-fifth thereof in two years afte said ordinance becomes effective; one-fifth thereof in three years after,se d ordinance becomes effective; one-fifth thereof in four yearsiu, er.sa.id ordinance becomes effective; and one-fifth there- of in,fibeyears after said ordinance becomes effective One or more 8f said installments, in the order in which they are payable, or the whOie-appp ial tax, may be paid at any time within thirty days after the .;prdinance confirming the levy of the tax becomes effective, without interest. In the event of any installment or the interest aforesaid not being paid on the date the same becomes due, the whole amount of the special tax unpaid at the time said installment and interest are due, shall become due and payable, and shall draw interest at the rate of eight per cent per annum until the sale of the property assessed; provided, one or more installments, in the order in which they are payable, or the whol= special tax unpaid, may be paid on the day any installment become due, by paying the amount thereof and interest to said date. SECTION 3. This ordinance shall take effect one day after its first publication.
