Section 43-1-12, 43-1-14., 43-1-15, 43-1-16, 43-1-17, 43-].-16 of the Revised Ordinances of Salt Lake City, Utah, 1955, as amended by Bill No. 17.3 of 1960, relating to the taxicab drivers' licenses. Be it ordained by the Board of Commissioners of Salt Lake City, Utah. SECTION 1. That Sections 43-1-12, 43-1-14, 43-1-15, 43-2-16, 43-1-17, 43-1-18 of the Revised Ordinances of Salt Lake City, Utah, 1955, as amended by Bill No. 113 of 1960, be, and the same hereby are, amended to read as follows: Sec. 43-1-12. Application for driver's license. An application for a taxicab driver's license shall be filed with the License Assessor and Col- lector on forms provided by Salt Lake City. Before accepting; any application the License Assessor and Collector shall require the applicant to submit a copy of a completed police recom- mendation form as provided in Section 43-1-14, which form shall include the recommendation of the Chief of Police. The application shall be verified by the applicant under oath and he shall be required to swear to the truth- fulness of the matters contained upon the application and the police recom- mendation form. At the time the application is filed the applicant shall pay to the City Treasurer the sum of $2.00. Sec. 43-1-14.. Police investigation of applicant. Traffic and police report. The police department shall conduct an investigation of each pro- spective applicant for a taxicab driver's license and to aid such investi- gation, the prospective applicant will be required: (a) To fill out two police recommendation forms containing-the fol- lowing information: 1. The names and addresses of four residents of Salt Lake City who have known the prospective applicant for a period of 30 days and who will vouch for the sobriety, honesty and general good character of the applicant. 1,` 9 -2- 2. Experience of the prospective applicant in the transportation of passengers. 3. Education background of the prospective applicant. 4. A concise history of his employment. 5. Such other information as may be deemed necessary by the Chief of Police. (b) To file with the Chief of Police three (3) unmounted, un- retouched photographs of himself taken within 30 days next preceding, which photographs shall be 2 x 3 inches, black and white glossy finish; two photographs shall be attached to the police recommendation forms, the third shall be attached to the taxicab driver's license of the ap- plicant by the City Recorder; applicants for renewal of taxicab licenses will be required to furnish an up-to-date photograph as directed by the Chief of Police. (c) To file with the Chief of Police two sets fingerprint impres- sions which shall be taken under the supervision of the Chief of Police. (d) To file a certificate from a reputable physician of Salt Lake City certifying that, in his opinion, the applicant is not inflicted with any disease or infirmity that might make him an unsafe or unsatisfactory driver. Upon completion of the investigation, the Chief of Police shall recommend approval or disapproval of the proposed applicant to the Board of Commissioners on the police recommendation form. It shall be the duty of the Chief of Police to report in writing to the Board of Commissioners any misrepresentation or falsification by the prospective applicant on the police recommendation form which may be uncovered by the police investigation, and any such misrepresentation or falsification will constitute just cause for the Board of Commissioners to refuse to issue a taxicab driver's license or to suspend or revoke the same if it has been issued. Sec. 43-1-15. Consideration of application. The Board of Commis- sioners shall, upon consideration of the application and the police recom- mendation form required to be attached thereto, approve or reject the application. If the application is rejected, the applicant may request a personal appearance before the Board of Commissioners to offer evidence why his application should bo reconsidered. a.39 -3- Sec. 43-1-16. Issuance of license and badge. Duration. Annual Fee. Upon approval of an application for a taxicab driver's license, the Board of Commissioners shall issue a license to the applicant which shall bear the name, address, color, age, signature and photograph of the applicant. A taxi driver's badge shall be issued to each approved applicant. Such license shall be in effect for the remainder of the calendar year. A license for every calendar year thereafter shall issue upon the payment of $1.00 unless the license for the preceding year has been revoked. Sec. 43-1-17. Display of license and badge. Every driver licensed under this ordinance shall post his driver's license in such a place as to be in full view of all passengers while such driver is operating a taxicab. The taxicab badge issued by the Board of Commissioners must be displayed on outer garments of driver so as to be in full view at all times while engaging in his occupation .as a taxicab driver. Sec. 43-1-18. Suspension and revocation of license. The Board of Commissioners is hereby given the authority to suspend any driver's license issued u=der this ordinance for a driver's failing or refusing - to comply with the provisions of this ordinance, such suspension to last for a period of not more than 60 days. The Board of Commissioners is also given authority to revoke any driver's license for failure to comply with the provisions of this ordinance. However, a license may not be revoked unless the driver has been given notice and has had an opportunity to present evidence in his behalf. Notice of such proposed action shall be deemed to be sufficient if it is mailed to the address designated on the said driver's license at least seven days prior to the revocation. No driver whose license has been revoked shall again be licensed as a driver for licensed public vehicles in the City except upon presentation of reasons satisfactory to the Board of Commissioners. SECTION 2. In the opinion of the Board of Commissioners of Salt Lake City, Utah, it is necessary to the peace, health and safety of the inhabitants of Salt Lake City, Utah, that this ordinance become effective immediately. 1:39 -4- SECTION 3. This ordinance shall take effect upon its first publi- cati on.
