VOTING Yes Nam ay, t, .awrence --- I move that the ordinance be passed.p Howie W ) Wells Mr.Chairman Result AN ORDINANCE An ordirmno a repealing Sections 1240 to 1288, inclusive, of the Revised Ordinances of Salt Lake City of 1913, the same being _- contained in Chapter LVII of said ordinances, relating to "Sreetc, Traffic and Travel on", and also repealing an ordinance of Salt Lake City passed by the Board of Commissioners September 24, 1914, amending Section 1268 of said Revised Ordinances, and repealing Section 1305 of said Revised Ordinances in regard to licensed public vehicles standing fifty feet apart; and enacting a new ordinance relating to travel and traffic upon the streets of Salt Lake City. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Sections 1240 to 1288, inclusive, of the Revised Ordinances of Salt Lake City of 1913, the same being con- tained in Chapter LVII of said ordinances, relating to "Streets, Traffic and Travel on", be, and eaoh of said sections is hereby repealed. SECTION 2. That an ordinance passed by the Board of Commis- sioners of Salt Lake City September 24, 1914, amending Section 1268 of said Revised Ordinances, be, and the same is hereby repealed. SECTION 3. That there is hereby enacted a new ordinanoe relating to travel and traffic upon the streets of Salt Lake City as follows: SECTION 1. The following terms whenever used in this -1- • ordinance, unless otherwise specified, shall be deemed to . have, and shall be held to include each of the meanings respectively set forth in this section, and any suoh terms used in the singular number shall be held to include the plural. PERSON. Whenever the word "person" is used, it shall be deemed to include partnership, firm, oompanI, corporation person andowning,thecontrolling or having charge of a vehicle street oar or interurban oar. , ' STREET. All public streets, avenues, boulevards, alleys, lanes, highways, foot ways, sidewalks, public parka, parkinge, roads, viaducts, or other publio places laid out for the use of vehicles. CURB. The lateral boundaries of that portion of a street designed or intended for the use of vehioles whether marked by curbing oonetruoted of stone, cement, concrete or other ' material or not so marked. VEHICLE. Every wagon, hack, coach, carriage, omnibus, push cart, bicycle, motorcycle, automobile, motor truck or 1 other conveyance, except baby carriage, railroad, street and' interurban railway cars, in whatever manner or by whatever force or power the same may be driven, ridden or propelled, • which is or may be used for or adapted to pleasure riding,. the transportation of passengers, baggage, merchandise or • freight; and every draft or riding animal, whether driven, ridden or led, or standing still, except that an animal or animals attached to any vehicle shall, with such vehicle, constitute one vehicle. MOTOR VEHICLE. A11 vehicles propelled by any other• than muscular power, except suoh as run upon rails. DRIVER. The rider or driver of an animal, the rider of. • a bicycle or motorcycle, the operator of a motor vehicle, a person in charge or control of an animal attached to a wagon;, -2- hack, coach, carriage or omnibus. SECTION 2. CONGESTED DISTRICTS. For the purposes of this ordinance the following streets and portions of street, in Salt Lake City shall be known, and hereby are designated congested distriots, to-wit: Main Street from the north side, of North Temple Street to the south side of Fifth South Street; II State Street from the north side of South Temple Street to the south side of Fifth South Street; West Temple Street from the north side of South Temple Street to the south side of Fifth South Street; South Temple Street from the west side of West Temple Street to the west side of Second East Street; First South Street from the west side of West Temple Street to the east side of State Street; Second South Street from the West side of West Temple Street to the east side of State Street; ! Third South Street from the west side of West Temple Street to the east side of State Street; Fourth South Street from the west side of West Temple Street to the Oeat side of State �elt7lee-A-wecsE�(m`a tm"yolico.St, Street; Pierpont Street; Edison Street from Second South Street to Third South Street; Commercial Street; Richards Street; Cactus Street; Post Office Place; and Exchange Place, SECTION S. RESTRICTED DISTRICTS. For the purposes of this ordinance the following streets and portions of streets ! in Salt Lake City are hereby designated as restricted dis- tricts, to-wit: Ninth East Street from Eighth South Street to Ashton Avenue; Eleventh East Street from Ninth South Street to Twelfth South Street; Fifth East Street from the north side of Ninth South Street to the south side of Twelfth South Street; Ninth South Street from the west side of Fifth East Street to the oast side of Eleventh Ehst Street; Fourth: South Street from Third West Street to Eighth West Street; the intersection of Second West and South Temple Streets; the intersections of Second South Street with First West, Second -S- SECTION 4. That Section 1305 of the Revised Ordinances of Salt Lake City, 1913, as contained in Chapter L% of said Ordinances, in regard to licensed public vehicles standing 50 feet apart, be, and the same is hereby repealed. • West and Third West Streets; the intersections of Third South ij Street with First West, Second West and Third West Streets; the intersections of South Temple and Ninth East Streets; and. II the intersections of South Temple, E and Fifth East Streets. SECTION 4. It shall be unlawful for any person to violate any of the provisions of this ordinanoe, or to fail to observe and obey any of the requirements and restrictions hereof. II SECTION 5. BELL, GONG, tic. No person shall ride, drive or propel, or pause or permit to be ridden, driven or pro- 1 palled., any motor vehicle or bicycle upon or along any publia street of this city without having attached thereto a bell, gong, horn or other signaling device in good working order, and sufficient to give warning of the approach of such vehio]k to pedestrians, other riders, or drivers of vehicles, and persons entering or leaving street oars. No such signaling device shall be used or sounded except when necessary to give such warning; nor shall any person use for signaling any device making a sound similar to that used by the police or fire departments of this city. SECTION 6. BRAKES. No person shall ride, drive or propel, or cause or permit to be ridden, driven or propelled; any motor vehicle upon or along any public street of this city, unless the same shall be equipped with a good and sufficient brake or set of brakes which shall be of sufficient power when applied to bring such vehicle when running at a speed of twelve miles per hour to a full stop within ten feet from the point where such brake is applied. SECTION 7. EMIT SMOKE, ko. No person operating a motor vehicle shall permit the motors of the same to visibly emit . an undue amount of steam, smoke or product of combustion from exhaust pipes or openings, and every vehicle using gasoline, distillate, kerosene or other liquid fuel as motor power, i -4- it must be provided with a muffler or other devioe for the reduc- tion of the noise of the exhaust, which devioe shall not be cut out or disconnected within the limits of the city. Nor shall the driver or person in charge of any motor vehicle permit such vehicle to stand alone upon any street of the city with any part of its machinery running. Nor shall any person operating or in charge of any motor vehicle either by its operation or use create any unnecessary noise. SECTION 9. LIGHTS ON MOTOR VEHICLES. No person owning,: controlling or having charge of a motor vehicle, except a motor cycle, shall drive, propel or operate, or permit such vehicle to stand upon any street of Salt Lake City during the, period of one hour after sunset and one hour before sunrise, unless there is attached to the front thereof two lighted lamps showing white lights visible within a reasonable distance, in front of such vehicle. Each of suoh motor vehicles shall also have attached to the rear at the left side, a lighted lamp reflected in such manner that it will elearly show the number of the vehicle4 and a red light visible for a reason- able distance in the rear thereof. SECTION 9. LIGHTS ON MOTOR CYCLES. No person owning, controlling or having charge of a motor cycle vehicle shall drive, ride, propel or operate, or permit to stand upon any street of Salt Lake City any such vehicle during the period of one hour after sunset and one hour before sunrise, unless there is attached to the front thereof a lighted lamp showing; a white light visible a reasonable distance in front thereof, and also attached to the rear thereof a lighted lamp showing a red light visible a reasonable distance, in the rear thereof. SECTION 10. LIGHTS ON HORSE VEHICLES. No person owning, controlling or having charge of any horse drawn vehicle, shall drive or permit such vehicle to stand on any street of Salt .-i- Lake City during the period of one hour after sunset and one hour before sunrise, unless there is attached to the loft side thereof a lighted lamp showing a white light toward the front, and a red light toward the rear, each of such lights to show a reasonable distance from such lamp; provided. that this section shall not apply to a vehicle while loaded with loose hay or straw. SECTION 11. DAZZLING LIGHTS, No person owning, control'- ling or having charge of any vehicle, street ear or interurban operate, oar, shall drive, ride, propellor leave standing upon any street of Salt Lake City, any sueh vehicle, street oar or interurban oar having at the front thereof a light of such strength or power as to dazzle pedestrians upon such streets, or drivers of vehicles proceeding in an opposite direction. SECTION 12. NUMBER. ivory motor vehicle shall at all u ' times while being used or operated upon the streets of Salt Lake City, haws the number assigned to it by the Secretary of State of the State of Utah, displayed on the baok or rear ! thereof in a oonspieuous plaoe and manner, securely fastened , so as not to swing, and so that the same oannot be raised toi show the back of such number, and so as to be plainly visible, the numbers to be Arabic numerals, and upon a plate or marker, the said number to be followed by the initial letter of this state on the plate or marker, the figures thereon to be four. inches high, and each stroke thereof to be one-half inch, and the said letter thereon to be not less than one inch in width, and at all times unobscured. The said number shall also be conspicuously displayed upon the front of said vehicle. SECTION 13. PERMIT FOR MOTOR CYCLE. No person shall ride any motor cycle, or motor bicycle on any street or pub- lie place within this city unless a lioense has been procured. for the use thereof, as provided by law or ordinance. SECTION 14. BADGE. No person shall use or operate any :, motor vehicle, exoept a motor cycle, upon the streets of Salt Lake City, as mechanic, employe, or for hire, without having obtained from the Secretary of State of the State of Utah, a badge, as provided by the laws of Utah, which badge shall be worn by such person, pinned to his clothing in a conspicuous place, at all times while he is operating such vehicle, and no such person shall voluntarily permit any other person to wear said badge, nor shall any person while operating said 5t0h vehicle wear anyAbadge belonging to another person, or a fictitious badge. SECTION 15. NAXE OF DRIVER AND BORROWER. Every person engaged in the business of renting or hiring out motor vehicles, exoept motor cycles, and employing drivers or chauffeurs to operate such vehicles, shall keep a record containing the name, address and age of each driver or chauffeur in his, their or its employ, which record shall be shown any police officer upon demand. Every person lending his, their or its motor vehicle shall keep a record of the name, age and address o€'" he person to whom loaned, and furnish the same on demand a•„near.. to he 4hist.of-poiiee. A yi-yy SECTION 16. STOP AT CURB. P5 AND ! FEET FROM INTER- SECTION. No person shall, unless in an emergency, or to allow another vehicle, street oar, interurban oar or a pedestrian to pass, stop any vehicle on any public street of this city in the congested districts, except as near to the right hand curb as possible, and not less than feet from the cross- walk of the intersection, nor in front of the entrance to a street or alley in the congested districts. No person shall stop any vehicle on any street with the left side to the curb. Persona desiring to discharge or take on merchandise or passengers on the left side of the street -7- Provided that upon streets running in a generally easterly and westerly direction wherein there is a rail- way track or tracks, any person in charge of any vehicle traveling on such streets shall have the right of way over vehicles traveling on streets running in a general- ly northerly and southerly direction wherein there is no railway track or tracks. shall cress over by making a complete turn and stopping at the curb on their right, as provided in this ordinance. Im • the congested districts drivers of vehicles shall go either to the intersection of the streets or half way of the block, to make the turn for the purpose of crossing the street. SECTION 17. HOW LONG MAY STAND. No person shall at any time allow any vehicle to stand longer than necessary to take on or discharge passengers or merchandise in any part of that portion of a street in front of any railroad depot or theatre or any other place where large numbers of people congregate or pass in or out; non shall the driver of any vehicle stand such vehicle in any such place so as to obstruct or impede travel, ingress or egress. The Chief of Police is hereby directed and empowered to designate places where vehicles may stand and to so arrange that travel, ingress and egress to and from such places shall not be impeded. No person shall between the hours of nine o'clock A.M. and six o'clock P.M. allow any vehicle to stand in one place in the congested districts as defined in this ordinance longen than one hour; provided that this provision shall not apply to either side of State Street or West Temple Street from the south side of Third South street to the south side of Fifth South street, nor Fourth South street between State and West Temple street; provided, further, that no vehicle shall be allowed to stand longer than necessary to take on or discharge passengers or merchandise.on the following streets in the congested district, to-wit: Commercial street, Richard street, Cactus street, Exchange Place, Post Office Place, Edison street between Second South and Third South streets, and Pierpont :street between West Temple Street and First West Street. • SECTION 18. HOW APPROACH CURB. Every person in charge of a vehicle shall, in the congested districts as defined in this ordinance, in stopping such vehicle, approach the curb ' in such manner that either the front or rear of such vehicle • shall when stopped, be close to the curb, and not less than eight feet from the nearest part of any other vehicle standing at the curb; that eight feet between vehicles shall be main- tained at all times except when necessary to be occupied by a vehicle taking on or discharging merchandise, in which case said last mentioned vehicle shall occupy said space only long enough to take on or discharge such merchandise. SECTION 19. HYDRANT. No person shall hitch or leave standing, or cause or permit to hitch or to leave standing any vehicle on any public street of this city, within ten feet of any fire hydrant. } -i- SECTION 20. NOT DRIVE SIDE BY SIDE. No person shall drive or permit to be driven or ridden any vehicle by the side of another vehicle or vehicles, in any street of this city longer than is necessary to pass such other vehicle or vehicles. SECTION 21. PASSING. Every person riding or driving any vehicle upon the streets of this city shall, upon meeting. another vehicle, pass the same to the right, and overtaking another vehicle, shall pass to the left thereof, and not pull over to the right until entirely clear of the vehicle passed; but no person riding or driving any vehicle shall, in over- taking a street oar or interurban railway car, pass to the left thereof. SECTION 22. TURN OUT. Every person in oharge of a vehicle on any street of this city, when signaled so to do by two blasts of a horn, or two rings of a bell, or other signal by the driver of another vehicle approaching from the rear, shall, when there is room so to do, pull over to the right of • the street or road far enough to permit such signaling vehiole to pass on the left and on the right of center of such street or road. SECTION 25. PARKWAYS, he. Every person riding, driving or propelling any vehicle, shall, on all avenues or streets divided by parkways, walks, sunken ways or viaduots, keep to the right, exeept in approaching Twelfth East Street on Second • South Street, when such person desires to proceed north on said Twelfth East Street, or in approaching Second South Street on Twelfth East Street, when such person desires to proceed west on said Seoond South Street; in either case such person may proceed on the left side of said streets, but in so doing shall keep to the right of said left side. SECTION 24. SLOP MOPING. Every person driving a slow moving or heavily loaded vehicle, and riders of bicycles, -9- V SECTION 45. STANDING ON CROSSING. No person, firm or corporation, nor any employe of any person, firm or corporation controlling, operating, or in oharge of any oar or train of cars operated by steam or any other motive power, shall cause' or permit such oar or train of oars, or any portion of the same to stand or be moved in, along or across any public street in such manner as to prevent for a period of five minutes or longer, any person or vehicle from crossing the traek or tracks on which such oar or train of oars are stand ing, or being moved. is Any person, firm or corporation oonvioted of a 'axial' violation of any provisions of this section shall upon con- viotion thereof, be punished by a fine of not less than $50.00, nor more than $299.00, or by imprisonment in the city' jail for a period of not less than thirty days, nor more than six months, or by both such fine and imprisonment. The court may in imposing a fine enter as part of the judgment that in default of the payment of the fine, the defendant be imprisoned in the city jail for a period of not less than thirty days. SECTION 46. INTERFERE WITH CROSSING. No person, firm or corporation, either as owner, employe or otherwise, con- trolling, operating or in charge of any vehicle, street oar or interurban car, shall cause or permit such vehicle or oar to be stopped in or upon any street in the congested distriots of this city, so that any portion thereof or of the fender attached thereto shall project between the prolongation of the lines of the sidewalk of the street crossing intersecting or terminating in the street, or in or upon which such vehicle or car is so stopped; provided, that the provisions of this section shall not apply in case of emergency, or when soh vehicle or oar is stopped for the purpose of avoiding an accident. SECTION 47. WHERE TO STOP CARS. No person operating -17- the time specified in this section as applicable to the particular offense. ii SECTION 37. DRIVING ON NE'7 PAVEMENT. No person shall drive, ride, or cause to be driven or ridden, any animal, or ride, drive or propel, or cause to be ridden, driven or pro- pelled, any vehicle over or across any newly made pavement in any public street across or around which pavement there is a barrier, or at, over or near which there is a person or a sign warning persons not to drive over or across such pavement, or a sign stating that the street is clamed. SECTION 38. CHILDREN. No person under eighteen years of age shall engage himself for hire, or be employed by any person, firm, association or corporation, as driver of any motor vehicle, except a motor cycle, nor shall any person under sixteen years of age drive any motor vehicle upon the streets of Salt Lake City; provided, however, that any person under the age of eighteen years and over the age of sixteen years who shall satisfy the chief of polio, of his or her oompetene", and secure from such officer a written permit to drive a motor vehicle, may drive such vehicle owned by his or her parents, when accompanied by an adult person; provided such adult per— son site in the same seat with such driver. SECTION 39. TAKING HOLD OF VEHICLES. No pedestrian or rider, driver or occupant of any vehiole shall lay hold of any part of any other vehicle, street oar or interurban oar while the same is in motion. SECTION 40. SIDEWALL. No person shall drive or ride, or cause to be driven or ridden, any animal or vehicle upon or along any public sidewalk or crosswalk, or leave any animal or vehicle on or along any public sidewalk or orosswalk in such manner as to obstruct the same. SECTION 41. RIGHT OF WAY. The officers and firemen and; all vehicles and apparatus of the fire department, when going -15- ii about to stop, or by reason of the narrowness of the street or avenue it is not possible to preserve said distance of eight feet from the running board or lowest step as herein described, then the person in oharge of such vehicle shall stop the same and remain standing until euoh street oar or interurban oar shall prooeed. SECTION 58. OgRE IN DRIVING. Every person in charge of any vehicle, street oar or interurban oar, shall drive such vehicle and operate such street oar or interurban oar on the : streets and avenues of this city in a careful manner, and with due regard to the width, character of traffic and use of the street being traversed, and the safety and convenience og pedestrians and other vehicles and oars. SECTION 34. INTOXIOMION. No person while in an inter tested condition shall ride, drive, propel, or have charge o/ any animal, vehicle, street oar or interurban oar upon ant street, avenue or alley of this city. Every person being convicted of violating the provisions of this section shall be punished as follows: For the first offense, by a fine of. not less than $25.00 nor more than $50.00, or by imprisonment in the pity jail for a period of not exceeding thirty days, or by both such fine and imprisonment; and in case the person convicted shall at the time of committing the offense have been in charge of a vehicle licensed by Salt Lake Oity, in addition to such fine or imprisonment or both, the judgment shall provide that such license shall be suspended for a period not less than six months, if such license has that long to run; otherwise that it be revoked. The court may in imposing a fine, enter as part of the judgment that in default of the payment of the fine the defendant may be imprisoned in the city jail for a period of not exceeding thirty days. r` For the second offense, imprisonment in the pity jail for a -12- period of not less than thirty days and not more than six months; and in ease the person convicted shall, at the time of committing the offense, have been in charge of a vehicle licensed by Salt Lake City, in addition to such imprisonment, the judgment shall provide that such license be revoked. SECTION 35. FREIGHT VEHICLES. No person between the hours of nine o'clock A. M. and seven o'clock P. M. of any day, shall drive or propel, or pause to be driven or propelled upon or over Main Street from the north side of South Temple Street to the north side of Fourth South Street, two or more freight vehicles hitched tandem; nor any freight vehicle draw# by more than three animals, nor any vehiole loaded with or hauling coal, hay or straw, nor any freight vehicle the bed, body or carrying part of which shall exceed twenty feet in length and eight and a half feet in width; nor any vehicle carrying a load, which load together with the bed, body or carrying part shall at any point occupy a space greater than twenty feet in length and eight and a half feet in width; nor: any vehicle loaded with or hauling earth, dirt, sand, gravel, brick, fire proof tiling, mortar, rook, stone or lumber, 1V any wreckage, unless the same is being taken to or from an excavation, building or place being made, constructed, repaited or demolished, located upon the street above mentioned. Every vehicle loaded or hauling as aforesaid, shall proceed to and from its destination by the most direct route, avoiding when possible so to do, passing over any part of ■Mims of the streetA above mentioned; provided, that nothing in this sec- tion shall prevent any vehicle from crossing any part of the street herein mentioned. SECTION 36. SPEED. No person shall drive, ride or propel, or cause or permit to be driven, ridden or propelled, any vehicle upon any street, avtinue or alley of Salt Lake City, or -13- to or returning from a fire, and all ambulances, whether pub- lie or private, and all other vehicles when employed in carry- ing sink or injured persons to a hospital or other plaoe for relief or treatment, and the officers, patrolmen and vehicles of the police department shall have right of way over all other persons and vehicles on any street, and through any procession, except vehicles carrying U. S. mail. SECTION 42. RIGHT OF WAY. Yehioles under the oontrol of the board of commissioners, used for flushing or sprinkling public streets, avenues or alleys of the city, or for the collection of garbage, and the emergency crew of the waterworks department when responding to a fire or emergency pall, shall have right of way over all other vehicles except those oarry- ing U. S. mail, ambulances, fire department apparatus and vehicles of the police department. SECTION 48. STOP. Every person in charge of any vehicle in or upon any street of this pity, upon the approach of any! vehicle or apparatus of the fire department, or any police patrol wagon, or any ambulanoe, or the emergency crew of the waterworks department, or of any auxiliary fire apparatus, shall, when signaled, immediately stop such vehicle as near as possible to the right hand curb of such street; nor shall such vehicle be moved until such apparatus, police patrol, emergency crew, auxiliary fire apparatus, or ambulanoe shall have passed the same. SECTION 44. NOT INTERFERE WITH STREET CAR. No person in charge of any vehicle upon the streets of this pity shall wilfully stop, or drive, or cause to be stopped or driven, any such vehicle along or across any street railway track or inter- 1 urban railway traok in such manner as unnecessarily to hinder, delay or obstruct the movement of any car traveling upon such. track. -16- ^ g - f shall keep ease to the right hand curb, allowing more swiftly moving vehicles to pass on the left. SEOTION gg. TURNING PROM ONE STREET INTO ANOTHER. Ever$r person in charge of any vehicle when turning to the right from one street, avenue or alley in this city into another street, avenue or alley, shall turn as near the right hand curb as possible, and in turning to the left into another street, avenue or alley, shall keep to the right of the center of the intersection of the two streets, avenues or alleys. SEOTION 2g, TURNING FROM ONE STREET INTO ANOTHER. Evexty • parson in charge of any vehicle turning to the left from one ; street, avenue or alley into another street, avenue or alley,; shall allow the right of way to a vehicle or vehicles travel-' ing in the direction in which such vehicle is turning, and the person in charge of any vehicle traveling in the direoticin in which such vehicle is turning shall have the right of way; over the vehicle so turning. Every person in charge of any vehicle turning to the right from one street, avenue or alley- into another street, avenue or alley, shall have the right of way over a vehicle or vehicles traveling in the direction in Which such Vehicle is turning; and the person in charge of any vehicle traveling in the direction in which such vehicle,' is turning shall allow such right of way to the vehicle so turning. SEOTION 27. Except as herein otherwise provided, every; person in charge of a vehicle traveling on a street in a generally northerly and southerly direction shall have the right of way over vehicles traveling on streets in a gener- ally easterly and westerly direction; and every person in charge of any vehicle traveling on streets in such generally easterly or westerly direction shall allow vehicles traveling on streets in a generally northerly or southerly direction the right of way. -10- SECTION 28. RIGHT OF WAY. Interurban railway oars shall have the right of way over street oars. ma4 person in charge of ,atreet Gard shall allow interurban railway oars the right of way at street crossings. SECTION 29. SIGNALING WHEN ABOUT TO TURN. Every person in oharge of a vehicle when about to stop, shall signal per- sons in charge of vehicles in the rear by raising the hand, and in case such person is about to turn off the street, or turn around, he shall indioate to persons in charge of vehioles in the rear with his hand, the way he proposes to turn. SECTION S0. NOT PASS ON INTERSECTION. No person in charge of a vehicle shall pass or attempt to pass another vehicle or vehicles upon any intersection in the congested districts. SECTION 81. MIRROR. No person shall drive on any street or avenue of this pity a vehiole that is so enclosed as to prevent the person in charge from having a complete view of the traffic at the rear and sides of such vehiole, unless there is attached to such vehicle a mirror so placed that till person in oharge is able to see therein the reflection of the street or avenue two hundred feet in the rear of suoh vehicle. SECTION 32. EIGHT vsET FROM RUNNING BOARD. Every person in oharge of any vehicle upon any street or avenue of this pity shall keep the same at least eight feet from the running board or lowest step of any street oar or interurban oar which has stopped or which is about to stop to take on or let off a passenger or passengers, and shall maintain such distance from such oar until such vehicle shall have pro- seeded beyond the front of such street oar or interurban oar. If by reason of the presence of a vehicle or other obstruo j tion at the place where such car shall have stopped or is -11- on any part of any street avenue or alley of said city, at a greater rate of speed than in this section provided, to-wit, eight miles per hour over and across any intersection in the congested and restricted districts, as defined and located in: this ordinance; fifteen miles per hour in said restricted dis- tricts, other than intersections therein; twelve miles per hour in said congested districts other than intersections therein; twenty-five miles per hour upon any other streets and avenues. Every person convicted of violating the provisions of this section shall be punished as follows: For the first offense, by a fine of not less than $10.00, nor more than #s0.00, or by imprisonment in the city jail for a period not longer than thirty days, or by both such fine and imprisonment. For the second offense, if committed within one year after oonviotion of the first offense, by a fine of not less then $50.00, and not more than $100.00, or by imprisonment in the city jail for a period of not less than thirty days, nor more' than one hundred days, or by both such fine and imprisonment. For a third, or any subsequent offense committed within one year after conviction of the first offense, by a fine of not less than $100.00, and not more than $299.00, or by imprison- ment in the pity jail for a period of not less than sixty Jaye, and not more than six months, or by both such fine and imprison- ment. That in case the person convicted of a second or third offense, at the time of committing the offense shall have been in charge of a vehicle licensed by Salt Lake City, in addition to such fine or imprisonment or both, the judgment shall pro- ;, vide that such license be revoked. The court may in imposing a fine under this section, enter as a part of the judgment that in default of the payment of the fine, the defendant be tAr imprisoned in the city jail for a period of time not exceeding er in charge of a street oar on Main Street between the south; side of South Temple Street and the south side of Fourth South Street, shall atop such oar to takes on and let off passengers except on the aide of the intersection such oar is approaohing, and in the center of the block between intersections. In turning into Main Street from another street, no person operating or in charge of a street oar shall stop the same to take on or let off passengers on said Mein Street except in the center of the block between intersections. Pedestrians shall have the right of way over vehicles at regular street crossings and in the center of blocks army. Every pedestrian shall keep to the right of the sidewalk or street crossing, and shall not obstruct or prevent the free use of any sidewalk or street crossing by others. In the oon gested districts pedestrians shall not stop or stand so as to obstruct the use of the sidewalk. SECTION 49. PEDESTRIANS. No pedestrian shall interfere with the movement of vehioles or street oars or interurban oars. No pedestrian shall cross an intersection of streets in the congested districts diagonally, but shall cross the street at right angles at a regular crossing at the intersec- tion of two streets, and at right angles at a point in the middle of the block. SECTION 50. POLICEMEN. The chief of pollee shall desig- nate ameeddieetomimmemlemere police officers to attend upon the public streets to control the movements, and order the stoppage of vehicles, street oars and interurban oars in or -18- upon such streets, in order to prevent congestion of traffic, and to prevent accidents. Any polioe officer designated by the chief of polies to perform such duty, shall control the movement and order the stoppage of vehicles, street oars, interurban cars and pedestrians in or upon suoh public streets for the purposes herein set forth. The movement and stoppage: of vehicles, street oars, interurban oars and pedestrians at street intersections shall be governed by whistle or other signal given by such police offioer as follows: One blast of a police whistle or a raising of a hand indicates that the east and west bound traffic, including pedestrians, must stop, and that north and south bound traffib may proceed; provided, that street cars and interurban rail- way oars turning from a northerly or southerly direction to the east or west shall prooeed upon the sounding of one blast' of suoh police whistle, and shall stop upon the sounding of two blasts thereof. Two blasts of a polioe whistle or a raising of a hand indicates that north and south bound traffio, including pedestrians, shall stop, and that east and west bound traffic] may proceed; provided, that street oars and interurban railwa* care turning from an easterly or westerly direotion to the north or south shall proceed upon the sounding of two blasts of such police whistle, and shall stop upon the sounding of one blast thereof. Three or more blasts of a police whistle is a signal of , alarm, and indicates the approach of vehicles of the fire department, or some other emergency, and all vehicles, street oars and interurban railway oars, and pedestrians, shall stop until permitted by the police officer to proceed. pp )E 0T'P I SECTION 51. COMPLY WITH ORDER OF POLICEMAN. Every person in charge of any vehicle, street oar or interurban oar,.or -19- animal, isAsa , shall at all times comply with any direotion given by whistle, voice or hand of any police officer as to stopping, starting, approaching or departing from any place in the street. SECTION 52. MOVE WHEN REQUESTED. Every person in charge • of any animal, or vehicle standing along or near the curb of any street within the congested districts, shall, at the request of any police offioer, move such animal or vehiole away from such curb. SECTION 63. MMik NOTICES. Every person shall oomjly with any instruction or direction displayed upon any post, • standard, sign or device for the regulation of traffic in ani public street. SECTION 54. ZONES. Subject to the approval of the $oard of Commissioners, the department of public safety may establi¢h zones of quiet in the vicinity of hospitals and other public institutions, and other places, and notices shall be oonspio-' uously placed designating the limits of such zones. Every person in oharge of a vehicle, street oar, interurban oar or railway train, or any other type of vehicle, shall exercise special oars to approach and proceed through such zones as noiselessly as possible. SECTION 65. INJURING SIGNS. No person shall deface, injure, move or interfere with any sign, standard, post, rope; or other device installed or planed for the purpose of direct' ing or regulating traffic. SECTION 56. NAILS. No person thall throw, deposit or place in or upon any public street, avenue or alley of this oity any nails, tacks, crockery, scrap iron, tin, wire, bottles, glass, boxes, wood, boards, stone, thorns or thorny clippings, or thorny branches of trees or bushes, or any other article or thing likely to puncture or injure the tire of any vehiole: -20- SECTION 57. ACCIDENT. In ease of an accident to a person or property on any of the streets, avenues or alleys of this city, due to the operation thereon of any vehicle, the person; operating or in charge of such vehiole, shall stop, and upon the request of the person injured, or any person present, give suoh person his name and address, and if not the owner of such vehicle, the name and address of such owner. • SECTION 58. S.D.L'WAT.K. No person shall operate a motor vehicle upon any sidewalk of Salt Lake City. SECTION 59. EXCEPTION. The provisions of Sections 16, 17, 18, 19, 21, 22, 24, 27, 30, 32, 35, 36, 40, 45, 49, 50, S3 51jamd 52,,of this ordinance shall not apply to any vehicle or? the person in oharge of any vehicle connected with the fire department or police department of this oity, when in the performance of duty. SECTION 60. EXCEPTION. The provisions of Sections 16, 17, 18, 19, 21, 22, 24, 27, 29, 32, 35, 45, 49, 50, 51)e1t 526of this ordinance shall not apply to vehicles of any • auxiliary fire apparatus belonging to any person, firm or corporation engaged in furnishing gas or electricity to Salt Lake City or its inhabitants, or the person in oharge of auoh vehicle when responding to a fire call. SECTION 61. EXCEPTION. The provisions of Sections 16, ' 17, 18, 19, 21, 22, 24, 27, 29, 31, 35, 45, 49, 50, 51,erid • w�3 52 of this ordinance shall not apply to vehicles carrying the emergency Drew of the waterworks department, or to the such persons in charge of vehioles, or the occupants of the same when responding to an emergency or fire oall. SECTION 62. EXCEPTION. The provisions of Sections 16, 15, 19, 21, 24 29, 39 and 45 of this ordinance shall not apply to vehicles or to the persons in charge of vehioles of the g health department in the collection of garbage. •21_ it SECTION 63. EXCEPTION. The provisions of Sections 10, 25, 16,'18, 19, 20, 21, 22, 24,/26, 27, 29, 32 and 39 of this ordinance shall not apply to sprinkling, or street flushing or street cleaning vehicles operated by Salt Lake City, or the persons in charge of the same while engaged in cleaning, sprinkling ot flushing streets of the pity. SECTION 64. PENALTY.
