l AN ORDINANCE
AN ORDINANCE AMENDING TITLE 20 of the Revised Ordinances of Salt
Lake City, Utah, 1965, relating to license and business regulation by
adding thereto a new Chapter 30, relating to locksmithing.
Be it ordained by the Board of Commissioners of Salt Lake City,
Utah:
SECTION 1. That Title 20 of the Revised Ordinances of Salt Lake
City, Utah, 1965, relating to license and business regulation, be, and
the same hereby is, amended by adding thereto a new Chapter 30, to read
as follows:
Sec. 20-30-1. Definitions. (a) "Locksmithing" means the
installation, change, removal, construction, reconstruction,
repair, adjustment, manufacture, or duplication of locks,
combination for safes, tool boxes, vaults, and the duplication
of keys.
(b) "Key duplicating" means solely the duplication of any
keys by mechanical or other means.
(c) "Applicant" means any person applying for a license
hereunder.
Sec. 20-30-2. License requirements. (a) No person, including
an employee or officer of any firm or corporation, shall engage
in the business of locksmithing or key duplicating within the city
limits of Salt Lake City, Utah, without first having obtained a
license to do so. Each act of locksmithing or key duplicating
performed without such a license shall be deemed a separate violation
of the law.
(b) Each locksmithing license shall include the right to engage
in the business of locksmithing and key duplicating.
(c) Each key duplicating license shall include only the right
to engage in the business of key duplicating.
Sec. 20-30-3. License is personal. (a) Licenses issued shall
be personal in nature, and each individual or employee engaged in
the business of locksmithing or key duplicating shall be required
to have a license.
(b) If licensee changes his employment or place of business during
the year, he shall immediately notify the Salt Lake City Police
Department, in writing, of the name and address of his new employer
or the name and address of his new place of business.
Sec. 20-30-4. Application requirements. (a) Every application
for license and application for license renewal hereunder shall be
filed with the Salt Lake City Board of Commissioners and shall include
the following information verified under oath:

(1) The name under which licensee will conduct his business,
or the name of the firm or corporation by whom he is
employed, and a concise history of his employment.
(2) Applicant's name, age, address, phone number, and length
of residency in the State of Utah.
(3) The names and addresses of three character references.
(4) A statement disclosing whether applicant has ever been
convicted of a felony or misdemeanor, and, if so, the
nature of the offense, and where and when it was committed.
(b) Every applicant for license or renewal or license hereunder
shall also be required to furnish the following:
(1) A photograph of applicant to be taken by the Salt Lake
City Police Department.
(2) If deemed necessary, a complete set of applicant's finger-
prints to be taken by said department.
Sec. 20-30-5. License fee. (a) Licenses shall be valid from
January 1, tp,pecember 31, and the yearly locksmithing license fee
shall be $ 4IC.O O , and the yearly key duplicating fee shall
be $ „ Aiceq . Payment of such fees shall be made to the Salt
Lake City Treasurer at the time application is made for license
hereunder.
(b) Fees submitted with applications for licenses not approved
shall be returned.
Sec. 20-30-6. Police investigation and board action. (a) After
investigation of each applicant, the chief of police shall recommend
to the Board of City Commissioners either approval or denial of each
application. Any recommendation of approval from the chief of police
shall be based on an affirmative finding in each of the following:
(1) A reputation for honesty.
(2) A police record devoid of a conviction of, or any alleged
but as yet unresolved charge that licensee has committed
a crime involving moral turpitude.
(3) No known association with felons.
(b) The Board of Commissioners shall, upon consideration of
the application and the police recommendation, approve or reject
the application.
(c) If the application is rejected, the applicant may request
a personal appearance before the Board of Commissioners to offer
evidence for reconsideration of his application.
Sec. 20-30-7. Bond requirements. All licensees shall be
required, before issuance of a license hereunder, to de osit with
the City, a corporate surety bond in the penal sum of $f0 00.• 0
for locksmithing licensees and $[OOD.O O , for key duplicating
licensees, conditioned that said licensee shall faithfully observe
and comply with all ordinances and laws pertaining to locksmithing
and key duplicating, and that such bond shall indemnify Salt Lake
City and any person injured or damaged by reason of the failure of
said licensee to comply with said ordinances and laws.
Sec. 20-30-8. License and identifying number. (a) Upon approval
of an application, the Board of Commissioners shall issue a license
to applicant which shall bear his name, address, age, signature,
photograph and identifying number.

Sec. 20-30-9. Display of locksmith plaque. Each licensee shall
display conspicuously at his place of business or employment a plaque
of the style, size and color prescribed by the chief of police, which
shall include licensee's name and the words "Licensed Locksmith," or
"Licensed Key Duplicator," together with the licensee's identifying
number.
Sec. 20-30-10. License revocation. Any license granted or
extended hereunder may be revoked or suspended by the Board of
Commissioners after a hearing, with notice being given to the licensee,
resulting in an affirmative finding by said commissioners in any of
the following:
(1) Any misrepresentation made in obtaining a license.
(2) A conviction of, or any alleged but as yet unresolved
charge that licensee has committed a crime involving
moral turpitude.
(3) The violation of any provision of this chapter.
(4) A showing of any evidence which provides reasonable grounds
for said Board of Commissioners to believe that licensee
has committed or aided in the preparation for or allowed
his records, tools, equipment, facilities or supplies to
be used for the commission of any crime.
Sec. 20-30-11. Licensee records. Each licensee shall keep
for a minimum of two years orderly and adequate records containing
the following, which shall be open to inspection by a police officer
at any reasonable time:
(1) The name and address of every person for whom a key is
made from a key bearing the imprint "M" or "Master" or
other recognizable mark indicating it is a master key,
together with the name and address of every person for
whom a locked automobile, building, structure, house,
store, safe, or vault is opened and the date of transaction.
(2) The name and address of every person for whom a lock or
combination of a lock is changed and the date of the
transaction.
Sec. 20-30-12. Exceptions. The requirements of this ordinance
shall not apply to the following:
(1) Persons otherwise licensed by the City of Salt Lake or
the State of Utah as a contractor or carpenter who
installs a lock as part of a door or remodeled door
when the lock and key come from a manufacturer's stock
and the installation does not involve adjustment or
reconstruction of the lock.
(2) A person or an employee of a firm or corporation who is
duly licensed to conduct such business in an area outside
the jurisdiction of Salt Lake City, and who is not other-
wise subject to the provisions of this law, when their
work in Salt Lake City does not involve, in a six month
period, more than one contract and one day to perform.
SECTION 2. In the opinion of the Board of Commissioners it is
necessary to the peace, health and safety of the inhabitants of Salt
Lake City that this ordinance become effective immediately.
SECTION 3. This ordinance shall take effect upon its first
publication.
