AN ORDINANCE Mr.Chairman Result AN ORDINANCE GRANTING to Salt Lake Rail & Bus Terminal Company, and its successors and assigns, a franchise and right of way to construct, maintain and operate a single spur track upon First West Street in Salt can Lake City, Utah, from the track of the Company, as now constructed in 8First West Street in Salt Lake City, Utah, to the property line on the west side of said First West Street and along Folsom Avenue. Be it ordained by the Board of Commissioners of Salt Lake City, Q• Utah: • SECTION 1. A. franchise and right of way is hereby granted to the 0 Salt Lake Rail & Bus Terminal Company, its successors and assigns, to con- struct, maintain and operate a single spur track upon First West Street c:and along Folsom Avenue, Salt Lake City, Utah, the center line of said spur track being described as follows: r� ti o Beginning at a point in the center line of the Salt Lake ° Rail & Bus Terminal Company southbound track 4.35 feet West b .o� and 248.32 feet, more or less, North of the City Monument ,^ at the intersection of First South and First West Streets; p running thence on a curve to the left through a switch 4-3 - turnout of 12° 40' 49n for a distance of 49 feet, more or -4CC1 less; thence on a curve to the left with a radius of 150 o x feet for a distance of 102.85 feet to a point on the East 0 m ~ line of Lot 1, Block 78, Plat A, Salt Lake City Survey, said point being 11.85 feet south of the N.E. corner of said lot 1; continuing thence on a curve to the left with a radius of 150 feet into Folsom Avenue for a distance of 99.6 feet to a point 20 feet North and 92.4 feet West of the S.E. corner of Lot 8 in said Block 78; continuing on a curve to the left of 200 feet radius for a distance of 32.3 feet; thence on a curve to the right of 200 feet radius for a distance of 32.3 feet to a point 14.75 feet North and 8 feet East of the S.W. corner of said lot 8; continuing thence West parallel with the center line of Folsom Avenue to a point 14.75 feet North and 73 feet East of the S.W. corner of Lot 6 in said Block 78. such spur track is more particularly shown on the attached blueprint which , is hereby made a part of this ordinance. SECTION 2. That the riglt and privileges granted in this ordinance are specifically made subject to all the rights, responsibilities, conditions, 20 i provisions and obligations as the same are set out in that certain franchise. heretofore and on the 31st day of May, 1916, granted to the grantee herein,. and said rights herein conveyed are hereby declared to be governed and con- trolled by said franchise and the terms thereof, except insofar as the same may be repugnant to or in conflict with the terms of this ordinance. SECTION 3. The right hereby conferred shall expire on the 1st day of January, 1975. SECTION 4. Unless this franchise and all the terms and conditions thereof shall be accepted in writing by the grantee herein'.within thirty days after this ordinance becomes effective, and=unless said track be constructed within one year from the effective ate thereof, then this ordinance shall be null and void. SECTION 5. In the opinion of the Board of Cgmmissionex's it is neces- sary to the peace, health and safety of the inhabitants of 'Salt Lake City that this ordinance become effective immediately. SECTION 6. This ordinance shall take effect upon its first publication.
