Greener Hogensen s Phillips / C Result (AN ORDI CE AN ORDINANCE AMENDING Chapter 11 of Title 5, of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to housing, by adding thereto a new Section 4. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Chapter 11 of Title 5 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to housing, be, and the same hereby is amended by ADDING thereto a new Section 4, relating to housing advisory and appeals board, to read as follows: Sec. 5-11-4. Housing advisory and appeals board. Section 203 of the Uniform Building Code, 1973 Edition, adopted by Section 5- 11-1 of this chapter, is amended to read as follows: (a) In order to provide for final interpretation of the pro- visions of this code and to hear appeals provided for hereunder, there is hereby established a housing advisory and appeals board consisting of ten (10) members who are not employees of the city and one ex officio member from each of the following organizations and departments: Department of Building and Housing Services, City-County Health Department, Department of Parks and Public Property, Redevelopment Agency, Department of Streets and Public Improvements, Planning and Zoning Department and Salt Lake Asso- ciation of Community Councils. The board of appeals shall hear and decide appeals where it is alleged there is an error on any order, requirement, decision or determination made by an administrative official in the enforce- ment of this code. The board may also recommend new ordinances and procedures to the board of city commissioners. (b) Members of the board shall be appointed by the board of city commissioners and shall hold office for three (3) years. Ex officio members may be appointed or removed by the board of commissioners at any time and shall have no vote in determinations made by the board of appeals. (c) The board of appeals shall adopt reasonable rules and regulations for conducting their investigation and business and shall render all decisions and findings in writing to the director of the Department of Building and Housing Services and to the appellant. (d) The concurring vote of a majority of the members of the board in attendance shall be necessary to reverse any order, requirement or determination of any administrative official, or to decide in favor of the appellant on any matter upon which it is required to pass under this code. In no case shall any such decision of the board affect a variation in the provisions of this code or any related ordinance or provision of law. 1.60 -2- SECTION 2. In the opinion of the Board of Commissioners of Salt Lake City, it is necessary to the health, peace and welfare of the inhabitants of Salt Lake City that this ordinance become effective immediately.
