AN ORDINANCE An ordinance amending and re-enacting an ordinance granting a franchise to the Emigration Canyon Railroad Company, approved February 5th, 1908. Be it ordained by the City Council of Salt wake City,Utah i,. SECTIONI. That section one of an ordinance granting a franchise to the Emigration Canyon Railroad Company along and across certain streets of Salt Lake City, approved February 5th, 1908, be, and the same is hereby amended by adding to that section after the word "granted" at the end of Subdivision three, the following: Also a right of way over and along 21st East Street of Salt Lake City, commencing at the north end of said street where it joins upon the United States Military Reservation, running thence south to the southern limits of Salt Lake City. Also a right of way three rods wide over the city lands in and on each side of what is known as Parley's Canyon Creek Hollow lying south of 12th South Street as shown in yellow lines upon a blue print, hereto attached and made a part hereof including sufficient ground for switches and connection with the Denver &. Rio Grande Railroad at the place of crossing their tracks, provided that before said grantee shall occupy said right of way over lands owned by the city, it shall pay into the City Treasury the sum of : 2u0.u0 per acre for all land used in this right of way. The said grantee shall also have the right to make arrangement with the Utah Light & Railway Company to operate its passenger cars over the tracks of said last named company for carrying pas- sengers only, from Main Streets and hotelsin said city to the Emigration Canyon Railroad Company's depot grounds at the east end of 5th South Street. Also the right to make track connections on the south side of said 5th South Street at the junction of said railroads <:nd on the south side of said street so as to connect the tracks of said Utah Light & Railway Company with the track of the Emigration Canyon Railroad Company. 32 2 Provided that elecO'ric power o ' some other power reasonably- equal thereto is to be used on said road; steam or horse power never to be used during the life of this franchise. Freight trains to run only between 9 o'clock P. P. and 6 o'clock A. M. excepting for gravel or other material for repair of the road and streets. Said company to have the right to run express care at any time. The fare to be five cents on this road from iweith South Street to the Western terminus of the Emigration Canyon Railroad, Passenger service sha ll be run ever day Y at least every hour starting from the south end of the line, when completed, at six o'clock A. M. and until eight o'clock P. M. when the last car shall leave the western terminus, and such further service II as shall be reasonably required to accommodate the public travel. The track shall be located just a little east of the middle of the road so as to provide for a double track hereafter, and said grantee, its successors and assigns shall gravel and main- tain ingood condition at the established grade between tracks and fifteen feet each side the outer rail to the approval ofthe Street Supervisor of Salt Lake City the streets over which this ordinance grants a franchise. And provided further that the road to be built hereunder III shall be completed as fax southas Tenth So uth Street within two years from the date of thieiordinance; otherwise this franchise shall be null and void. This amendment to take effect up on approval, and shall be co-extensive with the origianl ordinance to which this is an amendment.
