Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the assessment list made by the City Treasurer as corrected, approved and completed by the Board of Commissioners of Salt Lake City, sitting as a board of equaliza- tion and review, of the property in Lots 1 and 8, Block 64; and 5, Block 65, Plat "A", Salt Lake City Survey, abutting on both sides of Fourth West Street between First South and Second South Streets, in Paving District No. 28, of Salt Lake City, for the purpose of providing for the grading, curbing and guttering, constructing private driveways and drainage system, and paving said portion of said street, is hereby confirmed, and the assessments made and returned in said completed lists ate hereby confirmed. ci -1- • SECTION 2. Scheid Y Shearman-- Wells Mr.Chairman _ Result � AN ORDINANCE An ordinance levying a tax and for the assessment of property on First South Street between Main and State Streets, and on State Street between First South and Fourth South Streets, in Paving Districts Nos. 1 and 4, for the purpose of providing for the grading, removing stone curb and stone blocks, constructing curb and gutter and private driveways, and repaving and resurfacing thereof. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Paving Districts Nos. 1 and 4, for the purpose of providing for the grading, removing stone curb and stone blocks, constructing curb and gutter and private driveways, and repaving and resurfacing thereof, to-wit: In Lots 1 and 8, Block 52; 2, 3, 4 and 5, Block 53; 4 and 5, Block 56; 1, 6, '7 and 8, Block 57; 1 and 8, Block 70; and 2, 3, 4 and 5, Block 71, all in Plat "A", Salt Lake City Survey, abutting on both sides of State Street between First South and Fourth South Streets. This tax is levied to defray the expense of grading, removing stone curb and stone blocks, constructing curb and gutter and private driveways of cement, and repaving and resurfacing with sheet asphalt (said sheet asphalt pavement to be ninety (90) feet between curbs -1- '"<< and nine and one-half (9*) inches thick, with six (6) inch coneret= base, one and one-half (1*) inch binder of asphaltic concrete and two (2) inch topping of sheet asphalt) , the portions of said stree s opposite the property hereinbefore and hereinafter described to be especially affected and benefited by said improvement, and it is hereby adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portions of said streets, fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levie. and to be assessed upon said parcels of land is twenty-five thous., d one hundred forty and 52/100 (*25,140.52) dollars; twenty-six thousand four hundred sixty and 13/100 ($26,460.13) dollars, or six and 98/100 ($6.98) dollars per front or linear foot of abuttin: 01819.61) dollars) , property, less one thousand eight hundred nineteen and 61/1Q or 48/100 (*0.48) dollars per foot, credit for Atm curb and stop= blocks removed, leaving twenty-four thousand six hundred forty and 52/100 ($24,640.62) dollars, or six and 50/100 ($6.50) dollars per front or linear foot of abutting property for said ninety foot roadway, there being 3790.85 feet abutting said portion of said improvement; and five hundred (0500.00) dollars for private drive- ways, or fifty ($50.00) dollars for each private driveway, there being ten private driveways, the cost of the construction of whin. and the property benefited thereby is hereinafter set out, and al within the boundaries of the lots, blocks and street above mentio =d, which is the total cost and cost per front foot of said improveme , according to the contract entered into with J. V . Mellen, dated the 17th day of July, 1916, and the Treasurer is hereby authorize• and directed to assess, in accordance with the provisions of this ordinance, for the purpose herein mentioned: The east side of the south 179 feet, and the east side of the -2.. north 85 feet of Lot 1, the east side of Lot 8, Block 52; the west side of Lots 4 and 5, Block 56; the east side of Lots 1, 6 and 8, the east side of the south 64 feet, and the east side of the north 89 feet of Lot 7, Block 57; the east side of the north 177 feet, 9( and the east side of the south 113.35 feet of Lot 8, the east side of Lot 1, Block 70; the west side of Lots 2 and 3, the west side .5 of the south 76.5 feet, and the west side of the north ± feet of Lot 4, the west side of the north 91 feet, and the west side of the north 50 feet of the south 62 feet of Lot 5, Block 71; the we side of Lots 2, 4 and 5, the west side of the north 49.5 feet, an. the west side of the south 100 feet of Lot 3, Block 53, all in Plat "A", Salt Lake City Survey. The east side of the north 110 feet of Lot 6, the east side of the north 16.5 feet of Lot 1, Block 57; the east side of the north 177 feet of Lot 8, the east side of the north 40 feet, the east side of the south 59 feet of the north 99 feet , the east side of the north 49 feet of the south 181 feet, and the east sid> of the south 132 feet of Lot 1, Block 70; the west side of the north 76.5 feet of Lot 4, the west side of the south 57.75 feet, and the west side of the north 57.75 feet of the south 115.5 feet of Lot 3, Block 71; the west side of the north 82.5 feet of Lot 4, Block 53, all in Plat "A", Salt Lake City Survey, as the same are shown upon the official plats of said City to a depth of twenty-five (25) feet back from said street, and to collect said tax. SECTION 2. Said tax shall become and be delinquent in ten equal yearly installments, with interest on the whole sum unpaid at the rate of six per cent per annum, payable at the time each installment is due; to.wit: One-tenth thereof one year after the ordinance confirming the levy of the tax for the payment for such -3- improvement becomes effective; one-tenth thereof in two years afte, said ordinance becomes effective; one-tenth thereof in three years after said ordinance becomes effective; one-tenth thereof in four years after said ordinance becomes effective; one-tenth thereof in five years after said ordinance becomes effective; one-tenth there Of in six years after said ordinance becomes effective; one-tenth thereof in seven years after said ordinance becomes effective; one tenth thereof in eight years after said ordinance becomes effecti, one-tenth thereof in. nine years after said ordinance "becomes effective; and one-tenth thereof in ten years after-,said ordinance becomes effective. One or more of said installments, in the order in which they are payable, or the whole special tax, may be paid any time within thirty days after the ordinance confirming the le,N of the tax becomes effective, without interest. In the event of any installment or the interest aforesaid not being paid on the date the same becomes due, the whole amount of the special tax unpaid at the time said installment and interest are due, shall become due and payable, and shall draw interest at the rate of eight per cent per annum until the sale of the property assessed; provided, one or more installments, in the order in which they ar. payable, or the whole special tax unpaid, may be paid on the day any installment becomes due by paying the amount thereof and interest to said date. SECTION 3. This ordinance shall take effect one day after its first publication.
