Shearman Wells —._ (°kuv '.>" Mr.Chairman �V Result AN ORDINANCE An Ordinance levying a tax and for the assessment of property on Highland Perk Drive between Twelfth South and Thirteenth South Streets, in Paving District No. 32, for the purpose of providing for the grading, curbing and guttering, constructing drainage and irrigation systems, and paving thereof. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board. of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Paving District No. 32, for the purpose of providing for the grading curbing and guttering with Dement, constructing drainage and irrigation system, and paving thereof, to-wit: In Lots 10, Block 45; 1, 6, 7,8 and 9, Block 46; 1 to 12, in- clusive, Block 9; 3 to 5, inclusive, Block 7; 1 to 6, inclusive, Block 6; 1 to 11, inclusive, Block 5; 1 to 11, inclusive, Block 4; 1 to 11, inclusive, Block 3; 1 to 6, inclusive, Block 2, Union Heights Subdivision, Block 46; 123 to 132, inclusive, Block 6; 1 and 2, Block 1; 113 to 118, inclusive, Block 5; 95 to 100, inclu- sive, Block 4; 66 to 71, inclusive, Block 3; 28 to 33, inclusive, Block 2, Highland Park Plat "B" Subdivision, Block 46; 1, and 18 to 24, inclusive, Highland Park Plat "D" Subdivision, Block 46; 11 to 16, inclusive, 40 to 45, inclusive, 73 to 78, inclusive, 99 Ito 104, inclusive, 117 to 122, inclusive, 141 to 146, inclusive, and 158, 159 and 160, Highland Park Plat "A" Subdivision, Block 46, all in Ten Acre Plat "A", Big Field Survey, abutting on both sided of Highland Park Drive between Twelfth South and Thirteenth South Streets. This tax is levied to defray the expense of grading, curbing and guttering with cement, constructing drainage and irrigation 11 systems of from four (4) inches to fifteen (15) inches in diamete* of cement, vitrified and corrugated iron pipe, and paving with Utah rock asphalt , a roadway (said roadway to be forty-four (44) feet wide between curbs from Twelfth South Street to the first angle point, and forty-two (42) feet wide between curba from said (8J first angle point to Thirteenth South Street, and eight,inches thick, with five (5) inch base, one (1) inch binder, and two (2) inch topping) , the portions of said street opposite the property hereinbefore and hereinafter described to be especially affected i I and benefited by said improvement, and it is hereby adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied, anl said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said por- tions of said street fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is forty-two thousand eight hundred thirty and 49/100 (042,830.49) dollars; twenty-eight hundred twenty-nine and 91/100 (42829.91) dollars, or five and • 89/100 (05.89) dollars, per front or linear foot of abutting property for forty-four foot roadway (with single track), there , being 460.46 feet abutting said portion of said improvement; I I twenty-four thousand eighty-nine and 51/100 (024,089.51) dollars,) 1 or five and 64/100 (05.64) dollars per front or linear foot of abutting property for forty-two foot roadway (with single track) ,' -2- there being 4271.19 feet abutting said portion of said improve- ment; thirteen thousand eight hundred fifteen and 65/100 (013,815.i65) ; dollars, or four and 95/100 ($4.95) dollars per front or linear foot of abutting property for forty-two foot roadway (with single ; track, curb and gutter built) , there being 2791.04 feet abutting j said portion of said improvement; thirteen hundred forty-three and 75/100 ($1343.75) dollars, or four and 30/100 (04.30) dollars per; i front or linear foot of abutting property for forty-two foot road4 way (with double track) , there being 312.50 feet abutting said '; portion of said improvement; and seven hundred fifty-one and 67/100 (0751.67) dollars, or three and 61/100 ($3.61) dollars per front or linear foot of abutting property for forty-two foot roadway (with double track, curb and gutter built) , there being 208.22 feet abutting said portion of said improvement, within the boundaries of the lots, blocks and streets above mentioned in sai district, which is the total cost and cost per front foot of said! improvement, according to the contract entered into for the per- I formance of said work and making said improvement, with P. SECTION 2. Said tax shall become and be delinquent in ten equal yearly installments, with interest on the whole sum unpaid ti at the rate of six per cent per annum, payable at the time each installment is due, to-wit: One-tenth thereof one year after the ordinance confirming the levy of the tax for the payment for such improvement becomes effective; one-tenth thereof in two years h after said ordinance becomes effective; one-tenth thereof in three L years after said ordinance becomes effective; one-tenth thereof in four years after said ordinance becomes effective; one-tenth thereof in five years after said ordinance becomes effective; one tenth thereof in six years after said ordinance becomes effective; one-tenth thereof in seven years after said ordinance becomes effective; one-tenth thereof in eight years after said ordinance becomes effective; one-tenth thereof in nine years after said ' ordinance beoomes effective; and one-tenth thereof in ten years after said ordinance becomes effective. One or more of said 1 installments, in the order in which they are payable, or the whole special tax, may be paid at any time within thirty days after the ordinance confirming the levy of the tax becomes effective, with- out interest. In the event of any ihstallment, or the interest i' aforesaid not being paid on the date the same becomes due, the -5- I ' II • I,whole amount of the special tax unpaid at the time said install- 'ment and interest are due, shall become due and payable, and shall', draw interest at the rete of eight per Dent per annum until the sale of the property assessed; provided, one or more installments,1• in the order in which they are payable, or the whole special tax unpaid, may be paid on the day any installment becomes due, by ! paying the amount thereof and interest to said date.
