AN ORDINANCE AMENDING Chapter 14 of Title 25 of the Revised
Ordinances of Salt Lake City, Utah, 1965, relating to Public Works
Director.
Be it ordained by the Board of Commissioners of Salt Lake City,
Utah:
SECTION 1. That Chapter 14 of Title 25 of the Revised Ordinances
of Salt Lake City, Utah, 1965, relating to Public Works Director, be,
and the same hereby is amended to read as follows:

25-14-25. Organization of Public Works Department.
Sec. 25-14-1. Creation of office. There is hereby created
the office of Public Works Director who shall be the city engineer,
which office shall be filled by appointment of the Board of
Commissioners. Wherever the term "city engineer" shall appear
in these revised ordinances it shall mean the Public Works Director.
Sec. 25-14-2. Oath. Bond. The Public Works Director shall,
before he enters the duties of his office, take and subscribe
the constitutional oath of office and shall execute a bond with

good and sufficient sureties, to be approved by the Board of
Commissioners, payable to the city in the penal sum of five
thousand dollars. Said bond shall be conditioned for faithful
performance of the duties of his office and the payment of all
moneys received by him according to law and the ordinances of
the city.
Sec. 25-14-3. Duty of Public Works Director. It shall be
the duty of the Public Works Director to locate the lines and
grades of all streets and sidewalks, alleys, avenues or other
public ways, and to determine the position, size and construc-
tion of all sewers, culverts, aqueducts, bridges, viaducts,
or other public works or appurtenances, and to prepare plans,
maps or profiles of the same, and to make estimates and furnish
specifications for any of said work, whenever required to do
so by the Board of Commissioners. He shall, under the direction
of the Board of Commissioners and the Commissioner of Public
Works, have general charge, supervision and inspection of all
public improvements and public work undertaken by or on behalf
of Salt Lake City by contract or otherwise, and shall see that
the same are performed in a workmanlike manner, and in accord-
ance with the authorized plans and with the terms and specifica-
tions of the contracts. The Public Works Director shall appoint
and be represented by division heads and their staffs on the
work with power to act for him and direct the work.
Sec. 25-14-4. Field notes, maps and profiles. The Public
Works Director shall insure that the appropriate divisions of the
Public Works Department keep certified copies of all the field
notes, maps or profiles which relate to city surveys, sewers,
streets or sidewalks and all other engineering works, and he
shall insure that they are arranged and indexed in such manner
as will enable a ready reference thereto, and all shall be the
property of Salt Lake City.
Sec. 25-14-5. Street lines. It shall be unlawful for any
person to erect or construct, or to commence the erection or
construction of any building, fence or other structure, or tb
make any excavation upon the line of any street, alley or other
public way without first making application to and obtaining from
the Public Works Director a survey of such premises showing
the property lines upon which such a building, fence or other
structure is to be constructed, or such excavation to be made.
Sec. 25-14-6. Street grades. Establishing. Whenever it
shall be deemed advisable to establish a grade on any street
where no grade has been theretofore established, or to change
any established grade, the Public Works Director shall cause
the necessary survey to be made and prepare and submit to the
Commissioners a profile map of such proposed grade with his
recommendations concerning the same. When any such profile map
shall have been approved and adopted by a majority of the Board
of Commissioners as a correct map of the grade on such street, the
action of the Commissioners shall be endorsed on said map by
the City Recorder and said map shall be then filed in the office
of the Public Works Director and the grade on any such street
shall thereafter be considered as established as shown on such
profile map. It shall be unlawful for any person to erect or
construct, or to commence the erection or construction of any
building or other structure upon the line of any street where
the grade of said street has already been established, without
making application to the Public Works Director to indicate the
grade of the street upon which said building or other structure
is to be erected, or thereafter to build to any grade other
than that indicated by the director.

Sec. 25-14-7. Fees. For all surveys in plats and additions
that have been officially resurveyed in congested districts,
or in any additions where the surveys are found to agree sub-
stantially with the recorded plat thereof, the Public Works
Director shall charge and collect in advance for the benefit
of the city, the estimated sum to cover the actual cost or ex-
pense of such surveys, from the owners of property ordering
work to be done by the Public Works Department or against whom
work done in said office is properly chargeable, and upon
ascertaining such cost or expense, any excess thereof shall be
refunded to the person advancing such sum.
The Public Works Director shall be allowed to charge and demand
in advance for the benefit of the city, fees for design, survey
and inspection of any curb and gutter to be installed at a pri-
vate property owner's request and expense, and for tying-in
said curb and gutter to the street. However, if the property
to be curbed and guttered is in an area scheduled for curb and
gutter extension under an improvement district and the property
owner agrees to pay his other assessments, said tie-in fees may
be waived at the Public Works Director's discretion. The exact
amount of each said fee shall be fixed by the Public Works
Director in accordance with the reasonable costs as determined
by the nature and amount of work to be done.
Sec. 25-14-8. Fees to cover cost of surveys. In all parts
of the city over which the official survey has not been extended,
and where the surveys are not found to agree substantially
with the recorded plats thereof, the Public Works Director shall,
for all surveys in such districts, charge and collect in advance
a sum estimated to cover the actual cost or expense thereof,
and upon ascertaining such cost or expense, any excess thereof
shall be refunded to the applicant; and in case of surveys in
such districts where lines cannot be satisfactorily determined
to agree with the recorded plat, the Public Works Director may
refuse to give any certificate of survey.
Sec. 25-14-9. Tests of additions. The Public Works Director
shall from time to time make a test of the additions to the
city, theretofore filed and recorded without a proper survey
or where the survey was so badly executed that great inaccuracy
exists in respect to the lines of streets and alleys, and where
there has been no official survey made by the city of the entire
addition; and until a proper resurvey of such addition is made
by the owners thereof, and the lines of the streets and alleys
accurately determined by the Public Works Director to agree with
the recorded plat thereof, he may refuse to give any certificate
of survey in connection therewith.
Sec. 25-14-10. Resurveys of additions. The Public Works
Director shall, from time to time, as promptly as may be with
the force at his disposal, proceed with resurveys of additions
as ordered by the Board of Commissioners.
Sec. 25-14-11. Location by section corner. All such maps
and plats of land situated outside of the limits of the city
survey shall be located with reference to the section corners.
Sec. 25-14-12. Standard of measure. The three stone monu-
ments set in Liberty Park and provided with a scale of vernier
to make the exact lengths for instruments of one hundred and
four hundred feet, respectively, and to indidate the tension
and degree of temperature employed, are hereby declared to be
the means of fixing and perpetuating the official standard of
measure in this city. The initial monument of the said group
being located at a point twelve hundred fifty-seven and seven-
tenths feet south and two hundred thirty and seven-tenths feet
west from the stone monument at the intersection of Seventh
East and Ninth South streets, and the two other monuments being

in line with and at a distance of one hundred and four hundred
feet, respectively, west from the initial monument.
Sec. 25-14-13. Instruments. How adjusted. All persons who
shall hereafter use any measuring instrument for making any
survey or measurement to establish the boundary lines of any
street, lot or other parcel of land, within the corporate limits,
shall first test or compare and adjust the same to correspond
with the official standard, as indicated by the above described
monuments.
Sec. 25-14-14. Instruments to be adjusted. It shall be un-
lawful for any person to refuse or neglect to compare and adjust
the measuring instruments to be used by him, with the official
standards as hereinbefore designated, before making surveys,
for any purpose, with the limits of Salt Lake City.
Sec. 25-14-15. Custodian of monuments. The Public Works
Director is the custodian of the monuments described in this
chapter. He shall keep the said monuments in perfect condition
and properly protected, and allow them to be used by proper
person at all reasonable times.
Sec. 25-14-16. Protection of monuments. It shall be unlawful
for any person to displace, remove, injure, or in any way inter-
fere with, or place obstructions upon any survey stake, or
monument marked as such.
Sec. 24-14-17. Interfering with Public Works Director pro-
hibited. It shall be unlawful for any person to interrupt or
molest the Public Works Director or any of his assistants, agents
or employees, and division heads and their staffs while engaging
in any official duty, or to willfully cause or offer to said
Public Works Director or his assistants or employees any kind
of corporal injury or hindrance.
Sec. 25-14-18. Employees. Compensation. The Board of
Commissioners shall employ engineers, draftsmen, lineman, and
such other employees as the necessities of the Public Works
Department shall demand, at such compensation as said board
may authorize.
Sec. 25-14-19. Absence or disability of Public Works Director.
In the absence of or during the disability of the Public Works
Director, the highway engineer shall exercise all the functions
and powers of the Public Works Director.
Sec. 25-14-20. Public Works Director's office, office of
record. Custodian. The Public Works Director's office is
hereby created an office of record for all maps, plans, plats,
profiles, drawings, deeds, dedications, final estimates, speci-
fications, and contracts, which in any way relate to the public
improvements and engineering affairs of the city. The Public
Works Director shall be the custodian of, and must keep, all
the drawings and documents above mentioned on file and record.
Sec. 25-14-21. Supplies, Records and files. The Public
Works Director's office shall be supplied with all necessary
books, cases, and supplies for recording and filing as herein
required. The Public Works Director shall record and file all
drawings and documents pertaining the public lands and improve-
ments and those made in his office shall be placed on record
as soon as completed, and shall then be open for public inspec-
tion, and any person copying the same, or taking notes, there-
from, may do so in pencil only. He shall keep the records and

files in good condition, and turn the same over to his successor
in office. He shall allow no alteration, mutilation or changes
to be made in any matter of record and shall be held strictly
accountable for same.
Sec. 25-14-22. Must not enter on record until fees are paid.
The Public Works Director shall not record any drawings or
instruments, or file any papers or notices or furnish any copies,
or render any service connected with his office until the fees
for same are paid or tendered as prescribed by law or ordinance.
Sec. 25-14-23. Seal. The Public Works Director shall be
provided with a seal by the city for his use, containing the
words "Salt Lake City, Utah. Department of Public Works -
Engineering Department." Said seal shall be affixed to every
certificate or approval.
Sec. 25-14-24. Recording not to conflict with recording in
other offices. The recording or filing of any drawing or
instrument in the Public Works Director's office shall not inter-
fere or conflict in any way with the recording or filing of the
same in other offices of record.
Sec. 25-14-25. Organization of Public Works Department. The
Public Works Department shall be divided into five divisions:
Airport Engineering Division, Transportation Engineering Division,
Highway Engineering Division, Street Maintenance Division, and
Administrative Services Division. Each division shall have a
separate division head, recommended by the Commissioner of Public
Works and appointed by the Board of City Commissioners. The Public
Works Director shall direct all public works in Salt Lake City,
and shall supervise all division heads in the Public Works Depart-
ment.
SECTION 2. In the opinion of the Board of Commissioners of
Salt Lake City, It is necessary to the health, peace and welfare of
the inhabitants of Salt Lake City that this ordinance become effective
immediately.
SECTION 3. This ordinance shall take effect upon its first
publication.
