An ordinance providing for the appointment of City Weighers, prescribing their duties, compensation and liabilities. Be it ordained by the City Council of Salt Lake City, Utah; SECTION 1. APPOINTMEIN'T OF CITY WEIGHERS. The Mayor shall have lthe power to appoint, subject to confirmation by the City Council, so many and such persons to be City Weighers as he may think proper,said appointees to serve and act without compensation from the City; pro- vided, that no person shall be appointed City Weigher who is engaged in the business of dealing in hay, straw nor coal; nor shall any per- son be appointed City Weigher who is the employee of or in any manner whatsoever connected with any firm or corporation dealing in hay, straw pr coal. SECTION 2. TERU OF APPOINTMEYT. The time for which any person shall be appointed City Weigher shall expire on the 31st day of December next following such appointment. SECTION 3. CE7TIFICATE OF A2POIIiTi-O hT. Upon the appointment of any person City Weigher, and upon payment by such appointee of the sum of money hereinafter named, and the execution, delivery, approval land acceptance of the bond also hereinafter mentioned, the City Re- eorder shall issue to such appointee a certificate of his appointment ( as City Weigher, and shall . in such certificate when such ap- Ipointment shall end, which certificate shall be by said appointee kept/in a conspicuous place on or near his city scales, during all the time he shall act under said appointment. SECTION 4. FEE. BOND. Every person before receiving the cer- tificate of appointment as City Weigher, mentioned in the preceding section, shall pay into the City Treasury of this City the sum of $ire 1` Dollars, and shall execute a good and sufficient bond to Salt I Lake City in the sum of Two Thousand Dollar , to be approved by the Mayor, conditioned for the faithful observance of all ordinances of ' this City, and the faithful discharge and performance of the dutiea. r1, a� r�.' • -2- i Itimposed upon him by this ordinance, and for the faithful observance of said ordinance and the faithful discharge and performance of said duties by any person who shall act under his said appointment, and will pay any and all damages occasioned to the City or to any person or persons by reason of any misstatement, misrepresentation, fraud or deceit of himself or any person acti07 for him under his appointment an City Weigher, or for any neglect to perform, or for improper per- formance by himself or any person acting under said appointment, of the duties as such City Weigher, or by reason of any violation of the provisions of this ordinance, and that the proposed obligee in said bond shall pay to Salt Lake City all fines and penalties that may be imposed upon him or any person acting under said appointment, for an; violation of this ordinance. SECTIOPT b. PUBLIC PLATFORM SCALES. All City Weighers shall pro- vide for public use a set of platform scales, which shall be of the most approved pattern in use, and shall keep the same at all times in proper balance and repair at their own e-:_pense. It shall be the duty of all City Weighers to have their scales adjusted and sealed by the Sealer ilimprellx of Weights and Measures at least as often as once in three months, and oftener if required by the Mayor. SECTION 6. DUTY OF i;,EICHE^S. CERTIFICATE. FEES. OFFICIAL SCAL7S. COi:I'LAITT. It shall be the duty of each and every City Weigher to weigh upon hie official city scales any coal, hay or other article or thing delivered at said scales for weighing, when required • so to do by any person, and to issue a certificate of weights therefo • to the applicant. Said certificates shall plainly state the gross weight of the vehicle containing the load to be welched, including driver; the weight of the vehicle, inoludin driver, without the load, and net weight of the coal, hay or other commodity; the license num- ber (if any), and the name o ' the driver delivering same; t1l:e name of the dealer or owner; the name or the city welober; and the location -3- of his official soales, for which certificate he may charge the sum of ten cents, except that no charge shall be made for any weighing done or for any certificate issued upon the demand of the sealer of jl weights and measures or any other authorized officer of the City & -49esswoorg of Salt Lake. The platform scales of all such city weighers shall be known as official city scales, and upon complaint of any person it shall be the duty of said sealer of weights and measures to re-examine and test- the same at any time for reasonable cause shown. SECTION 7. ASSISTANTS. City Weighers may employ assistants fors whose acts, neglect, misstatements, misrepresentations, fraud or de- ceit it I the City Weigher employing him or them shall be responsible as provided in the before mentioneft bond. SECTION 8. SCALES AVAILABLE DVHI:EC DAY. The official oityja cal ea shall be aStailable for use by the public as above provided, each day II in the year during all reasonable business hours, Sundays and other ( legal holidays excepted. SECTION 9. f.EGISTIP.. All City Weighers shall keep a daily register, in which they shall enter every transaction by them as City Weighers, including the gross weight of each load, the present weight jof the vehicle including the driver, the date when last weighed, the net weight of the load, the license number (if any), the name of the dealer or owner, the name of the weighmaster, and the name of the person for whom and the date when the same was weighed. SECTION 10. MUST ACTUALLY :7-'I^II. It shall be unlawful for the City Weigher to state in any certificate above required any weight, whether gross or net, without first ascertaining, the acme by actually and personally weighing the same on his said scales. SECTION 11. UNLAWFUL ACTS. SECTION 13. PENALTY. Any person violatieb any of the provisions of thin ordinance shall be deemed guilty o° a risdemeanor, and upon conviction shall be punished by a fine of les$ than three hundred dollars, or by imprisonment not to exceed six months, or by both such fine end imprisoneeent. I � SECTION 14. All ordinances and resolutions or parts of ordinan1 ees and resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 15.
