AN ORDINANCE VACATING all lots, streets and alleys located
within the Prospect Park Subdivision approximately situated near
Redwood Road and the Jordan and Salt Lake Surplus Canal north of
1700 South Street in Salt Lake City, Utah.
WHEREAS, the Board of Commissioners finds that the City's fee
simple interest in the streets and alleys dedicated within the
Prospect Park Subdivision have never been improved nor have they been
used by the public as thoroughfares, and the vacation of all lots,
streets and alleys within said subdivision will not be adverse to
the general public's interest in light of a new proposed subdivision
development for said property which would result in the rededication
of a different lot system and public street system.
THEREFORE, be it ordained by the Board of Commissioners of Salt
Lake City, Utah.
SECTION 1. That the Prospect Park Subdivision located in the
general area of 1700 South and Redwood Road in Salt Lake City, Utah,
and placed of record on or about April of 1892, in the Salt Lake
County Recorder's Office together with all lots, streets and alleys
located therein, more particularly described as follows, be, and the
same hereby are vacated and declared no longer to be a dedicated
subdivision, and the streets and alleys therein are no longer public
property for the use as streets, avenues, alleys or pedestrian ways:
Said Prospect Park Subdivision is bounded and
described as follows, to wit:
Beginning at the S.W. Cor. of N.E. 1/4 of Sec. 15
T.1S.R.1W. Salt Lake Meridian, which cor. is 40

chains N. of the 1/4 Sec. Cor. between Secs. 15 &
22 Township and Range aforesaid, thence North 990
ft.; thence East 968 ft. to the east-side of Surplus
Canal; thence N. 35°45'W.23 ft.; thence East 366
ft.; thence South 1008 ft.; thence West 1320 ft.;
to the point of beginning.
Said vacation is expressly made SUBJECT to all existing right
of ways and easements of all public utilities of any and every des-
cription located on, in, under or over the confines of the above-
described property and also SUBJECT to the right of entry thereon
for the purpose of maintaining, altering, repairing, replacing,
removing or rerouting said utilities and all of them.
Said vacation is also expressly made SUBJECT to all existing
right of ways and easements of any third parties.
Said vacation is also expressly made SUBJECT to the condition
precedent of the prior approval and acceptance by this Commission
of a final subdivision plat which includes all of the property
within the above description of the Prospect Park Subdivision which
is to be vacated. This ordinance shall take effect and shall be
recorded upon the records of the Salt Lake County C± -= Office
concurrently with a recordation of a final approved subdivision
plat that includes the above-described property situated within said
Prospect Park Subdivision. In the event an approved and final sub-
division plat containing the land located in said Prospect Park
Subdivsion is not approved and filed of record with the Salt Lake
County Recorder's Office within twelve months from the date hereof,
this ordinance shall be of no legal force and effect and shall not
be recorded in the office of the Salt Lake County Recorder.
