AN ORDINANCE AMENDING Title 20 of the Revised Ordinances of Salt Lake
City, Utah, 1955, relating to licenses by adding thereto a new Chapter 4, to
be entitled "Fire and Damaged Goods Sale."
Be it ordained by the Board of Commissioners of Salt Lake City, Utah:
SECTION 1. That Title 20 of the Revised Ordinances of Salt Lake City,
Utah, 1955, relating to licenses, be, and the same hereby is, amended by
adding thereto a new Chapter 4 to read as follows:
"CHAPTER 4.
"FIRE AND DAMAGED GOODS SALE.
"Sec. 20-4-1. Scope and definition. As used in this chapter
the term "fire and damaged goods" applies to goods, wares and mer-
chandise being offered for sale as a result of damage by fire,
smoke, water, wind earthquake, acts of God or other incidents of
similar nature, but does not apply to goods, wares or merchandise
damaged in transit or by handling, dropping, marking, scratching
or other similar damage occurring within or incident to the reg-
ular course of business.
"Sec. 20-4-2. Compliance with chapter required. It shall
be unlawful for any person to sell any fire and damaged goods
without complying with each and every provision of this chapter.
"Sec. 20-4-3. Permit required. Fire and damaged goods shall
be sold only in strict accordance with the terms of a permit to be
issued by the license assessor and collector.
"Sec. 20-4-4. Application required. Any person intending to
sell fire and damaged goods shall file an application with the
license assessor and collector which shall contain the following
information:
"(1) A complete inventory of all goods, wares and mer-
chandise as it existed at the place of business immediately after
the occurrence or incident causing damage.
"(2) The items of such inventory that will be the
subject of the sale.
"(3) An affidavit of the correctness of the inventory
and the cause of the damage.

"Sec. 20-4-540' Issuance and duration of permit. Upon the
filing of the inventory and affidavit referred to in the preceding
section, the license assessor and collector shall issue a permit
to conduct a fire and damaged goods sale which shall be effective
for a thirty-day period following its issuance.
"Sec. 20-4-6. Renewal of permit. A permit shall be renewed
for an additional thirty-day period provided a sworn affidavit and
inventory showing the unsold goods, wares or merchandise are fur-
nislgdto the city license assessor and collector; and provided fur-
ther that the license assessor and collector is satisfied that such
goods, wares and merchandise were a part of and included in the
original inventory. In no event shall a permit be renewed more
than twice.
"Sec. 20-4-7. Advertising restrictions. It shall be unlawful
for any person to advertise a fire and damaged goods sale in other
than a concise and clear manner so as not to deceive the public.
All advertising shall state that such sale is not a termination of
the entire business but is a special sale.
"Sec. 20-4-8. Revocation of permit. A permit issued pursuant
to this chapter shall be revoked if:
"(1) The permittee has added, caused to be added or
permitted to be added to the fire and damaged goods any goods,
wares or merchandise not described in the original inventory.
"(2) The permittee has violated any of the provisions
of this chapter or of the laws pertaining to advertising.
"Sec. 20-4-9. Records to be kept. The permittee shall keep
complete and suitable records and books of all sale items and make
them available at all times to inspection by the city license asses-
sor and collector. The inventory list shall be revised at the close
of business each day by the permittee and those items disposed of
during such day shall be so marked thereon. The records and inven-
tory referred to in this section shall be submitted to the city
license assessor and collector upon his request.
"Sec. 20-4-10. Each sale a separate offense. Each sale of
fire and damaged goods made without a permit or of goods, wares or
merchandise that are not on the original inventory and designated
therein as the subject of such sale shall constitute a separate
offense under this chapter."
SECTION 2. In the opinion of the Board of Commissioners, it is nec-
essary for the peace, health and safety of the inhabitants of Salt Lake City,
Utah, that this ordinance become effective immediately.
SECTION 3. This ordinance shall take effect upon its first publication.
Passed by the Board of Commissioners of Salt Lake City, Utah, this 5TH
day of March, 1964.
