Equipment Standards]
AN ORDINANCE AMENDING TABLE 2, SUBSECTION 4(B), SECOND
PARAGRAPH OF SECTION 32-9-5 OF THE REVISED ORDINANCES OF SALT
LAKE CITY, UTAH, 1965, RELATING TO EQUIPMENT STANDARDS.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Table 2, SubSection 4(b), second paragraph
of Section 32-9-5 of the Revised Ordinances of Salt Lake City,
Utah, 1965, is hereby amended to read as follows:
32-9-5. Equipment standards. * * *

(a) * * *
(b) Subject to the provisions of subsection (a) of this
section, any equipment which is the subject of regulation as
provided in this section and which is manufactured prior to
January 1, 1974, may be exempted from the noise levels specified
herein provided a good and sufficient showing can be made that as
the machinery exists it is impossible without major recon-
struction to modify such equipment so as to be in compliance.
A written statement from the manufacaturer indicating that
such a condition exists must be presented to the Mayor or his
designated agent before an exemption will be granted. Such
statement shall be buttressed by a written statement from the
manufacturer's representative that such equipment is equipped in
all other respects so as to minimize to the maximum degree
possible the objectionable noise.
Said exemption may be granted if a showing is made as above
provided, and provided further that the noise thus emitted is not
of such a nature as to require its total prohibition.

SECTION 2. This ordinance shall take effect upon its first
publication.
Passed by the City Council of Salt Lake City, Utah,
this 9th day of December , 1980.
