Shearman !/ , ,, �) Wells ' / .- VA.CiYT " Mr.Chairman Result AN ORDINANCE .� An ordinance requiring the Oregon Short Line Railroad Company to enlarge its viaduct across its railroad tracks at the intersec- tion of North Temple Street with Fourth West Street in Salt Lake City. WHEREAS, The Oregon Short Line Railroad Company owns and operates a railroad on Fourth West and other streets in Salt Lake City, State of Utaho which railroad runs from said pity to other planes in said state and in other states, and daily employs in such service a large number of passenger and freight trains which are propelled by steam power over its numerous tracks which cross North , Temple Street at its intersection with Fourth West Street; and WHEREAS, A large number of the inhabitants of this pity reside on the west sid.e of the said railroad tracks, whose business sff*s affairs require them by day and by night to cross said tracks on foot and in vehicles at the intersections of the streets aforesaid, and the said traffic in both directions has been and now is very large and is increasing; and WHEREAS, In the year 1907, the said Oregon Short Line Railroad Company, recognizing the danger in life, limb and property to persons obliged to cross as aforesaid the tracks of the said rail- road oompany, and with a view to protect the public against said hazards, constructed a viaduct on and along said North Temple Street over said Fourth West Street, said viaduot beginning on said North -1� - ' 'e - - { Temple Street at its intersection with Third West Street and ex- tending thence west about twelve hundred feet on said North Temple Street, said viaduct having a roadway about twentywthree feet ' wide, and a sidewalk about six feet wide on the south side of said roadway, and said roadway carrying double street-car tracks; and WHEREAS, The said viaduct was at the time of its construction and ever since has been inadequate for the traffic and travel on and along said North Temple Street intended to be served by it, Y - and has now become totally insufficient for such purpose, to the great delay and inconvenience of the public, and to its danger in! life, limb and property; NO THEREFORE, Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. It is necessary for the protection of the publio, and the convenience and welfare of the inhabitants of Salt Lake City demand, that the aforesaid viaduct along North Temple Street ' over the tracks of the Oregon Short Line Railroad Company on Fourth West Street be widened, enlarged and improved as herein- after prescribed. SECTION 2. The said Oregon Short Line ailroad Company, _ I hereby directed and required to reconstruc and improve,Aat its own expense, the viaduct heretofore built by it along North Temple' ! Street, in Salt Lake City, Utah, east and west on said street across said company's railroad tracks situated on Fourth West Street and immediately adjacent thereto; said viaduct shall be of a height sufficient to permit safety clearance for all railroad ; purposes and surface traffic; it shall be wide enough to permit a olear roadway forty-one feet wide between the curbs, and shall have a sidewalk six feet wide on the outside of each curb; the . grades of the a approaches of the roadway and sidewalks on each side shall not exoeed seven per cent; at each street intersection they- shall be a. flight of steps on each side leading to the street, an. -2- in the sidewalk approaches from each end shall be incline conforming , to the grade of the roadway; the west approach shall be straightened so that the south curb of the roadway will extend due west, and the south sidewalk be continued on the same incline es the road- way to the end of the approach, eliminating any steps at that point on either sidewalk; the structure shall be constructed of either steel skeleton with concrete subgrade, or of reinforced concrete throughout, and either type of construction adopted shall conform to the standard specifications for the material employed, ' and no wooden girders, beams, floors or railings shall be used; the said viaduct shall be designed and constructed to permit the laying of double street-car tracks thereon, and to allow and sus-! P tain a concentrated live load caused by passing two fifty-ton passenger cars or by passing two trains of two thirty-ton oars having twenty-foot truck centers, or a fifteen-ton road roller, or a combination of any two of these that the width of the roadway it will permit; the said streetcar tracks shall be located on the roadway with about twelve feet between the center lines; the viaduct shall be designed and constructed so as to provide for proper drainage, and shall have a concrete curb on each sifts of the roadway on approaches, and timber curb or wheel guard on remaining portion; the surface of the roadway on the main portion of the viaduct, or wherever the grade permits, shall be of creosoted wood blocks laid on creosoted planks, and on the approaches, or in any place where the grade may be five per cent , or greater, stone blocks shall be laid, and the surface shall have a concrete foundation; all wooden stringers, planks, etc. used shall receive treatment to absorb et least twelve pounds of! creosote per cubic foot, and shall be thoroughly dried and made free from sap before they are treated. The roadway shall meet the requirements of standard specifications for such construoti4, SECTION 3. All columns, pillars or supports of the super- IS -3- structure necessarily required to be placed in any part of the street shall be so constructed and placed as not to interfere ji (materially with the public traffic) and use of such streets, and to maintain intact the City Creek Aqueduct. SECTION 4. -taireitajhe plans and specifications for the con- . i struction of said viaduct shall be made and provided by the said railroad company within sixty (60) Oteys after a Dopy of this ordinance shall have been served upon thcsaid oomp)4ny, and there- upon within said time presented to the City'Engineer and the Boar. of Commissioners of said oity for their approval. Whe.n'said plan= and specifications are approved by the City Engineer and Board of Commissioners, the said railroad pompany shall within two (2) months thereafter begin the construction of'said viaduct, and thereafter continuously carry on said work of construction, and complete the same in such time as it may reasonably do, but in any event, shall finish the entire work within eighteen (18) months from the date of service of this ordinance upon said company. SECTION 6. This ordinance shall take effect upon publieatio thereof.
