AN ORDINANCE AUTHORIZING THE ISSUANCE OF TAX ANTICIPATION BONDS OF SALT LAKE CITY IN THE PRINCIPAL AMOUNT OF $250,000. RECITALS. (A) A national emergency productive of wide-spread unemployment and disorganisation of industry, which burdens interstate and foreign commerce, affects the public welfare, and undermines the standarus of living of the American people, has been declared to exist by the Congress of the United States in the National Industrial Recovery A state emergency of like import as to the State has been declared to exist by Chapter 23 of the Laws of the State of Utah passed at the Second Special Session of the Twentieth Legislature. A city emergency productive of unemployment, poverty, suffering and distress which af- fects the public welfare and undermines the standards of living of the people of this City and which, unless immediately relieved, will in- volve loss of life and great loss of property is hereby declared by the Board of Commissioners to exist. (B) To relieve such existing emergency the Board of Commissioners, at a regular meeting held November 9th, 1933, and after notice of such proposed action had been given tfi all commissioners at least one week in advance of such action, reduced various appropriations in the budget for 1933 by an amount aggregating $250,000. Subsequently the Mayor of Nhe city made a written request setting forth the emergency recited in paragraph (A) above, for the increase in various appropriations in the budget for 1933 by an amount aggregating $250,000 to provide the funds,which, together with the grant of thirty per centum (30%) of the cost of labor and materials to be received from the President of the United States through the Federal Emergency Administrator of Public Works, are necessary to meet the cost of the projects described in Section 4 of this ordinance, which request was promptly made avail- -2- able for public inspection and a notice of consideration thereof published in the Salt Lake Telegram, a daily newspaper of general ,circulation published in the city on November 9th, 1933, at least it '!one week in advance of the meeting at which such request was con- 1 sidered. Thereafter and prior to the granting of such request, a li public hearing was allowed on November 17th, 1933, and 4t its regu-j ,lar meeting on November 17th, 1933, the Board of Commissioners (granted such request. , (C) Such appropriation of $250,000, together with allother ap- j Oropriations in the budget for 1933, was not then made, and is not 1 'ion the date of this ordinance in excess of the total of taxes levied. 1 1 ,(for the year 1933, amounting to $1,865,824.75, plus the total miscel- .aneous revenues for such year amounting to $932,400 aggregating th$ 1; of $2,798,224.75. The Tax Anticipation Bonds authorized by this rdinance together with all other indebtedness of the city incurred ) i l.n anticipation of the payment of taxes levied by the Board of Com iissioners for the year 1933, is not in excess of taxes for such citiy aevied for the year 1933, the total tax anticipation warrants and :ponds of the city heretofore issued and now outstrnding amounting td 01,453,100.00 . The entire indebtedness authorized to be incurred by this ordinance was and is contracted for the purposes for which 1Haid taxes for the year 1933 have been levied. 1 (D) The relieving of the emergency recited in Paragraph (A) above and the projects set forth in Section 4 of this ordinance for which pie appropriations in the budget for 1933 were increased, as recited , n Paragraph (B) above, are corporate purposes and in the judgment or 1 ' he Board of Commissioners are necessary to provide for the safety, preserve the health, promote prosperity, and improve the morals, peace, order, comfort and convenience of the inhabitants of this ity. NOW, THEREFORE, THE BOARD OF COMMISSIONERS OF SALT LAKE OITY DO ORDAIN AS FOLLOWS: j Section 1. In anticipation of the payment of taxes levied by the Board of Commissioners for the year 1933 and for the purposes -3- for which said taxes have been levied, bonds of the City to be known as "Tax Anticipation Bond of 1933" are hereby authorized to Ibe issued in the principal amount of $250,000. Such bonds shall be iodated October 1, 1933, shall mature in the principal amount of II $50,000 on October 1 in egch of the years 1934 to 1938, both inclu-' sive, shall be in denomination of $1,000 each, numbered from one upwards in order of maturity, shall bear interest at the rate of four per centum (4%) per annum, payable semi-annually on the first day of April and October in each year until maturity, shall be pay-i fable as to both principal and interest in such funds as are on the i I respective dates of payment of principal and interest legal tender for the payment of debts due to the United States of America, at the banking house of the Walker Bank and Trust Company, Salt Lake C-ty,l Utah. Section 2. All bonds issued pursuant to this ordinance shall be general obligations of the City for the payment of princi= pal and interest of which ad valorem taxes are and shall be levied , I I on all the taxable property within the City. Adequate provision shall be made in the budget for, and a sufficient tax shall be levied and collected ih each year for the punctual payment of the principl P� of and interest on said bonds when the same shall become due and payable. The full faith and credit of the City are hereby pledged to secure the payment of said bonds and interest. 'he provisions of this ordinance shall be deemed a contract with the holders of said bonds. Section 3. All bonds Issued pursuant to this ordinance shall be substantially in the following form: No. $1.000.00 UNITED STATES OF AMERICA STATE OF UTAH SALT LAKE CITY TAX ANTICIPATION BOND OF 1933. SALT LAKE CITY, a municipal corporation of the State of I � Utah, for value received, promises toapay to the bearer of this bond, or if it be registered, to the registered holder, the sum of! One Thousand Dollars ($1000.) on the first day of October,19_, -4- and to pay interest thereon at the rate of four per centum (4w) pert annum, semi-annually on the first day of April and October in each year from the date of this bond until it matures, upon presentation, and surrender as they severally mature of the coupons therefor an- I nexed hereto, or if this bond be registered as to both principal and interest, then to the registered holder. Both principal and interest of this bond will be paid in i such funds as are, on the respective dates of payment of such princ .- pal and interest, legal tender for the payment of debts due the United States of America at the office of the Walker Bank and Trust, Company, Salt Lake City, Utah. At the written request of the holder, this bond may be re1- I igistered as to principal and interest on the books of the City, kept I 'Iin the office of the City Auditor, and the coupons annexed hereto i ;cut off and destroyed after which both principal and interest shall. I 'be payable only to the registered holder, his legal representatives, 'successors or assigns and shall be transferable only in the manner ', herein set forth. A certificate of such registry shall be endorsed I q upon this bond by said City Auditor, and the name of the assignee shall be entered upon this bond and said books. I� This bond is one of an issue, the principal amount of which is $250,000.00, the notes of which are of like tenor, except as to maturity, 4nd is issued in accordance with the Constitution of the State of Utah and pursuant to the Revised Statutes of Utah, 1933, particularly Title 15 thereof, and pursuant to an Act of the Legisla- ture of the State of Utah, entitled: "An Actt Declaring an Emergency to Exist and Conferring upon the Governor and the Political Sub- ,visions of the State Extraordinary Powers to Carry On and Administer Program of Public Works and to Make Use of Aid Available under thel "National Industrial Recovery Act'; Empowering the Governor to Estabi- ish Agencies and to Accept and Utilize Certain State and Other Oal-- ers in Carrying Out the Purposes of This Act and to Make Expenditures I ff f Certain Funds; also Giving the Govern Power to Pledge the Faith nd Credit of the State for Certain Purposes; and Permitting Munici al Corporations, Public Sub-Divisions and Public Bodies, Singly or -5- • in Combination with Others to Participate under the 'National Indus+ trial Recovery Act' and Empowering the Governor to Promulgate Rules and Regulations and Providing a Penalty' for Violation of Such Rules1 and Regulations", approved July 26, 1933, constitution Chapter 23 or the haws of the State of Utah passed at the Second Special Session Laws of the Twentieth Legislature, 1933, and in accordance with all other laws of the State of Utah appertaining thereto, and by virtue, of an Ordinance entitled "A}1 Ordinance authorizing the issuance of Tax Anticipation Bonds of Salt Lake City in the principal amount of; $250,000, adopted by the Board of Commissioners November 1933,! deposited in the office of the City Recorder and published as re- quired by law. The full faith andleredit and taxing power of the city is! pledged to the punctual payment of the principal of and the interest on this bond. This bond is issued in anticipation of the payment of taxes levied by the Board of Commissioners for the year 1933.
