Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Sections 39-1-3 and 39-1-5 of the Revised Ordin- ances of Salt Lake City, Utah, 1965, relating to the creationispecial improvements, be, and the same hereby is, amended as follows: Sec. 39-1-3. Power to create special improvement districts. Assessments. To defray the cost and expense of such improve- ments, or any of them, the Board of Commissioners may proceed, after acquiring jurisdiction as provided by law, to create special improvement districts, and to levy by ordinance special taxes and assessments upon the area to be served, or the blocks, lots or parts thereof and pieces of ground fronting or abutting upon or adjacent to the street or alley, or assessed valuation or any combination thereof, thus in whole or in part opened, widened or improved, or which may be affected or specially benefited by any such improvements to the full depth of such lots, parts of lots, or pieces of ground; provided, that where any lot or piece of ground is of a greater depth than three hundred thirty feet back from the street, such assessment shall be levied upon such lots, or pieces of ground, to a depth of three hundred thirty feet only, except in those cases where an improvement district is formed for the purpose of installing sewer or storm sewer trunklines and/or major water supply lines; and provided, further, that an allowance may be made for corner lots, so that they shall not be assessed at full rate on both streets. * * * Sec. 39-1-5. Form of notice of intention. The notice of intention shall be substantially in the following form: NOTICE OF INTENTION NOTICE IS HEREBY GIVEN by the Board of Commissioners of Salt Lake City, Utah, of the intention of said board to create a special improvement district to make improvements and to levy assessments to pay all or a portion of the cost for the following proposed improvements, including removal of all nonconforming improvements as part of said work, according to plans, profiles, and specifi- cations on file in the office of the city engineer, to-wit: (Here describe the improvements and work to be done) The places and the improvements are to be made and streets to be improved are as follows: (Here are the streets to be improved) -2- The boundaries of the proposed district are as follows: (Here describe the district by any means that will reasonably permit owners of property situated in the district to ascertain that their property is within the district. Such description may be by metes and bounds, reference to streets or extensions of streets, or by any other means reasonably describing the boundaries of the district so as to permit owners of property therein to ascertain that his property is with the district.) The total estimated cost of all improvements is $ as determined by the Director of Public Works or in the case of water or sewer improvements, the Director of Public Utilities, of which the city's portion is estimated to be $ and the remainder in the amount of $ , is to be paid by an assessment to be levied upon property fronting or abutting upon or adjacent to the streets and alleys to be improved, or the service area which may be affected by or specially benefited by any of such improvements. If the actual cost of the improvements exceeds the estimated cost, the governing body shall nevertheless have the right to levy assessments in excess of the estimated cost. It is proposed to levy assessments on property in the district to pay all or a portion of the cost of improvements according to the benefits to be derived by such property by levying an assessment on all property in the district according to (here set forth whether it is to be frontage, according to area, assessed valuation or by combination of the above) . Any assessment may be paid in _ equal annual install- ments with interest on the unpaid balance not to exceed percent ( %) per annum until due and thereafter at the rate of percent ( %) per annum until paid; or the whole or any part of the assessment may be paid without interest within days after the ordinance levying the assessment becomes effective, and if paid in part the unpaid balance shall be payable in equal annual installments with inter- est as aforesaid. All protests or objections to such improvements or the crea- tion of the district or to the carrying out of such intention MUST BE IN WRITING, signed by the owner or owners of the property affected or benefited by such improvements, describing or other- wise identifying such proeprty, together with (here set forth front feet, area or assessed valuation of the property depending on the proposed method of levying assessments) . NOTICE OF PROTEST MUST BE FILED IN THE OFFICE OF THE SALT LAKE CITY RECORDER ON OR BEFORE 5:00 O'CLOCK P.M. ON THE DAY OF thereafter at a.m., on the day of , the Board of Com- missioners will meet at the Commission Chambers in the City and County Building to hear and consider any such protest and objec- tions to the creation of the special improvement district or any other objections relating thereto.
