Shearman Q Wells cN-4 \ ✓ A Mr.Chairman Result AN ORDINANCE An ordinance levying a tax end for the assessment of property on Ninth South Street between Ninth East and Eleventh East Streets, and on Eleventh East Street between Ninth South Street and Yale Avenue, in Paving Districts Nos. 31 and 32, and in Paving Extension No. 91, for the purpose of providing for the grading, guttering and curbing, constructing drainage and irrigation systems, and paving thereof. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Paving Districts Nos. 31 and 32, for the purpose of providing for the grading, guttering and curbing, constructing drainage and irrigation systems, and paving thereof, to-wit: In Lots 13 to 23, inclusive, Block 16; 24, Block 8, Fremont Heights Subdivision of Block 4; 2, Block 4, Plat "F"; 1 and 2, Block 1; 1 and 2, Block 2, roodmansee Subdivision of Block 1, Plat "B", Salt Lake City Survey; 21 to 31, inclusive, Block 2; 18 to 28, in- clusive, Block 1, Gilmer Square Subdivision, Block 17-A; 9, 10 and 11, Block 17-A, Five Acre Plat "A", Big Field Survey, abutting on the north side of Ninth South Street between Ninth East and Eleventh East Streets, and on the east side of Eleventh East Street between Ninth South Street and Yale Avenue. -1- 14,2 This tex is levied to defray the expense of grading, gutter- ing and curbing with cement, constructing drainage and irrigation system from four (4) inches to fifteen (15) inches in diameter, o' cement, vitrified, corrugated iron and wrought iron pipe, and pav ing with Utah rook asphalt a roadway (said roadway 4e-e6- sixty (60) feet wide between curbs and eight (8) inches thick) on Ninth South Street betweenrinth East and Eleventh East Streets; and grading, guttering and curbing with cement, constructing drainage and irrigation system from four (4) inohos to fifteen (15) inches in diameter, of cement, vitrified, corrugated iron and wrought iron pipe, and paving with bitulithio pavement a roadway (said roadway forty-four (44) feet wide between curbs and six (6) inches thick on Eleventh East Street between Ninth South Street and Yale Avenue, the portions of said streets opposite the prop- erty hereinbefore and hereinafter described to be especially affected and benefited by said improvement, and it is hereby ad- judged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portions of said streets fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is fourteen thousand five hundred sixty-nine and 90/100 ($14,569.90) dollars; fifty- nine hundred eighty-three and 15/100 (45983.15) dollars, or four and 70/100 (44.70) dollars perfront or linear foot of abutting property for forty-four (44) foot roadway,Athere being 1273.01 feet abutting said portion of said improvement; seventy-seven hundred eighty-eight end 75/100 ($7788.75) dollars, or six and 70/100 ($6.70) dollars per front or linear foot of abutting property for sixty (60) foot roadway with car tracks, there bein: 1162.50 feet abutting said portion of said improvement; and -2- seven hundred ninety-eight 0798.00) dollars, or five and 70/100 05.70) dollars per front or linear foot of abutting property for sixty (60) foot roadway with car tracks (curb and gutter built) , there being 140 feet abutting said portion of said improvement, within the boundaries of the lots, blocks and streets above men- ' tioned in said district, which is the total cost and cost per front foot of said improvement, according to the contract entered into for the performance of said work and making said imrovement, with Ctx:n e-Maguire Paving Company, dated the 9th day of October, 1913, and the Treasurer is hereby authorized end directed to assess, in accordance with the provisions of this ordinance, for the purpose herein mentioned: Forty-Four Foot Roadway. (With Car Tracks) The west side of Lots 21 to 31, inclusive, Block 2; the west side of Lots 18 to 28, inclusive, Block 1, Gilmer Square Subdivision of Block 17-A; the west side of Lots 10 and 11, end the west side of the north 136.38 feet of Lot 9, Block 17-A, Five Acre Plat "A", Big Field Survey. Sixty Foot Roadway. (With Car Tracks) The south side of Lots 13 to 23, inclusive, Block 16; the south side of Lot 24, Block 8, Fremont H eights Subdivision of Block 4; the south side of the west 294.7 feet of Lot 2, Block 4, Plat "F"; the south side of Lots 1 and 2, Block 1; the south side of Lot 1, Block 2, T'oodmensee Subdivision of Block 1, Plat "B"; 1, commencing at the southeast corner of Lot 1, Block g, VToodmansee Subdivision of Block 1, Plat "B", thence east 82.5 feet, all in Salt Lake City Survey. Sixty Foot Roadway. (With Car Tracks; Curb & Gutter Bu'lt) The south side of Lot 2, Block 2, Woodmansee Subdivision of Block 1, Plet "B", Salt Lake City Survey, as the same are shown upon the official plats of said city to a depth of twenty-five (25) feet back from said streets, and to collect said tax. -3- SECTION 2. Said tax shall become and be delinquent in ten equal yearly installments, with interest on the whole sum unpaid at the rate of six per cent per e.nnum, payable at the time each installment is due, to-wit: One-tenth thereof one year after the ordinance ootfirming the levy of the tax for the payment for such improvement becomes effective; one-tenth thereof in two years after said ordinance becomes effective; one-tenth thereof in three years after said ordinance becomes effective; one-tenth thereof i• four years after said ordinance becomes effective; one-tenth there of in five years after said ordinance becomes effective; one-tent. thereof in six years after said ordinance becomes effective; one- tenth thereof in seven years after said ordinance becomes effeoti e; one-tenth thereof in eight years after said ordinance becomes effective; one-tenth thereof in nine years after said ordinance becomes effective; and one-tenth thereof in ten years after said ordinance becomes effective. One or more installments, in the order in which they are payable, or the whole special tax, may be paid at any time within thirty days after the ordinance confirmin: the levy of the tax becomes effective, without interest. In the event of any installment, or the interest aforesaid, not being pa d on the date the same becomes due, the whole amount of the special tax unpaid at the time said installment and interest are due, shall become due and payable, and shall draw interest at the rate of eight per cent per annum until the sale of the property assess=d; provided, one or more installments, in the order in which they ar payable, or the whole special tax unpaid, may be paid on the day the same becomes due, by paying the amount thereof and interest to said date.
