Abercrombie, as Receiver for the Salt Lake & Utah Railroad Company, his successors and assigns, a franchise and right of way for the construction and operation of an electric railroad upon and over a certain street in Salt Lake City, Utah. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF SALT LAKE CITY, UPAH: Section 1. A franchise and right-of-wayy is hereby given and granted to D. P. Abercrombie, as Receiver for the Salt Lake & Utah Railroad Company, a corporation organized under and by virtue of the laws of the State of Maine, his successors and assigns, to lay, construct, maintain and operate a single track, standard gauge railroad to be operated by electricity transmitting power for the transportation of passengers, freight, express and mail matter and to erect and maintain all necessary poles carry- ing telephone, telegraph, trolley, power and transmission wires necessary to the operation of such railroad in, upon and across 13th South Street in Salt Lake City, Utah, substantially as rz" follows: Beginning at a point on the south line of 13th South Street, Salt Lake City, Utah, said point being South 49.0 feet and East 77.24 feet from the City Monument at the intersection of 13th South and First West Streets; thence northeasterly, along the line of a curve to the right, having a radius of two hundred forty and forty-nine one- hundredths (240.49) feet, a distance of 73.0 feet, to a point on the North line of 13th South Street, said point being 17.0 feet North and 108.19 feet East from the said City monument at the intersection of 13th.South and First West Streets. Section 2. This franchise is supplemental to and granted subject to the terms and conditions, so far as applicable, of that certain ordinance passed by the Board of Commissioners of Salt Lake City, August 28th, 1912, entitled: "An Ordinance granting to W. W. Armstrong, W. R. Wallace, A. J. Evans, D. R. Beebe, I. B. Keeler, J. S. McBeth¢¢(and Geo. C. Whitmore, Trustees, y2. 4 Y a franchise and right-of-way for the construction and operation of an electric railroad upon and over certain streets of the City of Salt Lake", as the same was thereafter duly accepted by said Trustees and, with the consent of Salt Lake City, by them assigned and transferred to said Salt Lake & Utah Railroad Company, as amended; provided, however, that if for a period of nine con- secutive months during the life of this franchise, said spur tracks are not used for the purpose for which this franchise is granted, or if there is a substantial abandonment of the use of said spur tracks for said purposes, said franchise shall be voidable at the option of the Board of Commissioners; and if so ordered by the Board of Commissioners, said spur tracks shall within thirty days thereafter be removed and the street restored to a condition uniform with the balance of said street with respect to grade, materials and construction, and to the satisfaction of the Dowd of Commissioners. In the event of the failure of said railroad company to remove said tracks and restore said street upon such action, and within said thirty days, the said work may be done by Salt Lake City at the expense of the railroad company. Section 3. If the grant of this fray hire be not accepted in writing by the Grantee within sixty days after this Ordinance becomes effective, or if the construction of said railroad be not commenced within six months after this franchise is accepted, or if the work of construction of said railroad track be not prose- cuted with diligence, or if the construction of said railroad track be not completed within one year after this Ordinance is accepted, or if said Grantee, its successors or assigns, shall fail or refuse to comply with any of the conditions, provisions, agreements or obligations of this grant, or to perform any of the conditions or obligations imposed upon it, then this franchise shall be null and void. Section 4. This franchise is granted for the period ex- piring on the 1st day of January, A. D. 1962. Section 5. In the opinion of the Board of Commissioners -2- it is necessary to the peace, health and safety of the in- habitants of Salt Lake City, Utah, that this ordinance become effective immediately. Section 6. This Ordinance shall take effect upon its first publication.
