AN ORDINANCE PROVIDING FOR AND ORDERING A SPECIAL ELECTION, submitting
Ito the qualified tax paying electors of Salt Lake City, Utah, at such special
election, the question of incurring a bonded indebtedness in the amount of
$2,000,000.00 for the purpose of supplying said city with water and extending
land perfecting the present water supply and waterworks system of Salt Lake City,
Utah, the said water, water rights and waterworks to be owned-and controlled by
Salt Lake City.
WHEREAS, there is immediate and pressing necessity for increasing,
lextending and perfecting the present water supply a d waterworks system of Salt
!Lake City for the purpose of supplying and distributing water to the inhabitants

thereof for fire and domestic purposes, and
WHEREAS, said city is without funds in its treasury sufficient to pro-

(5%) per annum, payable as shall hereafter be determined by said city by
Ordinance.
Section 3. That the said additional water and waterworks system
acquired and constructed with the proceeds of said bonds shall be owned and
controlled by said city.
Section 4. That the question so submitted shall be voted on at the
said election by the voters qualified as aforesaid at the respective polling
i places in the respective voting districts and wards of said city designated
as hereinafter provided by the City Recorder of said city upon the approval
thereof by the Board of Commissioners of said city. The vote shall be by
ballot on the form hereinafter provided, and said election shall be held and
conducted in all respects as nearly as possible, in conformity with the general
1 election laws of the State.
Section 5. The ballots to be used in voting upon the question above
submitted shall be prepared and furnished by the City Recorder to the judges of
election, to be by them furnished to the voters and shall be in substantially

Section 7. The City Recorder is hereby directed forthwith to proceed

in each municipal ward in Salt Lake City, with the exception of the first
municipal ward in which not more than ten suitable p polling places shall be
!!selected, and make contract for the same; also to select and submit to the Board
Hof Commissioners for appointment a list of names of at least three suitable per-
( sons of prover political belief for each voting plane to act as judges of elec-
ition therein, each of said persona to be a resident of one of the voting districts
in the municipal ward in which he is to act as judge. The City Recorder is direct-
ed to make report to the Board of Commissioners for approval of all acts afore-

Section B. The City Recorder is hereby instructed to secure copies of
registration books, sample ballots, notices of election, stationery, tables,
;chairs and such other things as may be necessary for such election for each
! voting place, and is hereby instructed to incur the expense for so doing and to i
11employ the necessary help for holding said election in accordance with the
j{provisions of law.
Section 9. The vote cast at said election on the question submitted

' a copy of such notice in at least five conspicuous places within his district,
all of whoch notices shall be so posted at least ten days prior to the said

a special election will be held at the respective polling places hereafter to
be designated in each ward in said city, on :'iednesdoy , the _1st,

At such election there will be submitted to a vote of such qualified

Salt Lake City Water Revenue Bond.

Salt Lake City, in the County of Salt Lake, in the State of Utah,
for value received, hereby promises to pay to the bearer hereof, out of the
special fund herein designated, the sum of One Thousand Dollars, (41,000.00)
in lawful money of the United States of America, on the first day of
A. D. 19 , with interest theronfrom date until payment at the rate of
four and one-half per centum per annum, payable semi-annually, on the first
day of Novermber and the first day of May in each year, both principal and
interest being payableaat the Irving Trust Company, in the City of New York,
U. S. A., or at the office of the First Security Trust Company, in Salt Lake
City, Utah, at the opetion of the holder, upon presentation and surrender of
this bond or the respective annexed coupons as they severally become due.
This bond is issued in payment for improvements and exyensione to,
and additionalw ater and water rights for the municipal waterworks system
owned, operated and controlled by the city, based upon claims against the city
duly presented, audited and allowed, the city hereby acknowledging receipt of
property, laborer material in an amount equal to or in exeess of the principal
of this bond.
This bond is payable solely out of a special fund designated
"Water Revenue Bond Sinking Fund," created by the city and consisting of
income derived from the operation of its waterworks; and it is hereby
warrantedthat for the payment of this bond, Salt Lake City, will maintain
aaid fund, deposit therein all receipts derived from each system and,
out of such receipts and as an irrevocable charge thereon, will pay this bond
and the interest accruing thereon, in the manner provided by the ordinance
under abidathis bond is issued.
It is further certified, recited and warranted that the city has not
pledged, hypothecated or anticipated in any way, any of the revenues derived er•
to be derived from the operation of its waterworks system, other than by the
issuance of the series of water revenue bonds, of which this bond is a part.
And it is further certified, recited and warranted that all acts,
conditions and things required to be done, to have hapi•ened or to exist,
precedent to and in the issuance of this bond, have been legally and
properly done, have hapaened and been performed and do exist in regular and die
time, form and manner as required by law, and in full and strict compliaice
with the constitution and lows of the State of Utah, and that the obligation
hereby created exceeds no limitation imposed by law.

signed by its Mayor and Treasurer, and has caused the seal of the city to be

Section S. That said bonds shall be delivered in payment for
said improvements, extensions, water and water rights, after elaiae therefor

of said bonds by the city shall constitute a warranty by and on behalf of the
city for the benefit of each and every holder of any of said bonds, that said
bonds have been issued for a valuable consideration in full conformity with
law.
Section 7. -That there is hereby established and created a fund
to be known and maintained as 'Tfater Revenue Sand Sinking hand," into which
fund the city shall pleas all water revenues from all sources. Salt Lake
City hereby irrevocably covenants and agrees with eaab and every holder of
said revenue bonds, issued under the provisions of this ordinaneei
A. That it will, through the appropriate notion of its City
Commissioners, establish and enforce a schedule of water charges, sufficient
at all times punctually to per the interest accruing on said bonds, to dis-
charge the principal thereof at maturity, and sufficient to ply all operating,
maintenance and depreciation charges and expenses, all in accordance with
such approved methods of operation and aecountiug as are usually applied
in the operation of similar utilities by public and private corporations.
B. That during the time any of said revenue bonds are outstand-
.g theoity will pay into said fund, for all water furnished the city for
•lic or municipal purposes, a sum not lees than that charged private
onsumers for equal or similar supply or servioe.
C. That the Tinter Revenue Bond Sinking haul hereby established

(a) During the month of Vey, 1951, and each and every month
hereafter so long as easy of said Water Revenue Bonds or the interest thereon
shall remain unpaid, there shall be set aside and there is irrevocably

. not less than one-sixth of the semi-annual interest and not lees than

ater Revenue Bonds, except that from May to October, inclusive, 1941, the

of principal shall be not lose they ewe—sixth in each of said months. Such
amounts shall be included in the annual budget and appropriation ordinances
of the City and shall be devoted to the payment of interest accruing upon
said bonds end the principal thereof when the same become due.
(b) There shall next be paid from said fund the necessary coats
and expenses of the efficient and economic operation of said water system.
(c) Any balance thereafter remaining in said fend my be disposed
of as directed by the City Commission.
Section 8. If it should ever be legally determined that any
legislative or any other body or commission has power lawfully to prescribe
a lower schedule of rates than that contemplated by this ordinance, and if
such lower rates should be proscribed, then the payment of the interest upon
and the principal of the water revenue bonds issued pursuant to the provi—
sions of this ordinance, shall constitute a first charge upon the revenue
received from said system, anything in this ordinance contained to the
contrary notwithstanding.
Section 9. In the event the city shall be in default in any
of the payments required by this ordinance, and such default shall continue
for a period of thirty days, the city shall appoint a manager of said water
gratem, who shall be satisfactory to First Security Compeer, of Salt Lake
City, Utah, and whose salary and expenses incurred iu such meT' gement shall
be a first and prior lien on and against the revenues of the system. Said
manager shall have full control over seed system, aubjeet.:only to the control
of the City Commissioners, end he shall enforce such raten and charges
fixed by the City Commissioners as will be sufficient to make the payments
required by this ordinance. If under such management all defaults are
remedied and the payments required herein are promptly made for a period of
six months, the city shall have the privilege of changing such management,
with or nithout the consent of acid First Security Company, but if there
shall be any subsequent default, the conditions set forth in this section ee
shall again prevail.

Section 10. The city shall not sell or agree to sell said
waterworks system unless and until arrangements are made satisfactory to
said First Security Company for the payment of the principal and interest
of any of said revenue bonds which may be outstanding at that time.
Section 11. A11 ordinances, or parts thereof, in conflict with
this ordinance, are hereby repealed.
Section 12. After amid bonds have been issued this ordinance
shall be irrepealable until said bonds and the interest thereon shell
be fully paid, satisfied and discharged in the manner herein provided.
Section lb. This ordinance, after its passage, shall be recorded
in the city book of ordinances kept for that purpose, authenticated by
the signatures of the Mayor and Recorder, and shall be published

Section 14. By reason of the fact that a water shortage is
imminent and said city and its inhabitants are not properly or adequately
supplied with water, it is hereby declared that an emergency exists and
in the opinion of theBoard of Commissioners it is necessary to the immediate
preservation of the peace, health and safety of the inhabitants of Salt Lake
City that this ordinance shall take effect immediately.
Section 15. This ordinance shall take effect at once upon its
first publication.
