AN ORDINANCE
An ordinance granting to the Salt Lake Terminal
Company its successors and assigns, a franchise and right
of way to construct, maintain and operate a single or double
turn out and spur track, from and between its main line on
First West Street in Salt Lake City to the property line upon
the east side of said street in Block 77.
Be it ordained by the Board of Commissioners of
Salt Lake City, Utah:
Section 1. A franchise and right of way is hereby
granted to the Salt Lake Terminal Company, and its successors
and assigns, to construct, maintain and operate a single or
double turn out or spur track from and between its main line
on First West Street in Salt Lake City to the property line
upon the east side of said street as follows:
Beginning at a point on the center line of the east
track of the Salt Lake Terminal Company 62.39 feet south and
8.87 . ast of the City Monument at the intersection of South
Temple and First West Streets; thence along a curve to the left
having a radius of 200 feet a distance of 13.1 feet; thence
along a curve to the left having a radius of 150 feet a dis-
tance of 29.4 feet; thence along a curve to the left having a
radius of 125 feet a distance of 94.4 feet intersecting the
west line of Lot 5, Block 77, Plat "A", Salt Lake City Survey,
109.5 feet south of the Northwest corner thereof.
Also beginning at a point on the center line of the
West track of the Salt Lake Terminal Company 76.0 feet south
and 3.83 feet west of the City Monument at the intersection
of South Temple and First West Streets• thence along a curve
to the lef* having a radius of 200 feet, a distance of 13.1
feet; thence along a curve to the left having a radius of 150
feet a distance of 31.0 feet; thence along a curve to the loft
having a radius of 125 feet a distance of 107.5 feet intersecti+:
the West line of said Lot 5, 130.2 feet south of the Northwest
corner thereof.
Also beginning at a point on the center line of the
West track of the Salt Lake Tdrminal Company, 332.97 feet south
and 3.83 feet west of the City Monument at the intersection of
South Temple and First West Streets, thence in a northeasterly
direction along a curve to the right having a radius of 200 feet
a distance of 13.1 feet; thence along a curve to the tight
having a radius of 150 feet a distance of 31.0 feet; thence
along a curve to the right having a radius of 125 feet, a dia-
1 tance of 107.5 feet intersecting the West line of said Lot 5,
140.8 feet south of the Northwest corner thereof.

Also beginning at a point on the center line of the
East track of the Salt Lake Terminal Company, 364.26 feet south
and 8.87 feat east of the City Monument at the intersection of
South Temple and First West Streets, thence in a Northeasterly •
direction along a curve to the right having a radius of 200 fee
a distance of 13.1 feet; thence along a curve to the right ha
a radius of 150 feet a distance of 129.3 feet intersecting ti VW/
west line of said Lot+%, 1!0.19. fe t„,acuth of the Northwest c$
thereof. ,

Said spur track being more particularly shown in
yellow on 'the attached blue print which is hereby made a part
of this ordinance.
Section 2: During the term of, this franchise
the grantee shall be subject to the following conditions, vis:
(a) That said spur track shall be laid upon and
conform to the established grade of said street, and if said
grade is afterwards changed by ordinance of the Board of
Commissioners, the grantee shall, at its own expense, change
the elevation of the track so as to conform to the same.
(b) Whenever said street where said track is
constructed shall be paved, then said grantee, its successors
and assigns, shall pave between the rails and. for a space of
two feet outside of each rail with stone blocks or asphalt,
or a combination of both, to be approved by the City Engineer,
and all ties shall be laid. upon a concrete base of such thick-6
ness as shall be directed by the City Engineer.
(o) Said grantee shall put in and maintain such
crossings over said spur track as shall from time to time be
required by the Board of Commissioners, and engines and cars
shall not be permitted to stand on said spur track in First
West Street longer than five minutes.
(d) The said spur track shall he laid, and the
road operated so as to cause no unnecessary impediment to the
common and ordinary use of said street upon which it is laid.
(e) Good and sufficient conduits to convey water
shall be laid. and maintained in good condition, at the expens
of said grantee, in all water ditches crossed by said spur
track, so as to admit of free passage of water.

(f) Salt Lake City reserves the right to regulate
and control the speed of all trains, engines and cars operated
by the grantee, its successors and assigns upon the spur tracks
aforesaid.
(g) That if in putting in said spur track said
grantee shall remove or in any manner interfere with the pave-,
mont, curb, gutter,' / waterway, or sidewalk on said street, it

h) Said grantee, ^ ,uccessors or as ,ens, shall

gravel and maintain in good condition, at the established gra e
the street along and across which said spur track runs to wit *+
in one and one-half inches of the top of the rails, and for a
distance of fifteen feet on each side of the outer rails,
rubjeet to the approval of the Supervisor of Streets and
Irrigation.
Section 3. Nothing in this grant shall be construe
so as to prevent Salt Lake City or its authorised agents, con-i
tractors, persons or corporation to whom a franchise may have
been, or may hereafter be granted, from paving, sewering, laying
gas or watermains or pipes, altoring, repairing, or in any
manner improving said street, but all such improvements shall
be made with as little injury as „rr..ctieahlo to said spur
track and the operation thereof.
Section 4: Tho said grantee heroin, its successors
and 8se,i ins, shall, and by the acceptance of the privileges
and franchises herein granted, and in consideration of the
same, does hind itself, its successors and assigns, upon its
I acceptance of this franchise, to save the city harmless from 11
suits, claims,, demands and judgments whatsoever, whether in
law or in equity which shall he asserted, found or rendered
in amy manner whatsoever, against said city for injury or
damage to abutting property or otherwise, by reason of t(
granting of this franchise, or by reason of the operatiol of

said spur track; and that the grantee, its successors and
assigns will pay the amount of any judgment, determination aft
adjudication which, in any suit or proceedings may or shall be
found against Salt Lake City; Provided., however, that said
grantee, its successors or assigns, shall have had notice of

ordered by the Board of Cormissioners, said spur track shall
within thirty days thereafter, be removed, and the street re-
stored to the condition existing prior to the construction of
the same.
Section 6: Unless this i franchise and all the terms
and conditions thereof shall be accepted in writing by the
grantee herein within thirty days from the passage of this
ordinance, and unless said track be constructed within one
year from the date of such passage, then this ordinance shall
be nnfl and void..
Section 7: This ordinance shall take effect upon
