Be it enacted by the board. of Coiwussioners of 'axlt Lake C-ty, Utah: SECTION I. That Chapter IVIII of the revised Ordinances of Salt Lake City, 1920, be and the same is hereby emended by adding in and to said chapter a new section to be known as Section 1830, providing for the levy of an annual water tax, which said. Sect:j.on shall read as follows: SECTION 1020. During the month of ..1pril of each year the Board. of Commissioners at a regular laceting thereof shall, by resolution, levy upon the lands irrigated by water over which the City in acting as distributing agent such a tax per acre as may be necessary for the purpose of sapl,lying, controlling, regul Bing and distributing .itch water and con- otruct.ul" and koeping in repair the necessary r.ieans for di- verting, conveying void distributing the or,ne. such tax ohall _be based upon on annual estimate,to be furnished. the Board of Commissioners by the :Iuperti-isor of .,treats and. Irrigation prior to the passage of said resolution, of the cost and ex- penses for the ensuing year of supplying, controlling, regu- lating and distributing such water, and constructing and keep- 11 i ing in repair the necessary means for diverting, conveying and distributing the same. Said tax shall become due and payable at the office of the City treasurer on or before th- • 15th day of I:iay of each year. Upon the payment of said tax the City Treasurer is hereby authorized to deliver to the owners of water rights the certificate of Supervisor of Streets and Irrigation specifying the time when such water may be used. Until collected such tax shall be a lien upon such water rights and the land irrigated thereby. Upon failure to pay said tax on or before the 15th day of :.lap of each year the same shall become delinquent within ten days after said date of delinquency. 'Ilse City 'Treasurer shall proceed to make up a list of all property upon which such tax remains due and unpaid, and upon completion shall cause the same to be published in some newspaper having gen- eral circulation in the city, daily thereafter for a period of ten days. Said delinquent list shall contain a descrip- tion of the property delinquent according to lots, blocks or parcels, together with the owner's name or names, with the amount of taxes due on each separate parcel exclusive of costs,and shall be accompanied by a notice of sale, and unless said tax and costs. of publication are paid before date of sale the water rights and land upon which such tax is a lien shall be offered for sale and sold by the City Treasurer on the date fixed in said notice which shall be not lees than twelve days after the date of first publica- tion for the taxes, costs of advertising and expense of sal-. The procedure provided for sale of property on account of delinquent special taxes shall be followed so far as appli- cable. SECTION 2. In the opinion of the Board of Commission- ers, it is necessary to the peace, health and safety of the in- habitants of Salt Lake City that this ordinance become effectiv. immediately. -2 11 .
