149 of 1910 - Ordinance 149 of 1910 – Sewer Extension No. 220, Seventh Partial Estimate. X AN ORDINANCE . An ordinance levying a tax and for the assessment of property in the territory included between South Temple and Ninth South Streets, and from the Intercepting Sewer east to Second West Street, in. Sewer District No. 2, for the construction of sewers. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the City Council does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Sewer District No. 2, for the construction of sewers, to-wit: In Lots 5 and 6, Block 43; 1, 4, 5, 6, 7 and 8, Block 26; 2, 3, 'i4, 5 and 6, Block 25; 1, 2, 3, 4, 5, 6, 7 and 8, Block 30; 1, 2, 3, ' 4 and 5, Block 29; 4, 5, 6, 7 and B, Block 44, all in Plat "A", abut- ting en the south side of Fourth South Street between Second West and, Fourth West Streets; on the west side of Third West Street between Sixth South and Seventh South Streets; pn the east side of Third West Street between Fifth South and Seventh South Streets; on both sides of Sixth South Street between Second West and Fourth West Streets; on the east side of Fourth West Street between Fourth South and Seventh South Streets; and on the south side of Fifth South Street between Second West and Third iciest Streets. This tax is levied to defray the expense of constructing vitri- fied pipe sewers six (6), eight (B), ten (10), twelve (12) and six- teen (16) inches in diameter upon the portions of said streets oppo- site the property hereinbefore and hereinafter described to be especi- ally affected and benefited by said improvement, and it is hereby ad- Judged, determined and established that said property will be especi- ally benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portions of said streets fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is eighteen thousand six hundred sixty-four and -2- 79/100 (418,664.79) dollars, or two and 2678958/10,000,000 (42.2678958) dollars per front or linear foot of abutting property for sewer on side of streets, there being 8230 feet of abutting prop erty within the boundaries of the lots, blocks and streets above men- tioned in said district, which is the total cost and cost per front foot of said sewer, according to the contract entered into for the performance of said work and making said improvement, with James Kennedy Construction Company, dated February 7, 1910, and the Treasurer is hereby authorized and directed to assess in accordance with the provisions of this ordinance for the purpose herein mentioned: Sewer on Side of Streets. The east 305 feet of the north side of Lot 5, the west 305 feet of the north side of Lot 6, Block 43; the east side of Lots 1 and 8, k 'Block 26; the west side of Lots 2, 3, 4 and 5, the east 305 feet of the north side of Lot 5, the west 305 feet of the north side of Lot 6, Block 25; the east 140 feet of the south side of Lot 4, the west 140 1feet of the south side of Lot 1, the south side of Lots 2 and 3, the west side of Lots 4 and 5, Block 30; the west side of Lots 4 and 5, Block 26; the east 140 feet of the north side of Lot 5, the west 140 • feet of the north side of Lot 8, the north side of Lots 6 and 7, Block 30; the west side of Lots 2, 3, 4 and 5, Block 29; the east 140 feet of the north side of Lot 5, the west 140 feet of the north side of Lot 8, the north side of Lots 6 and 7, Block 26; the west 305 feet of. the south side of Lot 2, the west 305 feet of the south side of Lot 1, Block 29; the west side of Lots 4 and 5, the east 140 feet of the north side of Lot 5, the north side of Lots 6 and 7, the west 140 feet of the north side of Lot 8, Block 44, all in Plat "A", Salt Lske City Survey, as the same are shown upon the official plats of said city to a depth of twenty-five (25) feet back from said Streets, and to col- lect said tax. SECTION 2. Said tax shall become and be delinquent in five equal ,yearly installments, with interest on the whole cam unpaid at the rate of six per cent per annum, payable et the time each installment is duo, -3- to wit: One-fifth thereof one year after the approval of the ordi- nance confirming the levy of the tax for the payment for such improve- ment; one-fifth thereof in two years after such approval; one-fifth 'thereof in three years after such approval; one-fifth thereof in four 'years after such approval; and one»fifth thereof in rive years after such approval. One or more of said installments, in the order in which they are payable, or the whole special tax may be paid at any time within thirty days after the approval of the ordinance confirming the, levy of the tax, without interest. In the event of any installment or the interest aforesaid not being paid on the date the same beoomee due, the whole amount of the speoial tax unpaid at the time said in- stallment and interest are due, shall become due and payable, and 'shall draw interest at the rate of eight per cent per annum until the sale of the property assessed; provided, one or more installments, ,the order in which they are payable, or the whole special tax unpaid !may be paid on the day any installment becomes due, by paying the amount thereof and interest to said date. SECTION 3. This ordinance shall take effect upon approval. Sewer Extension No. 220.
