Shearman q1 -0-4---c011/14.0-i-r-"0Wells Mr.Chairman i_ V Result AN ORDINANCE An ordinance levying a tax and for the assessment of property in the territory between the south side of Third Avenue and the north side of Eleventh Avenue, and the east side of Canyon Road and the east side of H Street, in Paving Districts Nos. 24 and 30, for the purpose of providing for the grading, guttering and curbing thereof, and constructing drainage system across intersections. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Paving District No. 30, for the purpose of providing for the grading, guttering anAcurbing thereof, and constructing drainage system across interseotions, to-wit: In Lots 4, and 7 to 10, inclusive, Block 3; 1 and 2, Block 4, Plat "I"; 3 and 4, Block 41; 3 and 4, Block 42; 1 and 2, Block 43; 1, 2 end 4, Block 44; 3 end 4, Block 40; 1, 2, 3 and 4, Block 45; 1 en 4, Block 69; 1, 2, 3 and 4, Block 61, 3 and 4, Block 72; 1, 2, 3 and 4, Block Block 73; 1, 2, 3 and 4, Block 96; 1, 2, 3 and 4, Block 97; 1, 2, 3 and 4, Block 100; 1, 2, 3 and 4, Block 101; 1, 2 and 3, Block 124; 1, 2 and 4, Block 125, all in Plat "D", Salt Lake City Survey, abutting on the east side of Canyon Road between Second and Third Avenues; on,both sides of Third Avenue between Canyon Road and C -1- 21` it Street; on both sides of Fourth Avenue between B and C Streets; on both sides of Fifth Avenue between B and C Streets; on both sides of Sixth Avenue between A and C Streets; on both sides of Seventh Avenue between A and C Streets; on both sides of Eighth Avenue between A and C Streets; and on both sides of B Street between Third and Ninth Avenues. This tax is levied to defray the expense of grading, gutter- ing and curbing with cement, and constructing drainage system across intersections (roadways to be twenty-four (24) feet between curbs on Canyon Road between Second and Third Avenues; thirty (30) ii feet between curbs on Third Avenue between Canyon Road and B Street; forty (40) feet between curbs on Third Avenue between B and C Streets, oil Fourth Avenue between B and C Streets; on Fifthl Avenue between B and C Streets, on Sixth Avenue between A and B Streets, on Seventh Avenue between A arid C Streets, and on Eighth) Avenue between A and C Streets; forty-two (42) feet between curbs; on B Street between Third and Ninth Avenues; and forty-six (46) ii feet between curbs on Sixth Avenue between B and C Streets) , upon the portions of said streets opposite the property hereinbefOre and hereinafter described to be especially affected and benefited by said improvement, and it is hereby adjudged, determined and established that said property will be especially benefited there by to the full amount of the tax hereby levied, and said parcels , of land are hereby assessed at an equal and uniform rate in ji accordance with the liner foot frontage upon said portions of said streets fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed! upon said parcels of land is twenty-one thousand eight hundred twenty-five and 94/100 (421,825.94) dollars; five hundred seventy nine and 64/100 (t579.64) dollars, or one and 69/100 (41.69) dollars per front or linear foot of abutting property for twenty- four foot rodaway, there being 342.98 feet abutting said portion -2- i! 1 of said improvement; thirty-nine hundred twelve and 30/100 (03912.30) dollars, or one and 75/100 (01.75) dollars per front on linear foot of abutting property for thirty foot roadway, there ! ! being 2235.60 feet abutting said portion of said improvement; , ninety-five hundred thirty-two and 50/100 ($9532.50) dollars, or Tone end 86/100 (01.86) dollars per front or linear foot of abut- I siting property for forty foot roadway, there being 5125 feet abut ting said portion of said improvement; one hundred twenty-six and ' 50/100 ($126.50) dollars, or one end 10/100 (01.10) dollars per front or linear foot of abutting property for forty foot roadway (curb and gutter built) , there being 115 feet abutting said por- tion of said improvement; sixty-five hundred forty-six and 40/100 ( :6546.40) dollars, or one and 67/100 (:1.67) dollars per front i or linear foot of abutting property for forty-two foot roadway (with oar tracks) , there being 3920 feet abutting said portion of; said improvement; and eleven hundred twenty-eight and 60/100 (01128.60) dollars, or one and 71/100 ($1.71) dollars per front i or linear foot of abutting property for forty-six foot roadway (with oar tracks), there being 660 feet abutting said portion of said improvement, within the boundaries of the lots, blocks and streets above mentioned in said district, which is the total cost and cost per front foot of said improvement, according to the contract entered into for the performance of said work and making said improvement, with J. W. Mellen, Contractor, dated the 2nd ii day of July, 1913, and the Treasurer is hereby authorized and directed to assess, in accordance with the provisions of this ordinance,for the purpose herein mentioned: Twenty-four Foot Roadway. SECTION 2. Said tax shall become and be delinquent in five ; equal yearly installments, with interest on the whole sum unpaid li D at the rate of six per cent per annum, payable et the time each installment is due, to-wit; One-fifth thereof one year after the ordinance ootfirming the levy of the tax for the payment for such improvement becomes effective; one-fifth thereof in two years ( after said ordinance becomes effective; one-fifth thereof in three years after said ordinance becomes effective; one-fifth thereof in four years after said ordinance becomes effective; and one- fifth thereof in five years after said ordinance becomes effeotivb. One or more of said installments, in the order in which they are !' I payable, or the whole special tax, may be paid et any time within thirty days after the ordinance confirming the levy of the tax becomes effective, without interest. In the event of any install ment or the interest aforesaid not being paid on the date the 1 same becomes due, the whole amount of the special tax unpaid at the tithe said installment and interest are due, shall become due -5- ii land payable, and shall drew interest at the rate of eight per oentl Viper annum until the sale of the property assessed; provided, one or more installments, in the order in which they are payable, or the whole amount of the special tax unpaid, may be paid on the da any installment becomes due, by paying the amount thereof and interest to said date.
