Thin ordinance is hereby declared to be enact— ed for the purpose of promoting the health, safety, morals, general welfare, preservation and promotion of the convenience, good order, proosperity, happiness qnd beat interests of the inhabitants of Salt Lake City and to encourage, facilitate and direct the orderly growth, development and expansion of said city. SECTION S. "Alley" -,A street not over twenty feet wide. 3. "Apartment House" - _l building or portion thereof used or intenlded to be used as the home of three or more families or householders living independently of each other. 4. 'established Grade" - The sidewalk gr&de at the front lot line as established by the City ':Engineer. 5. - Any number of individuals living together as a single housekeeping unit, and doing their cooking on the premises. 6. "Front Yard" - An open unoccupied space on the same lot with a building, between the front line of the building (exclusive of steps) and the front lot or street line. 7. "Height of building" - The vertical distance measured from the established grade to the mean roof line at the center of the building front. for buildings set back from the street 1 line the average level of the ground adjoining the building shall govern. 8. "Lot" - Land occupied or to be occupied by a building and its accessory buildings including such open spaces as are required under this ordinance, and having frontage upon a street or alley. 9. "One-family Dwelling" - A building arranged or de- signed to be occupied by not more than one family. lO: "Public Garage" - Any premises used for the storage) or housing of more than three steam or motor driven vehicles, or where such vehicles are repaired or kept for hire or sale. 11. "'?ear Yard" - An open unoccupied space on the same I lot with a building, between the rear line of the building 1 (exclusive of steps) and the rear line of the lot. 12. "Side Yard" - An open unoccupied space on the same 111 lot with a building, between the side wall line of the build- { ing and the side line of the same lot. 13. "Two -family Dwelling" - A building arranged or de- i signed to be occupied by two families. I r' SECTION 3. That in order to designate districts and reguIi- !late the location of dwellings, business, trades, industries and 'l the location of buildings erected or altered for specified uses, Salt Lake City is hereby divided into seven use districts to be known as: Residential "A" District; Residential "B" District; Residential "B-2" District; Residential "C" District; Commercial District; Industrial District; Unrestricted District; The boundaries of said districts, as shown upon the map attached hereto and made a part hereof, are hereby established, said map being designated as the "Use District Map", and said map and references, notations and other information shown thereon shall be as much a part of this ordinance as if the information and mat- ters set forth by said map were all fully described herein. Except as hereinafter provided, no building shall be erected or altered, nor shall any building or premises be used for' any purpose other than is permitted in the use district in which such building or premises is located. SECTION 4. residential "A" District. (a) In Residen- tial "A" District no building or premises shall be used, and no building shall be erected which is arranged, intended or designed to be used for other than one of the following uses: 1. One-family dwellings; 2. Two-family dwellings; 3. 5Rchools; 4. Churches; 5. Libraries and museums; 6. Parks, recreation grounds, play grounds, includ- ing usual park buildings. ... 7. Farming and truck gardening, nurseries and green- houses; provided that greenhouses shall be set back at least 60 feet from the front lot line. 8. Railroad or street railway passenger stations and �:1 -4- rights of way, not including railroad yards or sheds; 9. Public buildings, except penal or mental institu- tions. I 10. Cemeteries adjoining or in extension to existing cemeteries. 11. Telephone exchange where no public business office and no repair of storage facilities are maintained. ' I (b)', In a Residential "A" District buildings and uses, such as are ordinarily appurtenant to any of the uses listed above, ;hut not involving the conduct of business, shall be permitted, sub- ject to the limitations herein provided: 1. ,..coessory uses customarily incident to the above uses. 2. The office of a physician, musician, or other professional person, when located in his or her dwelling; also oustopary incidental home occupations engaged in by in- dividuals within their dwellings, provided that no window display is made. 3. A name plate not exceeding one and one half (12)� square feet in area. 4. A signboard not exceeding eight (8) square feet in area, appertaining to the lease or sale of the property; also a bulletin board not exceeding eight (8) square feet in area erected upon the premises of a church or other institu- tion for the purpose of displaying the name and activities or. services'therein, provided, when set back within two (2) feet of the building line. 5. Renting of rooms for lodging purposes only, or the furnishing of table board for not to exceed six (6) per- sons in a One-family dwelling. 6. Dormitories, fraternity or sorority houses or boarding houses occupied only by the faculty or students of a II public educational institution and supervised by the authori- ties thereof. -5- 7. R private garage that shall occupy not more tha 1 seven (7) per cent of the area of the lot, and shall be loca - i ed not less than sixty (60) feet from the front lot line, un- 11 less it is a part of the main building. I ' SECTION 5. Residential 'B" and "B-2" Districts. (a) In , residential "B" and "B-2" districts no building or premises shall be used, and no building shall be erected which is arranged, intend- ed or designed to be used for other than one of the following uses: 1. 1:ny use permitted in a Residential 'A" District; 2. All dwellings, flats, apartment and boarding or lodging houses without stores; 3. Hotels; 4. Clubs or fraternal societies, except those the I 1 chief activity of which is a service customarily carried on as a business; 5. Hospitals, sanitariums and institutions for philanthropic or eleemosynary uses, other than correctional or for insanity or other mental diseases; 6. An institution for subnormals when located not less than 600 feet from any dwelling or apartment house. 7. Public utility buildings, from which no noises, vibration, fumes or odors are emitted. 8. Outdoor advertising structures that otherwise comply with city ordinance. (b) Reeessory uses shall be as specified under a Aesiden- tial "A" District, Oection 4, paragraph (b), in conformity with Ilhe requirements governing such uses. In addition thereto, public garages may be maintained for storage purposes only, -where no repair facilities are provided, when located not less than 60 feet from the front lot line, and not less than 30 feet from any other street Dine on which the property faces; provided, that there shall be no . entrance or exit for motor vehicles within 150 feet of an entrance : or exit of a public school, church, playground or other public or I -6- semi-public institution; concessions and service shall also be perl- mitted as accesadries within hotels, etc., provided that access to such uses is only from within the building. SECTION 6. Residential "C" District. (a) In residential "C" District no building or premises shall be used, and no building shall be erected which is arranged, intended or designed to be used for other than one of the following uses:6 1. Any use permitted in Residential "A", "3" or "B-2" Districts; 2. Shops for retail business; 3. Drug stores; 4. Banks, fire or police stations, theatres; 5. Lunch rooms and restaurants; 6. Shoe repair shops; 7'. Barber y parlors; sho s and beaut p 8. Public garages; 9. Gasoline service stations. (b) Public garages and gasoline service stations shall not be permitted within 100 feet of any dwelling or apartment house. TIseii in this district shall be subject to front yard provisions required in adjoining residential areas. SECTION 7. Commercial Dis.trict.(a) All buildings and premises may be used for any purpose permitted in Residential "A", "B", "B-2" and '0" Districts and also for any trade, industry or use except the following which are hereby prohibited, subject to provisions of Sec. 14 of this, ordinance and of paragraph (b) hereunder: 1. Any trade or use prohibited in an Industrial District. 2. Acid manufacture. 3. Bag cleaning; 4. Boiler works; 5. Breweries or distilleries; I I i ip: -7 = - 6. Brick, tile or terra cotta manufacture or storage, except storage wit hin a building. 7. Celluloid or similar manufacture; 8. Charcoal manufacture or pulverizing; 1 9. Chemicals manufacture of objectionable or dan- gerous nature; 10. uontraotor's plant or storage, except where set back at least 100 feet; 11. Coal tar products manufacture. 12. Dog pound. 13. Jiyestuffs manufacture. 14. Electrical central station power plant. 15. 'Emery cloth or sand paper manufacture. 16. Enameling; 17. Exelsior fibre manufacture. 18. Exterminators or insect poisons manufacture. 19. Feed or cereal mill using power in excess of 50 HP. 20. Fish smoking and curing. 21. Flour mill. 22. Foundries. 2.3. Forge plant. 24. Glass or glass products manufacture. 25. Glucose manufacture. 26. Ice manufacturing plant or storage, except the manufacture by electricity. 27. Japanning. 28. Junk, rags, etc. storage. 29. Lamp black manufacture. 30. Lubricating grease or oil compounding. 31. Lumber or shingle mills using more than 50 HP. 32. Machinery manufacture. 33 Machine shop using in excess of 50 HP. 34. (b) Stables, lumber yards, fuel yards, dyeing and clean- ing establishments, public garage, mortuary, milk distributing I I stations or food products manufacturing, shall not be permitted in Commercial Districts within 100 feet of dwelling or apartment house. SECTION 8. Industrial District. (a) In an Industrial (District all buildings and premises may be used for any purpose permitted in i-tesidential "A", "B", "B-2" and "0" and Commercial Districts, and also for any other trade, industry or use except the following, which are prohibited, subject to provisions of Section 14 of this ordinance: 1. Lmmonia, bleaching powder or chlorine manufeictu*e. 2. Asphalt manufacture or refining. 3. Arsenals. 4. .,last furnaces. 5. Cement, lime or plaster-of-paris manufacture. 6. Coke ovens. 7. Crematory other than a crematory located in a cemetery. 8. Creosote treatment or manufacture. 9. Disinfectant and insecticide manufacture. 10. Distillation of bones,: coal or wood. 11. Fat rendering. 12. Fertilizer manufacture except the cold com- pounding of non-odorous materials. 13. 'fireworks, explosive manufacture and storage. 41' -10- i 14. Gas manufacture or storage in excess of 10,000 cubic feet. 15. Gelatine, glue or size manufacture. 16. Grease or tallow manufacture or refining. 17. Hair factory. 18. Hydrochloric, nitric, sulphuric or sulphurous acid manufacture. 19. Incineration or reduction of garbage, offal or refuse. 20. Petroleum refining or storage in excess of 100,000 gallons. 21. Potash manufacture or refining. 22. Raw hides or skins, storage, curing or tanning. 23. Rubber manufacture from the crude material. 24. Slaughter houses. 25. Smelting of iron, copper, zinc or tin ores. 26. Stock yards. 27. Sugar refining. 28. Tannery. 29. Tar distillation or manufacture. 30. Tar roofing or tar waterproofing manufacture. 31. Wool pulling, scouring, or shoddy manufacture. 1 32. .any other trade, industry or use that is noxious or offensive by reason of the emission of odor, smoke, gas,vibration or noise. SECTION 9. Unrestricted Districts. (a) In an unrestrict- ed district all buildings and premises may be used for any lawful purpose except those which by ordinance are excluded from within the city limits. (b) Any uses prohibited in Section 8 (Industrial Dis- trict) that are to be undertaken in this district shall be located at least. 660 feet distant from the boundary line of any Residen- tial "A", "BFF, mB-2", "0" or Commercial District. SECTION 10. Eront Yards. In all residential districts no part of any building (exclusive of steps) shall be erected 1 -11- nearer to the,' property line on which it faces than 15 feet, unless adjacent existing structures are nearer to the front property line than 15 feet, the then average alignment of such structures shall govern. One street frontage only of a corner lot shall be exempt from these provisions, except that in such event the build- ing on that side shall be set back not less than 10 feet. In a district where the street widths are less than 100 feet no wall, fence or other structure shall be erected and no hedge, shrub, tree or other growth shall be maintained in such location as to cause danger to traffic by obstructing the view. Where a resi- dential district and a commercial district adjoin each other, within the same block, the front and side yard. regulations shall j apply to the commercial district as well as the residential district, on the residential street. SECTION 11. Side Yards. In all residential "A", "B" and "B-2" districts, for every building erected, there shall be a side yard aldng each lot line. The least dimension of any such side yard shall be 35% of the building height, but in no case lessi than 8 feet for residential "A'T, 30% of the building height, but in no case loss than 6 feet, for residential "B" and 25% of build- ing height but in no case less than 4 feet for residential `B»2", � and the total width of the tvn side yards for any one lot c all be 70% of the building height, but in no case less than 20 feet for residential "A", 60% of the building height, but in no case less than 17 feet for residential "B" and 50% of the building height, but in no case less than 14 feet for residential "B-2". In all residential "C" districts side yards are not re- quired, except that whenever the boundary line of a residential I "C" district forms a common boundary with a residential "A", "B" or "B-2" district then a side yard of a width equal to that re- quired for maximum side yards in the adjoining district shall be Iregairedi on that side adjacent to the common boundary. ii I �lla- 51"iCTIOP 12. Rear Yards. In all residential districts there shall be a rear yard of not less than 25 feet, provided, however, that not more than 40 per cent of the area of the rear yard may be occupied by a one—story accessory building not over 15 feet in height. SECTION 13. Side and Rear Yard Exceptions. (a) The are . of a side or rear yard shall be open and unobstructed except for the ordinary projections of window sills, belt courses, cornises and other ornamental features to the extent of not more than 4 inches, except that where the building is not more than two stc'ies in height the cornice or eaves may project not more than two feet into snob yard. I i it GI (b) An open fron fire escape may project not more than four feet into a side or rear yard. Cc) Where a rear yard or a side yard in a residential district abuts on en alley or permanent open way the yard shall be deemed to extend to the center of such alley or way. (d) In all 'ruse" districts there shall be maintained a side yard and a rear yard for all apartment houses, tenement houses, and hotels as provided in this ordinance and also such 'other yards or courts as provided for in sections 519, 520 and 522, Article XV, Revised Ordinances of Salt Lake City for 1920. (e) On any lot held under a separate ownership from ad- jacent lots, and of record at the time of the passage of this ordinance, the side yard requirements may be waived to the extent, that the buildable width of such lot is not reduced to less than 25 feet, excoot that at least a three foot side yard is recp ired on both sides of all lots. SECTION 14. Non-Conforming Use. bny use of buildings or premises at the.time of the passage of this ordinance may be con- tinued, although such use does not conform to the provisions here- of. In the case of a building such use may be extended throughout the building, provided that no structural alterations are made therein, except those required by law or ordinance. Providing no) structural alterations are made, a non-conforming use may be chang- ed to any use permitted in a district where such non-conforming use would be permitted. zany non-conforming use changed to a more, restricted use or to a conforming use, shall not thereafter be changed back to a less restricted use. No non-conforming building which has been damaged by fire, explosion, act of God, or act of the public enemy to the extent of more than sixty per cent of its assessed value, shall be restored;except in conformity with the regulations of this ordinance. Any non-conforming use building, existing in any resi- dential district at the time of the passage of this ordinance, may ii -14- cornice for ornament and without windows, extending above such height limit not more than 5 feet. (e) Any portion of a building may be erected to a height in excess of the respective haight limits as herein prescribed provided such portion of such building is set back from all street, alley and required yard lines, I foot for each 3 feet of such additional height if in an industrial or commercial district, and 1 foot for each 2 feet of such addi- tional height if in a residential district. SECTION 16. Area Regulations. For buildings hereafter erected or altered to accommodate or make provision for additional families the required lot area per family housed shall be as follows; Residential "4" District. 6000 sq. ft, for a one family dwelling. 9000 " " " " two " Residential "B" District 4300 sq. ft. for a one family dwelling. 6500 sq. ft. for a two family dwelling. 8000 sq. ft. for a threefamily dwelling, with �n additional 1500 sq. ft. required for each family added. Residential "B-2" District 3000 sq. ft. for a one family dwelling. 4500 sq. ft. for a two family dwelling 5000 sq. ft. for a three family dwelling, with an additional 500 sq. ft. required for each family added. Residential "tF", Commercial 8o Industrial Districts 4000 sq. ft. for a one family dwelling 3500 sq. ft. for a two family dwelling, with an additional 500 sq. ft. required for each family added. Provided that in any district a single family dwelling may be erected on any lot held in separate ownership at the time the passage of this ordinance. _'_ lot less than 120 ft. in depth, ex- tending to a rear alley shall be deemed to extend to the center of suoh alley in computing its area for the purpose of this section. for the purpose of this section the number of families which a I i0- I be reconstructed or replaced to conform with all requirements for a Residential "C" district, including all required yard spaces. SECTION 15. Height Regulations - General. (a) No dwell- ing or hotel, unless of fireproof construction, shall be erected to a height of more than four (4) stories. A basement designed 1 for the occupancy of one or more families other than that of the 1 [janitor or caretaker shall be deemed a story for the purpose of [this section. (b) Residential Districts. In a Residential "A" dis- trict no dwelling shall be erected to a height in excess of 35 1 feet and no building shall be erected to a height in excess of 50 feet. In a Residential "B" District no building shall be erect- ed to a height in excess of forty-five (45) feet. In a residential 93-2" district no building shall be erected to a height in excess of fifty-five (55) feet. In a Residential "C" district no building shall be erect- ed to a height in excess of 65 (Sixty five) feet, and no garage building shall be erected to a height in excess of one story. (c) Commercial District. In a commercial district no building shall be erected to a height in excess of 14 times the width of street on which it fronts. Where a building fronts on two or more streets, the [greater height of building permitted on the wider street shall apply within a distance of 120 feet from such street. (d) Industrial and Unrestricted Districts. In an indus- trial or an unrestricted district, no building other than a grain elevator or a gas holder shall be erected to a height in excess of '80 feet. (e) Exceptions. (a) The provisions of this section shall not apply to restrict the height of a church spire, tower or bel- fry, or a flagpole, wireless tower, monument, chimney, water tank, elevator bulkhead, stage tower or scenery loft. (b) Nothing in these regulations shall apply to pre- vent the erection above the height limit of a parapet wall or ;11 -15- building is designed to accommodate shall be determined by the nu - ber of separate housekeeping units in such building. A suite of rooms without a kitchen or facilities for cooking meals shall not be deemed a housekeeping unit for the purpose of this section. SECTION 17. Plats. 1�11 applications for building per- mits shall be accompanied by a plat in duplicate drawn to scale, showing the actual dimensions of the lot to be built upon, the size and location of the existing buildings and buildings to be erected, and such other information as may be necessary to pro- vide for the enforcement of this ordinance. 2. careful record of such application and plats shall be kept in the office of the Building Inspector. No yard or other open space provided about any building for the purpose of complying with the provisions of these regulations shall be used as a yard or open space for another building. SECTION 18. Interpretation and Application. In inter- preting and applying the provisions of this ordinance they shall be held to be the minimum requirement for the promotion of the pu - lie health, safety, order, convenience, prosperity and general welfare. It is not intended by this ordinance to interfere with or abrogate or annul any easement, covenants or other agreements between parties, provided, however, that where this ordinance im- poses a greater restriction upon the use of building or premises or upon height of building, or requires larger open spaces than are imposed or required by other laws, ordinance or restrictions, the provisions of this ordinance shall control. SECTION 19. Violation and Penalty. Any person convicted of violating or refusing to comply with any of the provisions of this ordinance shall be punished by fine in any sum not exceeding Two Hundred Ninety-nine'(u299.00) Dollars, or by imprisonment in the city jail for a period of not longer than six months, or by both such fine an imprisonment, The court may in imposing a fine enter as part of the judenent that in default of the payment of the fine the violator may be imprisoned in the city jail for a period not exceeding six months. iach day a violation is permit- ted to exist shall constitute a separate offense. 1q 7y -1g- i SECal1ON 20. boundaries of Districts dhere uncertainty !exists with respect to the boundaries of the various districts hereby established and as shown on the maps made a part of this ordinance the ,following rules shall apply: (1) The district boundaries are either center lines of streets or alleys, unless otherwise shown, and where • the designation on the maps accompanying and made a part of this ordinance indicating the various districts are approximately bounded by street or alley lines, said center lines of streets or alleys shall be con- strued to be the boundary of such district. (2.) Where the district boundaries are not otherwise indicated and where the land has been or may hereafter be divided into lots or blocks and lots, the district boundaries shall be construed to be Iot lines and where the designations on the maps accompanying and made a part of this ordinance indicating the various districts are approximately bounded by lot lines the nearest lot line shall be construed to be the ,boundary of such dis- trict. C3) Where land has not been subdivided into lots or blocks and lots the district boundary lines on the maps accompanying and made a part of this ordinance shall be determined by the use of the scale of measurement shown on such maps. SECTION 21. Validity. Should any section, clause, or • provision of this ordinance be declared by the courts to be in- Ivalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid;. _— — SEC4.ION 22.
