AN ORDINANCE AMENDING Chapter 1 of Title 42 of the Revised
Ordinances of Salt Lake City, Utah, 1965, relating to general pro-
visions, by adding thereto a new Section 9 relating to restrictions;
and amending Chapter 2 of Title 42 relating to lot requirements, by
adding thereto a new Section 7, relating to excavating hillsides for
residential construction.
Be it ordained by the Board of Commissioners of Salt Lake City,
Utah:
SECTION 1. That Chapter 1 of Title 42 of the Revised Ordinances
of Salt Lake City, Utah, 1965, be, and the same hereby is, amended by
adding thereto a new Section 9, to read as follows:
"Sec. 42-1-9. Restrictions. No proposed subdivision or
any part thereof may be located on a hillside of more
than eight (8) percent vertical rise until a written
report, unless such report is waived in writing by the
city engineer, is submitted to the city engineer by an
accredited geologist concerning the geologic condition
and status of the site. Specifically included in said
report shall be information concerning any geologic faults
which may render the proposed subdivision site unsuitable
"I�r; , 1i�l or unsafe, together with information concerning the
proposed subdivision's effect on natural waterways and
drainage. Based on this report, the city engineer may
disapprove the proposed subdivision or impose such
reasonable conditions as he may deem necessary to protect
the safety of future residents and their property."
SECTION 2. That Chapter 2 of Title 42 of the Revised Ordinances
of Salt Lake City, Utah, 1965, be, and the same hereby is, amended by
adding thereto a new Section 7, to read as follows:
"Sec. 42-2-7. Excavating hillside prohibited. Exception.
Lots created or improved by excavating a hillside may
not be used for the construction of any structure, nor
'i/" may a building permit therefor be granted unless the
proposed structure and lot shall be protected by the

lot where the excavation has exposed a bank of dirt
in excess of two (2) feet in vertical height. The said
plan and retaining wall construction shall further provide
for adequate drainage to convey surface water draining
from above, around the lot and into an adequate drainage
system in the street."

SECTION 3. In the opinion of the Board of Commissioners, it is
necessary to the peace, health and welfare of the inhabitants of Salt
Lake City that this Ordinance become effective immediately.
SECTION 4. This Ordinance shall take effect upon its first
publication.
Passed by the Board of Commissioners of Salt LakeCity, Utah,
this 25th day of February , 1971.
