174 of 1910 - Ordinance 174 of 1910 – Sewer Extension No. 263, First & Final Estimate. AN ORDINANCE . An ordinance levying a tax and for the assessment of property onl both sides of Cottage Court between Third East and Fourth East Streets, in Sewer District No. 1, for the construction of a sewer. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the City Council does hereby levy the tax and provide for the assessment of the same upon the property hereinafter Idescribed in Sewer District No. 1, for the construction of a sewer, to-wit: In Lots 7 and 8, Block 21, Plat "B", abutting on both sides of Cottage Court between Third East and Fourth East Streets. This tax is levied to defray the expense of constructing a vitri II I fled pipe pipe sewer eight (8) inches in diameter upon the portions of said street opposite the property hereinbefore and hereinafter des- cribed to be especially affected and benefited by said improvement, and it is hereby adjudged, determined and established that said prop- erty will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portion of said street fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is four hundred thirty-eight and 8/100 0438.08) dollars, or 90/100 (40.90) dollars per front or linear foot of abutting property, there being 486.75 feet of abutting property within the boundaries of the lots, block and street above mentioned in said district, which is the total cost and cost per front foot of said sewer, according to the contract entered into for the performance of said work and making said improvement, with Dele L. Pitt, dated the 1st day of September, 1910, and the Treasurer is here- by authorized and directed to assess in accordance with the provisions of this ordinance for the purpose herein mentioned: -2- The north side of the south 90.75 feet of Lot 7, the north side of the south 74.25 feet of Lot 7, the west 78 feet of the north side of the south 90.75 feet of Lot 8, the west 78.75 feet of the north side of the south 74.25 feet of Lot 8, Block 21, Plat "B", Salt Lake City Survey, as the same are shown upon the official plats of said city to a depth of twenty-five (25) feet back from said street, and to collect said tax. SECTION 2. Said tax shall become an3jbe delinquent in five equa4 yearly installments, with interest on the whole sum u2ipaid at the rate of six percent per .annum, payable at the time each-installment is ,due, to-wit; One-fifth thereof one year after the approval of the ordinance confirming the levy of the tax for the payaent for such im-I provement; one-fifth thereof in two years after such approval; one- fifth thereof in three years after such approval; one-fifth thereof in four years after such approval; and one-fifth thereof in five year of said rafter such approval. One or more installments, in the order in which they are payable, or the whole special tax may be paid at any time ' Ilwithin thirty days after the approval of the ordinance confirming the. levy of the tax, without interest. In the event of any installment nor the interest aforesaid not being paid on the date the same becomes; Idue, the whole amount of the special tax unpaid at the time said in- staliment and interest are due, shall become due and payable, and ,shall draw interest at the rate of eight per cent per annum until the I ,sale of the property assessed; provided, one or more installments, in the order in which they are payable, or the whole special tax unpaid ,may be paid on the day any installment becomes dae, by paying the amount thereof and interest to said date. i SECTION 3.
