Moran Mr.Chairman - - AN ORDINANCE Result AN ORDINANCE, REPEALING SECTION 1226 of the Revised Ordinances of Salt Lake City, Utah, 1920, and Section 1226X1 of the Revised Ordinances of Salt Lake City, Utah, 1920, as enacted by the Board of--Commissioners of Salt Lake City, Utah, on July 2, 1925, relating to intoxicating liquors, and enacting in lieu thereof Section 1226 of Chapter 31, Revised Ordinances of Salt Lake City, Utah., 1920. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION I. That Section 1226 of the Revised Ordinances of Salt Lake City, Utah, 1920, and Section 1226X1 of the Revised Ordinances of Salt Lake City, Utah, 1920, as enacted by the Board of Commissioners of Salt Lake City, Utah, on July 2, 1925, be and the same are hereby repealed. SECTION 2. That Chapter 31 of the Revised Ordinances of Salt Lake City, Utah, 1920, be and the same is hereby amended by adding in and to said chapter in lieu of the Sections repealed by Section 1 hereof, a new Section to be known as Section 1226, relating to intoxicating liquor, to read as follows: SECTION 1226. UNLAWFUL TO POSSESS, ETC., INTOXI- CATING LIQUORS. It shall be unlawful for any person to manufacture, well, keep or store for sale, offer or expose for sale, import, carry, transport, advertise„distribute, give away, exchange, barter, dispense, dispose of, serve or otherwise furnish or knowingly to have in his possession any intoxicating liquor. The term intoxicating liquor, as used in this chap ter, shall be construed to embrace all fermented, malt, vinous or spirituous liquor, alcohol, wine, porter, ale, beer, ab- i sinthe or any other intoxicating drink, mixture or prepara- tion of like nature, and all malt or brewed drinks, and all liquid mixtures or preparations, whether patented or not, which will produce intoxication; fruits preserved in alcohol'c liquors of any kind; and all beverages containing in excess of one-half of one per centum of alcohol by volume; and all mixtures, compounds or preparations, whether liquid or not, which are intended, when mixed with water or other liquid, to produce by fermentation or otherwise, an intoxicating li- qaor; provided, however, that nothing in this section shall prevent the manufacture of wood or denatured alcohol under the rules established by the governor of the State of Utah, and in compliance with the formulas and rules of the United States; or the manufacture, importation, exportation, storag or sale of pure alcohol for scientific and manufacturing pur poses, in strict accordance with the provisions of Title 54, Compiled Laws of Utah, or to prevent the importation of wines for sacramental purposes only, by religious bodies, in the same manner as provided by law for the importation of alcohol by warehouse managers. i yrr44f n � � SECTION 3. That Section 1226, as enacted by this ordi- nance, so far as its provisions are the same in effect as those of previousl* existing ordinances, shall be construed as continua- tions thereof. SECTION 4. The repeal of the Sections as provided in Section I shall not affect any right which has accrued, any auty imposed, any penalty incurred, nor any action or proceeding com- menced under or by virtue of the sections repealed. I -3- i I SECTION 5. Any person violating any provision of this ordinance shall be punished by fine in any sum not exceedint Two Hundred.
